RE: APPROVAL OF FOUR-LOT RECORDED EXEMPTION #4524 - GREG AND PATTY
REEVES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the
Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as
Recorded Exemption #4524, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land," and
WHEREAS, the request for Four-Lot Recorded Exemption#4524 was submitted by Greg
and Patty Reeves, 1727 41st Street NE, Anamoose, North Dakota 58710-9335, do Doug
Windsheimer,4204 West 7th Street Road, Greeley, Colorado 80634,for property which is located
in part on the following described real estate, to-wit:
Lot B of Recorded Exemption #2226; being part of
Section 16, Township 8 North, Range 66 West of the
6th P.M., Weld County, Colorado
being more particularly described in the plat which shall be provided by the applicant and known
as Exhibit "A," said plat to be recorded, and
WHEREAS, this request is to divide the property into four parcels estimated to be
approximately 121 acres, 5 acres, 5 acres, and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land."
BE IT FURTHER RESOLVED by the Board that Four-Lot Recorded Exemption#4524 by
Greg and Patty Reeves is approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(I.S.D.S.) Regulations.
2. The applicants have proposed a well as the source of adequate water for Lots A,
B, C, and D. Property owners are advised that the quantity of water available for
usage may be limited to specific uses,i.e.,"Domestic Use Only,"etcetera. Because
each situation is unique,the Department of Planning Services encourages property
owners to contact the Office of the State Engineer, Division of Water Resources
(1313 Sherman Street,Room 818,Denver,Colorado 80203. Phone 303-866-3581),
to discuss each individual situation.

3. The West Greeley Soil Conservation District has provided information regarding the
soils on the site. The applicants shall review the information and use it to positively
manage on-site soils.
4. Prior to recording the plat:
A. The Weld County Department of Planning Services approves the applicant's
proposed building envelope on Lot D, located east of and adjacent to Weld
County Road 25. The building envelope shall be delineated on the plat.
B. The plat shall be titled: Recorded Exemption No. 0455-06-2 RE4524.
C. Lots A, B, and C shall use the proposed residential access. The accesses
shall be placed in such a location to have adequate site distance in both
directions and not below the crest of a hill, or where physical obstructions
are present.
D. Lot D shall use the existing residential access, as well as existing
agricultural/oil and gas/ditch road access necessary for agricultural
operations, as no additional accesses shall be granted.
E. All approved accesses shall be clearly shown on the plat. The applicants
shall contact the Weld County Department of Public Works to determine if
a culvert is necessary at any approved road access. If a drainage culvert
is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld County's
minimum size. If the applicants choose to place a larger culvert, the Weld
County Department of Public Works must be contacted to adequately size
the culvert.
F. Weld County Roads 25 and 110 are designated on the Weld County Road
Classification Plan as local paved roads, which require 60 feet of
right-of-way at full buildout. The applicants shall verify the existing
right-of-way and the documents creating the right-of-way. All setbacks shall
be measured from the edge of future right-of-way. These roads are
maintained by Weld County.
G. The applicant shall address the requirements of Weld County School
District RE-9, as stated in the referral response dated October 2, 2006.
Evidence of such shall be submitted, in writing, to the Weld County
Department of Planning Services.
H. Lots A, B, and C shall comply with the two and one-half (2.5) acre net
minimum lot size required by Section 24-8-40.L of the Weld County Code.
Net acreage calculations shall not include reserved road right-of-way.
Lot D shall comply with the one-hundred twenty(120) acre net minimum lot
size required by Section 24-8-20.C.3 of the Weld County Code. Net

acreage calculations shall not include reserved road right-of-way.
J. The applicant shall provide the Weld County Department of Planning
Services with a Statement of Taxes from the Weld County Treasurer
showing no delinquent taxes exist for the original parcel.
K. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property
is located. Pursuant to the definition of setback in the Weld County
Code,the required setback is measured from the future right-of-way
line. No building or structure, as defined and limited to those
occupancies listed as Groups A, B, E, F, H, I, M, and R in
Section 302.1 of the 2003 International Building Code, shall be
constructed within a 200-foot radius of any tank battery or within a
150-foot radius of any wellhead. Any construction within a 200-foot
radius of any tank battery, or 150-foot radius of any wellhead, shall
require a variance from the terms of Section 23-3-10 of the Weld
County Code.
2) Any future structures or uses on the site must obtain the appropriate
zoning and building permits.
3) Lots A, B, and C are not eligible for a future land exemption in
accordance with Section 24-8-20.C.3 of the Weld County Code.
4) All structures requiring building permits shall be located within the
designated building envelope.
5) Prior to the release of building permits, the applicants shall submit
a recorded deed describing the lot upon which the building permit is
requested with the building permit applications. The legal
description on such deed shall include the lot designation and
Recorded Exemption number.
6) Prior to the release of building permits, the applicants shall submit
evidence to the Department of Planning Services that the lot has an
adequate water supply of sufficient quality, quantity, and
dependability.
7) Prior to the release of building permits, the applicant shall submit
evidence of approval from the Nunn Fire Protection District to the
Weld County Department of Building Inspections.
8) Potential purchasers should be aware that Lots A, B, and C may not
be eligible for a domestic well permit which allows for outside

irrigation and/or the watering of stock animals. The State Division
of Water Resources issues all well permits.
9) Potential purchasers should be aware that groundwater may not
meet all drinking water standards as defined by the Colorado
Department of Public Health and Environment. The Weld County
Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and
periodically thereafter.
10) Potential purchasers should be aware that approval of this Recorded
Exemption does not guarantee that well permits will be issued forthe
lots. Any lot may be deemed non-buildable if the lot owner is unable
to obtain a well permit. The State Division of Water Resources
issues all well permits.
11) Should noxious weeds exist on the property, or become established
as a result of the proposed development,the applicants/landowners
shall be responsible for controlling the noxious weeds, pursuant to
Chapter 15, Articles I and II, of the Weld County Code.
12) Building permits shall be obtained prior to the construction of any
building. Buildings that meet the definition of an Agricultural Exempt
Building,perthe requirements of Sections 29-1-20 and 29-3-20.B.13
of the Weld County Code, do not need building permits; however, a
Certificate of Compliance must be filed with the Department of
Planning Services, and an electrical and/or plumbing permit is
required for any electrical service to the building or water for
watering or washing of livestock or poultry.
13) Effective January 1, 2003, building permits issued on the proposed
lots will be required to adhere to the fee structure of the County-
Wide Road Impact Program.
14) Effective August 1,2005, building permits issued on the subject site
will be required to adhere to the fee structure of the Capital
Expansion Impact Fee and the Stormwater/Drainage Impact Fee.
15) Weld County's Right to Farm statement, as it appears in the Weld
County Code, Appendix 22-E, shall be placed on the plat.
5. The applicants shall submit two (2) paper copies of the plat, for preliminary
approval,to the Weld County Department of Planning Services. Upon approval of
the paper copies, the applicant shall submit a Mylar plat, along with all other
documentation required as Conditions of Approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by the Department
of Planning Services. The plat shall be prepared in accordance with the

requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and
additional requirements shall be submitted within sixty(60)days from the date of the
Board of County Commissioners Resolution. The applicant shall be responsible for
paying the recording fee.
6. In accordance with Weld County Code Ordinance#2005-7,approved June 1, 2005,
should the plat not be recorded within the required sixty(60) days from the date of
the Board of County Commissioners Resolution, a $50.00 recording continuance
charge shall be added for each additional three (3) month period.
7. The Department of Planning Services respectfully requests the surveyor provide a
digital copy of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf,
and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo
Coverages and Arclnfo Export files format type is .e00. The preferred format for
Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent
to maps@co.weld.co.us.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by

The Department of Planning Services has forward application RE-4524 to the Board of County
Commissioners. The applicants, Greg & Patty Reeves, represented by Mr. Windsheimer, has
submitted the attached letter dated October 30, 2006 opposing the requirements of the school
district. Application RE-4524 was conditionally approved by Planning Staff on October 20,
2006. The applicant is opposed to 4.G of the staff comments regarding the school district
requirements.

The Weld County School District RE-9 has a fee in lieu requirement to address additional
residential development in the County. It is a standard condition for all recorded exemptions to
address the conditions (if any) required by the school district. As stated in their referral dated
October 12, 2006 'Weld RE-9...has adopted a methodology to determine an in-lieu of land
payment for potentially new residential dwelling units which off sets the cost of purchasing
school land that will be used for the education of children living in these residences. The school
district methodology has been developed in a manner as to fairly apportion the cost of acquiring
school sites made necessary by residential development' The school district is requesting a
cash-in-lieu of land dedication in the amount of $759.00 per single family housing unit. The
applicant would be required to pay the school district $2,277.00 for the creation of three single
family lots.

We are herein addressing the referral letter dated Oct. 10,2006 sent by the Weld County
RE-9 School District as required by the Planning Department. I have attached copies of
All of our correspondence with the School District. As you can see from the
correspondence we attempted to get a waiver letter of the fees the District requires until
such time as a building permit is applied for. The School Board voted against such a
letter. We do not feel the fees should be paid until such time as an impact of the District
would take place. We the applicants have no intention of building any homes on any of
the exempted parcels. We therefore respectfully request approval of our Recorded
Exemption by the Board of Weld County Commissioners.

We have applied for a four lot Recorded Exemption on land we own in Section 11 within
the Weld RE-9 School District. We have received your letter for the cash in-lieu of land
payment the School District requests for any future homes that may be built on the newly
exempted land. We would like to hereby request a waiver of that payment until such time
as a building permit would be applied for on any of the exempted parcels. We do not
intend to build any homes on any of the exempted parcels. We do not feel that there is an
additional burden to the District until such time as a home would be built on any of the
parcels and would appreciate your consideration of a waiver letter waiving the fees until
time of issuance of a building permit for the exempted parcels. If the District would agree
to the Waiver of fees letter could you please mail the same to me so we can provide a

Dear Mr. Wimdsheimer,
Highland Weld RE9 School District's Board of Education in 200 t approved a cash in lieu
of land formula that established fees for property owners who are)lanning to subdivide
land, The purpose of these fees is to enable the school district to . .y y for land that will be
needed to house potential new students from new lots as a result of land being
subdivided. The board of education elected to approve this fee in order to take some of
the burden from established land owners who don't plan to create new lots that would
have the potential of bringing new students to the district.
As I understand from your request you are asking the board of edu : ion to delay
assessing this fee until building permits are granted by the county. The problem with this
is the county does not notify the school district when building . e is are being issued.
In the past the school district has contacted the county asking for i I's possibility. The
answer received is that they prefer not to do this. Therefore,the school district has no
way of collecting fees before building permits are issued and woulc not have any
leverage to collect these fees absent of the present process of requir'ng them to be paid
before a recorded exemption is granted.
Since the adoption of this policy by the Board of Education there hive been no
exceptions.allowed. The Board of Education has insisted that these fees be collected
without exception; otherwise, the inconsistency would cause probl:. : with the policy
being enforced.
Since this is a board decision and the administration has not been , : •ted leeway for
exemptions,I will present your request for exception to the board of education at their
next meeting. This meeting is scheduled for October 24i',2006, • is , at 7:00
at
the Weld R£9 School District Administration Office located at 210 ' est First Street,
Ault, Colorado. You are welcome to attend and present your request in person or the
board will respond to your letter asking for the exception.

The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be
installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.

2. The Applicant has proposed a well as the source of adequate e...cer for Lots A - D. Property
owners are advised that the quantity of water available for usage may be limited to specific uses,
i.e., "Domestic Use Only," etc. Because each situation is unique, the Department of Planning
Services encourages property owners to contact the Office of the State Engineer, Division of Water
Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to
discuss each individual situation.
3. The West Greeley Soil Conservation District has provided information regarding the soils on the
site. The applicant shall review the information and use it to positively manage on site soils.
4. Prior to recording the plat:
A. The Weld County Department of Planning Services approves the applicant's proposed
building envelope located east of and adjacent to County Road 25 on Lot D. The building
envelope shall be delineated on the plat.
B. The plat shall be titled: Recorded Exemption No. 0455-06-2 RE-4524.
C. Lots A, B, and C shall use the proposed residential access points. The accesses shall be
placed in such a location to have adequate site distance in both directions and not below
the crest of a hill or where physical obstructions are present.
D. Lot D shall use the existing residential access as well as existing agricultural / oil and gas /
ditch road access points necessary for agricultural operations as no additional accesses
shall be granted.
E. All approved accesses shall be clearly shown on the plat. The applicant shall contact the
Weld County Department of Public Works to determine if a culvert is necessary at any
approved road access point. If a drainage culvert is required, a 15 inch Corrugated Metal
Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger
culvert please contact the Weld County Department of Public Works to adequately size the
culvert.
F. County Roads 25 and 110 are designated on the Weld County Road Classification Plan as
local paved roads, which require 60 feet of right-of-way at full build out. There is presently
60 feet of right-of-way. The applicant shall verify the existing right-of-way and the
documents creating the right-of-way. If the right-of-way cannot be verified, it shall be
dedicated. These roads are maintained by Weld County.
G. The applicant shall address the requirements of Weld County School District RE- 9 as
stated in the referral response dated October 2, 2006. Evidence of such shall be submitted
in writing to the Weld County Department of Planning Services.
H. Lots A, B, and C shall comply with the two and one-half (2 1/2) acre net minimum lot size
required by Section 24-8-40.L of the Weld County Code. Net acreage calculations should
not include reserved road right-of-way.
I. Lot D shall comply with the one-hundred twenty (120) acre net minimum lot size required by
Section 24-8-20.C.3 of the Weld County Code. Net acreage calculations should not include
reserved road right-of-way.

J. The applicant shall provide the Weld County Department of Planning Services with a
Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for
the original parcel.
K. The following rn..,,s shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured
from the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups
A, B, E, F,H, I, M and R in Section 302.1 of the 2003 International Building Code,
shall be constructed within a 200-foot radius of any tank battery or within a 150-foot
radius of any wellhead. Any construction within a 200-foot radius of any tank battery
or 150-foot radius of any wellhead shall require a variance from the terms of the
Section 23-3-10 of the Weld County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Lot A, Lot B, and Lot C are not eligible for a future land exemption in accordance with
Section 24-8-20.C.3 of the Weld County Code.
4) All structures requiring building permits shall be located within the designated
building envelope.
5) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building
permit applications. The legal description on such deed shall include the Lot
designation and Recorded Exemption number.
6) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that the Lot has an adequate water supply of
sufficient quality, quantity and dependability.
7) Prior to the release of building permit, the applicant shall submit evidence of approval
from the Nunn Fire Protection District to the Weld County Building Department.
8) Potential purchasers should be aware that Lots A, B, and C not be eligible for a
domestic well permit which allows for outside irrigation and/or the watering of stock
animals. The State Division of Water Resources issues all well permits.
9) Potential purchasers should be aware that groundwater may not meet all drinking
water standards as defined by the Colorado Department of Public Health and
Environment. The Weld County Department of Public Health and Environment
strongly encourages well users to test their drinking water prior to consumption and
periodically there after.
10) Potential purchasers should be aware that approval of this Recorded Exemption
does not guarantee that well permits will be issued for the lots. Any lot may be
deemed non-buildable if the lot owner is unable to obtain a well permit. The State
Division of Water Resources issues all well permits.
11) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling
the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County
Code.
12) Building ,. .emits shall be obtained prior to the constrL_.ion of any building. Buildings
that meet the definition of an Ag Exempt Building per the requirements of Section 29-
1-20 and Section 29-3-20.B.13 of the Weld County Code do not need building
permits, however, a Certificate of Compliance must be filed with the Planning
Department and an electrical and/or plumbing permit is required for any electrical
service to the building or water for watering or washing of livestock or poultry.
13) Effective January 1, 2003, Building Permits issued on the proposed lots will be
required to adhere to the fee structure of the County Road Impact Program.

14) Effective August 1, 2005, Building permits issued on the subject site will be required
to adhere to the fee structure of the Capital Expansion Impact Fee and the
Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40)
15) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and
spacious, but they are intensively used for agriculture. Persons moving into a rural
area must recognize and accept there are drawbacks, including conflicts with
longstanding agricultural practices and a lower level of services than in town. Along
with the drawbacks come the incentives which attract urban dwellers to relocate to
rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and
the rural atmosphere and way of life. Without neighboring farms, those features
which attract urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens, field work, harvest, and gravel roads; odor from animal confinement, silage,
and manure; smoke from ditch burning; flies and mosquitoes; and the use of
pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches
and reservoirs cannot simply be moved out of the way of residential development
without threatening the efficient delivery of irrigation to fields which is essential to
farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be
found to be a public or private nuisance if the agricultural operation alleged to be a
nuisance employs methods or practices that are commonly or reasonably associated
with agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and County roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on
patrols of the county and the distances which must be traveled may delay all
emergency responses, including law enforcement, ambulance, and fire. Fire
protection is usually provided by volunteers who must leave their jobs and families to
respond to emergencies. County gravel roads, no matter how often they are bladed,
will not provide the same kind of surface expected from a paved road. Snow removal
priorities mean that roads from subdivisions to arterials may not be cleared for
several days after a major snowstorm. Snow removal for roads within subdivisions
are of the lowest priority for public works or may be the private responsibility of the
homeowners. Services in rural areas, in many cases, will not be equivalent to
municipal services. Rural dwellers must, by necessity, be more self-sufficient than
urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches,
electrical power for pumps and center pivot operations, high speed traffic, sand burs,
puncture vines, territorial farm dogs, and livestock present real threats to children.
Controlling children's activities is important, not only for their safety, but also for the
protection of the farmer's livelihood. Parents are responsible for their children.
5. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. Upon approval of the paper copies the applicant shall
submit a Mylar plat along with all other documentation required as conditions of approval. The
Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of
Planning Services' Staff. The plat shall be prepared in accordance with the requirements of
Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be
submitted within sixty(60) days from the date the Administrative Review was signed. The applicant
shall be responsible for paying the recording fee.
6. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat
not be recorded within the required sixty (60) days from the date the Administrative Review was
signed a $50.00 recording continuance charge may be added for each additional 3 month period.
7. The Department of Planning Services respectfully requests the surveyor provide a digital copy of
this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format
type is .e00. The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This
digital file may be sent to maps(@co.weld.co.us.
8. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to
the Weld County Board of County Commissioners with a staff recommendation for denial.

3. There is dry land grass which is in the Conservation Reserve Program on the parcel.
There are no buildings or improvements located on the parcel. The owner intends to keep

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): WCRs 25 and 110 are local paved roads and require a 60-
foot right-of-way at full build out. There is presently a 60-foot right-of-way. These roads are maintained by
Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the
required setback is measured from the future right-of-way line.
REQUIREMENTS:
Road Access Policy: (Policy Established Sec. 8-2-10)
Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted
by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public
Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses within
the unincorporated areas of the County. Properties within municipalities or other counties which access
County roads are subject to this policy.
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present.
Utilize the existing access for residential use to this parcel. (Lot D)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.

Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or

controlling the noxious weeds.

Weld RE-9 School District with district offices located in Ault, Colorado has
adopted a methodology to determine an in-lieu of land payment for
potentially new residential dwelling units which off sets the cost of
purchasing school land that will be used for the education of children living
in these residences. The school district methodology has been developed in a
manner so as to fairly apportion the cost of acquiring school sites made
necessary by residential development.

1. Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Ag
Exempt Building per the requirements the Weld County Code do not need building permits, however a Certificate of
Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any
electrical or water for watering or washing of livestock or poultry.
2. A plan review is required for each building except for buildings that meet the definition of Ag Exempt buildings.
Plans may require the wet stamp of a Colorado registered architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application.
Current adopted codes include the 2003 International Residential Code; 2003 International Building Code; 2003
International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2005 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole
inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado
registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will
be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured
in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback
requirements. Offset and setback requirements are measured to the farthest projection from the building.
7. Provide letter of approval from Nunn Fire Protection District prior to new residential construction.
8. There are no historical building permits on record.

Dear Hannah,
This response is prepared regarding protest of cash in lieu of land ees for recorded
exemption#4524.
Highland Weld RE9 School District's Board of Education in 200 approved a cash in lieu of
land formula that establishes fees for property owners who are pl ing to subdi ide land.
The purpose of these fees is to pay for the land that is necessary t be purchased by the
school district in order to build buildings to provide classroom sp for students who
potentially will be added to the district roles due to the potential ditional housing that will
be built on the subdivided land.
A formula which takes into account student yield at each of the t e levels,elementary,
middle and high school; site space requirements for elementary, ddle and high school;
capacity requirements for all three levels, and developed land cost was approved by the
Board of Education six years ago. The cash in lieu of land formul yields a seven hundred
and fifty nine dollar per potential dwelling unit throughout the soh of district and has not
been adjusted in the six years since this policy was adopted. i
Doug Windsheimer,Agent to Greg and Patty Reeves,petitioned Board of Ed}:tcation
requesting a waiver of the fees for this recorded exemption. The oard of Education
unanimously voted not to approve the waiver of fees for this recor ed exemption during the
regularly scheduled Board of Education Meeting on October 24, 2 06. The board feels
strongly against allowing waivers and since the adoption of this p icy no exceptions have
been allowed. The Board of Education has insisted that these fees collected wfithout
exception; otherwise,the inconsistency would cause problems wit the policy behng enforced.
