Prior to recording the Site Plan Review plat, the applicant shall address the following to the Department of Planning Services' satisfaction: The applicant shall attempt to address the requirements (concerns) of the Mountain View Fire Protection District, as stated in the referral response received August 25, 2006. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. (Department of Planning Services) The applicant shall attempt to address the requirements (concerns) of the Town of Frederick, as stated in the referral response received August 24, 2006. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. (Department of Planning Services) The applicant shall address the concerns/requirements of the Division of Wildlife as stated in their referral dated 9/15/06. The applicant shall submit written evidence to the Weld County Department of Planning from Division of Wildlife indicating all their concerns have been addressed. (Division of Wildlife) D. The application shall submit a Landscape / Screening Plan in accordance with Section 23-3-250 and Section 26-2-50, delineating the following information: NAn installation schedule which specifies when the landscaping will be installed on site. (Department of Planning Services) At least 10% of the area of a parking lot must be landscaped if the lot contains ten or more spaces. (Department of Planning Services) A minimum of 5% of the parking area shall be landscaped exclusive of setback areas. Trees planted in parking areas should be either in bays or planting islands of at least 5 feet by 5 feet. Generally, every tenth parking space should be delineated with a planting island in addition the 5%. The applicant has submitted a Private Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all landscaping, transportation (access drive, parking areas, etcetera) and non-transportation (plant materials, fencing, screening, water, signage etcetera). The applicant shall submit to the Department of Planning Services an itemized landscaping bid for review. The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the Site Plan Review plat. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 2. In the event that a portion of the building is proposed to be leased or sold to another party in the future, the applicant shall submit a copy of the lease of sales agreement and information regarding the proposed use of the leased portion to the Weld County Building Inspection Department, Mountain View Fire Protection District and the Department of Planning Services for review. Based upon the proposed use and/or impacts of the leased portion, the Department of Planning Services may require a new Site Plan Review application. (Department of Planning Services) 3. In accordance with the Weld County Code, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the Commercial and Industrial Zone District until a Site Plan Review has been approved by the Department of Planning Services. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100, C.R.S., as amended), shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,C.R.S., as amended. Waste materials shall be handled, stored and disposed of in a manner that controls fugitive dust, blowing debris and other potential nuisance conditions. The facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone District, as delineated in 25-12-103, Colorado Revised Statutes. Adequate hand washing and toilet facilities shall be provided for employees and patrons of the facility. (Department of Public Health and Environment) 10. (Department of Public Health and Environment) 13. The operation/property shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. A building permit application must be completed, and two complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report preformed by a registered State of Colorado engineer shall be required. (Department of Building Inspection) 15. A plan review must be approved and permit must be issued prior to the start of construction. (Department of Building Inspection) 16. The new office shall conform to the requirements of the 2003 International Building Code, the 2005 National Electrical Code and Chapter 29 of the Weld County Code. Setback and offset distance shall be determined by the 2003 International Building Code and Chapter 23 of the Weld County Code, (Offset and setback distances are measured from the farthest projection from the structure). Prior to the release of building permit, the applicant shall submit evidence of approval from the Mountain View Fire Protection District to the Weld County Building Department. 19. Landscaping materials as indicated in the approved Landscape / Screening Plan shall be maintained at all times. Lighting shall comply with the requirements and standards for off-street parking spaces per Section 23-4-30.E, Section 23-2-250.D and Section 23-3-250.6.6 of the Weld County Code. The building is designed for an anticipated maximum of 100 employees; the basement will be used for building services and tenant storage and break/exercise rooms. The lot size is 56,995 square feet. It is bounded on the south by Stagecoach Road North and on the north by State Highway 119. The building footprint is a nominal 75'x100' with setbacks of 155'-7" to the front (south) property line, 50'-5" to the rear (north) property line, 11 '-0" to the west property line and 87'-0" to the east property line. The adjacent property to the west is developed as a bank/office building, the property to the east is a car wash, and the properties to the north and south are undeveloped. The property is served by Lefthand Water District and St. Vrain Sanitation District. There is an existing 1" water service to the site and an existing 4" sewer service. The building architecture, as shown on the accompanying elevations, will be somewhat similar to the adjacent bank building that is under the same ownership as this property. The sloped roof and asphalt 'shake' roof shingles will tie to the adjacent building, as will the stonework at the main entry and as caps and sills around the building. The brick and synthetic stucco veneers will establish the building's own identity, as will the use of split face and ground face CMU on the west stair tower. We have reduced the number of parking spaces from 80 to 76, converting them to landscaped areas. In my meeting with Michelle Martin on November 2 to review and clarify Weld County's comments, it was my understanding that converting one parking space in the row along the east property line to landscaping would break up the parking sufficiently to satisfy the requirements; we have exceeded this change; 1D4- We have raised the existing berming along Colorado 119 to screen the ground plane development for 180' from the R.O.W.; 1 D5- Note 12 states the landscaping maintenance requirements; 1D6- Note 10 has been added stating the requirements for turfgrass installation; 1 D7- The existing tree on the site is the volunteer off-shoots of an old willow tree that had been cut down in the past. As stated in the note on Sheet 2 of 6, we do not believe these off-shoots to be of good quality or form and intend to remove them from the site and plant four new trees in the general vicinity of this tree. 1E- The Private Improvements Agreement and form of collateral will be presented, reviewed and accepted prior to recording the Site Plan Review plat, or the developer will submit evidence that all work has been completed and approved by the Department of Planning Services and the Department of Public Works. 1 F- The plat has been amended as follows: 1F1 - 'Site Plan Review SPR-401 ' has been added to all sheets; 1 F2- The scale of 1" = 20' has been approved by the Department of Planning Services due to the lot size of this project; 1 F3- The vicinity map on Sheet 1 of 6 illustrates the parcel and surrounding parcels; 1 F4- We have removed the "Required Number of Parking Spaces' from Sheet 1 of 6; 1 F5- The Landscaping/Screening Plan is provided as Sheet 3 of 6 as noted in item 1D above; 1 F6- The entrance drive flairs have been changed to 40' radius; 1 F7- Sight distance triangles have been shown on Sheets 1 and 3; 1F8- As noted in 1 D2 and 3 above, we have revised the number of parking spaces to 76, with 4 spaces meeting ADA requirements. The sidewalk to the new walk along 119 is an accessible path to the public right-of-way. The curb ramps have 1 :12 flares, therefore the sidewalk either side of the curb ramps provides landing areas for non-ambulatory users. Prairie dog removal on this site should take place prior to development or construction work begins. Trapping/transplant efforts or euthanasia are legal options for prairie dog removal. Euthanasia efforts must occur through the use of approved toxicants, and trapping and transplanting of prairie dogs requires prior approval of the Colorado Division of Wildlife. Burrowing Owls require prairie dog or other suitable burrows(e.g. badger) for nesting and roosting. Burrowing Owls are migratory,breeding throughout the western United States, southern Canada, and northern Mexico and wintering in the southern United States and throughout Mexico. Federal and state laws prohibit the harming or killing of Burrowing Owls and the destruction of active nests. It is quite possible to inadvertently kill Burrowing Owls during prairie dog poisoning projects, removal of prairie dogs, or during earth moving for construction. Because Burrowing Owls often hide in burrows when alarmed, it is not practical to haze the birds away from prairie dog towns prior to prairie dog poisoning/removal or construction activity. Because of this, the Colorado Division of Wildlife recommends surveying prairie dog towns for Burrowing Owl presence before potentially harmful activities are initiated. The following guidelines are intended as advice on how determine if Burrowing Owls are present in a prairie dog town, and what to do if Burrowing Owls are detected. These guidelines do not guarantee that Burrowing Owls will be detected if they are present. However,adherence to these guidelines will greatly increase the likelihood of detecting Burrowing Owls Seasonal Timing Burrowing Owls typically arrive on breeding grounds in Colorado in late March or early April,with nesting beginning a few weeks later. Active nesting and fledging has been recorded and may be expected from late March through early August. Adults and young may remain at prairie dog towns until migrating to wintering grounds in late summer or early autumn. Surveys should be conducted during times when Burrowing Owls may be present on prairie dog towns. Surveys should be conducted for any activities occurring between 15 March and 31 October. No Burrowing Owls are expected to be present between 1 November and 14 March. Daily Timing Burrowing Owls are active throughout the day;however, peaks in activity in the morning and evening make these the best times for conducting surveys(Conway and Simon 2003). For small prairie dog towns that can be adequately viewed in their entirety from a single location,only one survey point is necessary. The survey point should be selected to provide unobstructed views(with binoculars if necessary)of the entire prairie dog town (burrow mounds and open areas between)and all nearby structures that may provide perches(e.g., fences,utility poles, etc.) For prairie dog towns that can not be entirely viewed from a single location because of terrain or size, enough survey points should be established to provide unobstructed views of the entire prairie dog town and nearby structures that may provide perches. Survey locations should be separated by approximately 800 m(0.5 mi),or as necessary to provide adequate visual coverage of the entire prairie dog town. Number of surveys to conduct Detection of Burrowing Owls can be highly variable and multiple visits to each site should be conducted to maximize the likelihood of detecting owls if they are present. At least three surveys should be conducted at each survey point. Surveys should be separated by approximately one week. Conducting the survey Weather Considerations Because poor weather conditions may impact the ability to detect Burrowing Owls, surveys should only be conducted on days with little or no wind and no precipitation. Passive surveys Most Burrowing Owls are detected visually. At each survey location,the observer should visually scan the area to detect any owls that are present. Some Burrowing Owls may be detected by their call, so observers should also listen for Burrowing Owl while conducting the survey. Burrowing Owls are frequently detected soon after initiating a survey(Conway and Simon 2003). However, some Burrowing Owls may not be detected immediately because they are inconspicuous, are inside of burrows, or are not present on the site when the survey is initiated. We recommend that surveys be conducted for 10 minutes at each survey location. Call-broadcast surveys To increase the likelihood of detecting Burrowing Owls, if present, we recommend incorporating call-broadcast methods into Burrowing Owl surveys. Conway and Simon(2003)detected 22%more Burrowing Owls at point- count locations by broadcasting the primary male(coo-coo)and alarm(quick-quick-quick)calls during surveys. Although call-broadcast may increase the probability of detecting Burrowing Owls,most owls will still be detected visually. We recommend the following 10-minute timeline for incorporating call-broadcast methods(Conway and Simon 2003, C. Conway pers. commun.). The observer should scan the area for Burrowing Owls during the entire survey period. • 3 minutes of silence • 30 seconds call-broadcast of primary call(coo-coo) • 30 seconds silence • 30 seconds call-broadcast of primary call(coo-coo) • 30 seconds silence • 30 seconds call-broadcast of alarm call(quick-quick-quick) • 30 seconds silence • 4 minutes of silence Calls can be broadcast from a"boom box"or a portable CD or cassette player attached to amplified speakers. When all active Burrowing Owl burrows have been located and marked, activity can proceed in areas greater than 150 feet from Burrowing Owl burrows with little danger to the owls. Comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Comments ❑ This site plan is for an office building to be constructed on Lot 3, block 1 of Western Dairymen Cooperative PUD which has the infrastructure in place. ❑ This proposed development is within the Weld County MUD boundaries and shall submit to these requirements. ❑ The external roadways are capable of handling anticipated traffic from the proposed facility. u) Sight distance triangles shall be provided at all intersections. All landscaping within the triangles must be less than 3%2 feet in height at maturity, and noted on the site plan map. 'Li- Access flairs should have a 40 foot radius(23-2-160 R 6). ❑ The location of the trash enclosure will be very difficult for a compactor truck to back up and load from the dumpster. The truck will need to pull into the parking space opposite the enclosure to allow the adequate turning space. Public Works recommends the placement of signage to not allow parking in this space during hours when the trash is collected. ❑ The storm water facilities for Western Dairymen cooperative were designed for a 10 year and 100 year storm in accordance with Weld County requirements. The storm water drainage for this lot shall conform to the master drainage plan. The Fire District does not object to the request to build the building provided the requirements of the Fire District can be met. The Fire District has the following comments with regard to the submittal: • The total building appears to be about 17,327 (including the basement) square feet of type V-N construction. In accordance with Appendix III-A of the Uniform Fire Code, the required fire flow for the building is 3,5 00 gallons per minute, measured at a residual pressure of 20 pounds per square inch. This water supply is not available to the site therefore the building will need to be provided with an automatic fire sprinkler system. If this is the case,the required fire flow is 1,750 g.p.m.,which is available from the fire hydrant shown on the site plan. • Fire apparatus access appears adequate as shown on the plans. Apparatus access roads shall be maintained to support the imposed loads of fire apparatus(75,000 pounds). • Building construction plans showing the gross square footage, construction type and occupancy classification must be submitted to the Fire District for review and approval before building permits may be issued. • A final inspection of the occupancy will be required by a member of the Fire District before any Certificate of Occupancy is issued from Weld County. Nothing in this review is intended to authorize or approve of any aspect of this project that does not comply with all applicable codes and standards.
