Dates and Hours during which the assembly is to be held: August 19, 2006 from 11:00 am to 11:00 pm. 4. Maximum number of persons to be allowed at assembly at any one time: 3,700 5. The maximum number of tickets to be sold, if any: 3,500 6. Identify plans to limit number of person to the maximum identified above: There will be a set number of volunteers and employees that will be working the event That number is about 500. No one else will be allowed on the farm without a ticket and the maximum number of tickets sold will be 3,500. 7. Identify plans for supplying potable (drinking) water, including the source, number and location of facilities, and type and means of disposing of waste deposited. Bottled water will be sold throughout the day& evening to the audience. Them will be ample trash cans throughout assembly area for disposal of water bottles. The trash will also be taken to our dumpster throughout the day. 8. Identify the plans for holding, collecting and disposing of solid waste materials: Approximately 50 trash cans will be set up all over the farm and trash will be picked up and taken to a 30 yard dumpster that has been ordered for that day. We are estimating that the trash cans will be emptied on average of 2 times during the event Each trash can is about.4 cubic yards. Total needed for a dumpster will be about 40 yards. We will have the 30 yard dumpster and two 8 yard dumpster. If more room is needed, we can compact the trash with a loader. 9. Identify the plans for providing separate toilet facilities for males and females, including the source, number, and location, type and the means of disposing of wastes deposited: There are 4 stalls available in the restrooms. 2 for men, 2 for women. Then, according to Portable Sanitation Association International, 7800 Metro Parkway, Suite 104, Bloomington, MN 55425, phone number 1-800-822-3020, for 3,500 people for 12 hours, approximately 30 units are needed based on 1 unit providing approximately 200 uses However, this calculation assumes that 3,500 people will be at the special event for the duration of the 12 hours. We believe that over the course of 12 hours, we will have 3,500 visitors but those visitors will not all be at the concerts at the same time. Them will be, however, a majority of the attendance from early evening to later evening. Therefore, we will be supplying 22 units. 8 for men and 12 for women and 2 handicap stalls. Staff and bands will have separate facilities. Bid requests will be sent to Front Range Septic and United Site Services to provide the ports potties and then will have responsibility of disposing of the waste. The location of the pats- potties will be on the north and south side of the seating area. See map for location. 10. Identify the plans to provide for medical facilities, including the location and construction of any structures, the names, addresses and hours of availability of emergency medical technicians and nurses and provisions for emergency ambulance service: Currently we are negotiating with Pridemark Paramedic Services to have a booth set up and a team of three EMT's In the preliminary negotiations we are discussing having them as a non-designated service. So it is possible that, at some point, some or all of those EMT's may have to leave the event if there is a major incident outside of our event In this event they would return after that situation is satisfied. We will also have the ability to treat minor injuries, cuts, dehydration at our Central Command Post that will be located behind the stage in a separate area. This site will be an RV. 11.Identify the plans, if any, to illuminate the location of the assembly, including the source and amount of power, and the location of lamps: The location of the poles with lights are indicated on the map. The amperage and wattage of these lamps for the yard and parking lot area are 208 volts. There are 8 of those. There are also lights on the silo that illuminate the alfalfa field. The lamps in the Kiddie Korral am Mercury 120 Volts. Them are 4 in Kiddie Korral. In addition, there will be a 2 light towers in the parking area of the alfalfa field. Their location is also identified on the map. 12.Identify the plans for parking vehicles, including size and location of lots, points of highway access and interior roads, including routes between highway access and parking lots: We will be using the alfalfa field that is on the south side of the property and it includes 30 acres. The field will accommodate parking and the seating area for guests watching the bands. Included in this packet is a map and drawing of the alfalfa field and how we will be using it The point of access to the farm is WCR 3-1/4. Where we have positioned the entrance (see map) we will have a holding area for cars if any backup occurs on WCR 3-1/4. 13.Identify the plans for communications with hospital, police, and fire services, including the source, amount and location of communication equipment: All volunteers will be on two way radios with a direct link to the Delta Security Team and the Event Managers Doug Mentz, Mike Patzkowsky, Peggy Shupe, Jodi Rowley and Jim Anderson who will also have direct links to the Delta Security Team. All management personnel will have cell phones with all emergency contact numbers programmed on the phones. In the ideal situation the Delta Security Team will make the decision to contact the appropriate law enforcement and emergency agencies. However, all management staff will also have the ability to call those agencies as well. There will also be a central command center that will be used to coordinate emergency plans and treat injuries until the appropriate actions can be taken by the appropriate agencies. We will also have an EMT team onsite throughout the day. The Delta Security Team will also have two Trauma Kits. 14.Identify the plans for camping facilities, if any: There will be no overnight camping. 15.Identify the plans for fire protection: There will be no fire allowed anywhere. For immediate accidental fire like electrical fires from stage equipment or someone throwing a cigarette in the trash we will have fire extinguishers and a water truck available in the immediate vicinity. We will also notify Mountain View Fire Protection District on County Line Road 1 that them is an event at the farm that day. And, of course, we can call 911. 16.identify the plans for security, including the number of guards, their deployment, their names, addresses, credentials and hours of availability and description of peer group control, if any: : Delta Security will be providing the required number of unarmed/licensed security officers. In addition to this the Colorado Blues Society will be supplying 15 volunteers who have worked festivals in the capacity of Event Security at the Greeley Blues Festival and various other festivals. These individuals will be strictly used to monitor crowd activity and communicate with the Delta Security Team in the case of any incidents. Delta Security provides security for the Fall Festival at Anderson Farms. 17.Identify the plans for sound control and sound amplification, if any, including number, location and power of amplifiers and speakers: The Stage& Speakers will be located on the south side of the Farm house approximately .3 miles south of the closest house. Sound will be projected south. The next Closest house is to the north at.46 miles and then another house .73 miles north. All other homes are south of the stage at a distance greater than .9 miles. Sound will be projected southeast away from all homes. More detailed information will be available for the hearing. 18.If applicable, identify plans for meeting County health standards for food concessions and concessionaires who will be allowed to operate on the grounds, including the names and addresses of all concessionaires and their license permit numbers: aMAIZEing farm events will utilize their own Food License for the concessions done by us. All other vendors will be required to have temporary or permanent license for Weld County and general liability insurance naming aMAIZEing farm events as an additionally insured. The outside food vendors are limited to Oskar Blue of Lyons and Storyville Cafe of Longmont. Them may be other food concessions such as Kettle Kom but a Weld County Food licenses and proof of insurance will have to be produced in order for them to work during the festival. 23.Submit $100.00 fee for each event where three-hundred fifty (350) or more people assemble or can reasonably by anticipated to assemble at any one (1) location, unless the location is properly zoned for such assembly, in which 19.Identify the plans, if any, for an electrical system: All power to the stage will be provided by 200amp/63k diesel generators. The same type of generators used for the Longmont OctoberFest. 20.Identify the plans to ensure that trees, underbrush, large rocks and other natural features shall be left intact and undisturbed, and natural vegetative cover retained, protected and maintained so as to facilitate drainage, prevent erosion, and preserve the scenic attributes; and the plans to abate dust on the site: This is private property. 21.Attach a statement by a bonding company licensed to do business in the state of Colorado indicating its intent to furnish a bond required in Section 12-1-30.8.13 of the Weld County Code to ensure performance by the applicant of each of the terms and conditions of the temporary assemblage permit. Currently we am asking that this requirement be waived. It is our understanding that this bond is used to recoup costs of dean up associated with events that are typically held on private land. We spoke with Bruce Barker on June 14, 2006 and discussed this issue. He explained that we could ask for the County Commissioners to waive this requirement In addition if this requirement is not waived we ask that the bond amount be reduced to no more than$1000.00. This event Is on private land and we will be responsible for dean up. We have already paid a fee to Anderson Farms as well. 22.Attach a statement by an insurance company licensed to do business in the state of Colorado stating its intent to provide liability insurance, as required by Section 12-1-30.b.14 of the Weld County Code, to protect against injury to persons or property occurring as a result of such an assembly. Currently we are in negotiations with the following agency to provide insurance for our event in the amount of$1,000,000.00. As used herein, the term event means an assembly or anticipated assembly which is scheduled to last for three (3) consecutive days or less. Temporary Assembly Worksheet The following concerns are noted: 1. The main concern is the impact 3700 people and their vehicles will have on Hwy 52 and the intersection of W.C.R. 3 'A. Hwy 52 carries a high volume of traffic anyway and without some sort of control at this intersection by sworn law enforcement severe problems will exist. There is a hill just directly east of this intersection and visibility is limited at this intersection. The applicant stated in a meeting with him on 061006 that he will try to contract with law enforcement for the control of this intersection as well as a minimum of 4 law enforcement officers to work the event itself, with 2 additional officers at the above mentioned intersection. 2. Another concern is the noise from 8 different bands playing for 12 hours. The Sheriff's Office has received complaints from residents in the subdivision about the noise this event will create already. Weld County does not have a noise ordinance at this point so we would lack a vehicle to use to stop the problem. The applicant has stated that the speaker systems will be placed on the south side of the main buildings at Anderson Farms so the sound can be directed toward a open field. In the application he states the distances to these residences. 3. A concern is that there are no designated EMT's on scene so they don't get called away on other calls. The Sheriff's Office feels the need to have designated EMT's on scene with 3700 people attending. The applicant has stated that he will try to get designated EMT's on scene for the event. He also advised that 2 of his events personnel are EMT's and will have full medical kits on scene. 4. In the flyer on the internet, lSt page, lower right hand corner, it was advertised by the promoter of things not to bring to the event. It stated"Dope, we don't care...the cops do". The applicant stated that he will have this removed from the flyer immediately. He also stated they do care if there is dope as well as other items and prior to entering the property bags will be looked into by event personnel. It is our belief that this cannot be controlled sufficiently and can lead to allegations of event staff stealing items. 5. Another concern is that the alcohol served will not be controlled sufficiently to eliminate intoxicated persons from causing problems requiring law enforcement intervention as well as the potential for traffic accidents resulting from D.U.I. The applicant has stated that he has hired only reputable bartenders who have had their establishments that they currently work for run background checks to ascertain if they have ever been cited for serving an intoxicated person. The applicant stated that if they have they are not hired. He also stated that the bartenders are told to hold customers to a 4 drink maximum. In closing even if the applicant meets all the above requests the Sheriff's Office would certainly feel better about the event but cannot recommend that the event takes place due to the impact on the community and the impact on the Sheriff's Office itself. It is not a certainty that the Sheriffs Office would be able to fill a 6 man contract to the applicant. These concerns have been discussed with the applicant. We have had a very good working relationship with both Peggy and Jim and the rest of the Anderson farm employees. They seem to run a profitable and good business. However I am greatly concerned about the coming concert that I heard about last week. It is my understanding that alcohol with be served or allowed on the property during the concert to the attending parties and that there will be up to 3500 participants. From my experience of running a bowling alley with a bar, if you have several people that are drunk you have your hands full, even if they have friends to take them home and they have been drinking for only an hour or two. With the large size of the crowd and partying for 12 hours, you must assume that there will be hundreds that have had a little to many, especially if they drink after dark. I am also concerned about the traffic on 3 1/4 road. We have accepted bids for some very large jobs that depending on the weather will require us to run a large number of gravel trucks on the day of the concert. Those trucks plus 1000 + cars will be a major traffic issue. I am also very concerned about the load music after dark for the tenants on our property. It was our understanding from the town meeting held prior to the county issuing the alcohol permit to Anderson Farm that alcohol would only be served at small wedding and reunion parties similar in size to ones held in the past. The neighbors attending the meeting agreed to not contest their application based on that fact. It is very evident that this will exceed that amount many times over. I spoke to Peggy last night and it appears that they have already signed an agreement to hold the concert and may be hurt financially if they cannot perform. If this is the case one way to compromise would be to allow the concert but only during daylight hours and without any alcohol being served or allowed on the property during or after the concert. The concert should be shut down in time to allow the crowd to leave before dark. We would also need to have at least 20% of the traffic directed to come down WCR 5 to the East edge of their property and another 20% of the traffic to come from WCR 16 '/z to the North, so we do not have major traffic issues at the intersection of WCR 31/4 and HWY 52. If these issues can be addressed and they would agree to sign an agreement to never apply for or hold a similar event in the future I would be amicable to allowing this one time event. Box 758 Greeley, CO 80632 On May 10`h, 2006 we found a poster in a restaurant bathroom advertising a Blues concert at Anderson Farms in Erie, Co (unincorporated Weld County). The same day, we called Weld County Planning & Zoning (970-353-6100) to ask if this was in compliance with their agriculture status parameters. We were told this would require the issuance of a "temporary assemblage permit" from the board of county commissioners, which, after checking, had not yet been applied for. They agreed to call Anderson Farms about this- and they did the same day-and promptly sent an application packet to Anderson Farms. On May 20, 2006 hundreds of post cards advertising the event were passed out at the Erie Town Fair, and as of May 23, 2006 still no permit had been applied for. It is our belief that they intended to host the event without a permit until we notified the county and they in turn notified Anderson Farms . Do we really want to legally permit an event that tries to cheat right from the beginning? What else do they have planned that they "conveniently" forgot or will plead ignorance about? When Anderson Farms wanted a liquor license, they held a neighborhood meeting . Peggy Shuppe looked us in the eye and PROMISED, YES PROMISED, us that alcohol would only be served a reunions, weddings, and company meetings/picnics---and never at a large event. So we did not disagree. She has been less than forthright on past issues and we can no longer trust what she says, especially now that we found out that this entire event was planned PRIOR to even applying for a permit! Noise will certainly exceed allowable limits. Remember Folsom Field at C.U. in Boulder- --NO MORE concerts due to the noise levels. Anderson Farms is just too close to our homes for this type of event. Off-site security will be a guaranteed problem. During the Fall Festival at Anderson Farms. People urinate and leave their trash on our property and we are stuck cleaning it up. They also park on County Road 5 and sneak through the fields to avoid paying the entrance fees. Those are family people---what on earth will concert goers do? Yes, we can call the sheriff, but the response time is about 20 minutes, and by the time the sheriff arrives, the offenders will already be gone. More seriously, alcohol WILL be served, people will get into their cars and funnel onto HWY 52, 125, and HWY 287. There is no light at CR3 ''A and HWY 52 who will police all the traffic at this intersection/ (It sits at the bottom of a small hill.) And WHO will keep partiers from taking a swim on a hot summer night at the gravel pit ponds directly across the road? This is a REAL safety concern! EXHIBIT When most of us moved here, Anderson Farms was a quiet, small, family-type corn maze for 1 month out of the year. Now they have mushroomed into a very noisy, alcohol serving party center under AGRICULTURE STATUS. (We're not sure how hundreds of screaming people running through corn fields & being chased by noisy chain saws at 11:00 at night relates to AGRICULTURE . Now they plan to add concerts to their list of events, and we must ask that you not allow this. The closest homes are in a PUD and you tax us on the high value of our homes yet do nothing to protect these values.
