How is the proposed rezoning consistent with the policies of the Weld County Code, Chapter 22? If the proposed rezoning is not consistent with the Comprehensive Plan, explain how the proposed rezoning will fit with what the applicant perceives as the changing conditions in the area. The proposed zoning change from R1 to PUD is consistent with the Weld County Code requirements. We are requesting the PUD zoning designation to specifically use the property for agricultural uses, leasing of an outbuilding and surrounding area to a Lawn and Landscape Service for equipment and materials storage, and possible future use of that facility for other uses by right as outlined in the AG zone district. When we bought this property in July 2003 we were told that the property was agricultural, the pasture was leased for horse grazing and the landscape company had a lease with the previous owner. 2. How will the uses allowed by the proposed rezoning be compatible with the surrounding land uses? Include a description of existing land uses for all properties adjacent to the subject property. The surrounding land uses are consistent with PUD requirements. In the adjacent properties there is agricultural use, farm animals, profit leasing of pasture/land for horse grazing or crop growing, in addition there is outdoor storage and storage outbuildings. 3. Will the property use a septic system or public sewer facilities? The property will use the existing septic system. Please reference SE0200111 and ISDS02-108. We are in the process of having a Septic Analysis by an Engineer. 4. Who will provide adequate water, including fire protection, to the property? The property will use the existing water and fire protection. A letter from Longs Peak Water District is provided. 5. Does the property have soils with moderate or severe limitations for construction? If yes, the applicant shall submit information which demonstrates that the limitations can be overcome. Soil information has been provided. In addition, there are no plans for construction. If in the future, construction of a building is needed all County Code regulations will be followed. loft 6. Is the road and/or highway facilities providing access to the property(ies) adequate to meet the requirements of the proposed zone district? If not, the applicant shall supply information demonstrating the willingness and financial capacity to upgrade the road and highway facilities. The road and highway, currently in use, has demonstrated it's efficiency to meet the requirements of rezoning for the past 3 years. 7. Is there a sand, gravel, or other mineral resource on or under the subject property? If so, the applicant shall provide a mineral resource statement prepared by a certified geologist or other qualified expert. The statement shall indicate the estimated quantity of resources and the economic feasibility of recovery, now and in the future, of the resource(s) so that the Planning Commission and Board of County Commissioners can determine whether a commercial mineral deposit is contained on or under the subject property(ies) as defined by Colorado Revised Statute. To the best of our knowledge there is no sand, gravel or other mineral resource on or under the subject property. There are no inactive or active indications of any resources. We have provided copies of the mineral ownership. Due to the size of the property and the existence of structures it would not be economical to mine the property. 8. Is the change of zone located in a flood Hazard Overlay District? The subject property is located in an area with special flood hazards. Equipment includes; trucks and trailers,mowing equipment, and snow plows. Materials stored on site include,trees and shrubs,mulch,rock,and flagstone. Turf Masters Lawn and landscape Inc.does not dispose of any Waste Chemicals at this location,such as fertilizer or pesticides. Waste materials from equipment maintenance operations (used motor oil) are collected and delivered to an auto parts store for recycling. Vehicles and equipment are not washed on site,this is done at a car wash in Longmont. The Department of Planning Services previously made the determination that the materials that are typically submitted in the site plan review application process should be submitted to provide the exact details of the proposed use. This is in lieu of requiring a separate site plan review application and fee after the change of zone application has been processed. Staff is not charging an additional application fee for this submittal. Staff has determined that the following additional information is required before your application can be deemed complete: 1) Adjacent County Roads need to be identified on the plat. 2) The access point(s) into the facility/property need to be identified in writing on the map. 3) A list of the types (for example, are the trucks 1 ton pickup trucks? Dump Trucks?...) and sizes of equipment will be on site along with the numbers of equipment that will be stored on site. List the type and size of equipment (for example, are the trucks 1 ton pickup trucks? Dump Trucks?...). 4) Any screening/landscaping proposed for the vehicle and storage areas shall be indicated on the map. 5) Indicate what employees are part-time vs. full-time employees. Also indicate how many employees will be coming to and from the site regularly to pick up vehicles and materials and how many employees will not be coming to the site (will go directly to the job sites). 6) Hours of operation (how many days a week) shall be clarified. 7) All existing and/or proposed buildings shall be labeled on the map. 8) Make sure that all existing and proposed uses on the property are outlined. The change of zone application is going to be readvertised and sent out for referral to include all of your existing and proposed uses on the property (not just the landscaping business). Parking We were not aware of the limit on parking within the 60' Right of Way. We have measured and marked the line of the right-of-way and have notified Turf Masters that all parking/equipment/storage will be behind that line. They have complied with this request at this time. 2. Additional Traffic The landscaping company, leasing the outbuilding and surrounding area, was here when we purchased this parcel. There will be no increase in traffic on County Road 3 because we are not making any changes to the use of the parcel. Turf Masters has 6 full-time employees and may hire part-time in the busy season. Some of the full-time employees take home the company trucks. There are only two employee vehides that remain on the property during the day because of carpooling and the personal use of company trucks. Second Access Point into Parcel The outbuilding was built about 20 years ago. I believe that permission was obtained, at the time the building was built, to allow the second access onto the parcel. In order to eliminate the second access and use our residential access, we would have to cut down several trees and bushes. We would prefer that the landscape company use the opening that goes directly into that area of the parcel, which would be better than trying to share our smaller access onto our residential area and would save the trees. I have also endosed a copy of the original Plat Map from King Surveyors that you did not receive. I am not certain why you didn't get the cog ett map and hope that this will clear up all of your other concerns covered in the memorandum. Please feel free to contact me with any questions.
