Dear Burt :
With respect to your e-mail of June 7, 2006, in order to prepare
an open space deed, you would need to provide me with the legal
description or identify what parcel is to constitute open space. In
addition, if you are speaking about the covenants that I am aware of
for Twin View, they do not contemplate a HOA, and would therefore have
to be redrafted if a HOA is to be involved. A redrafting of that
magnitude would definitely not fit within my timeframe within the next
week. I am curious as to why a HOA would even be required unless
there are matters to be dealt with beyond what are handled in your
existing covenants . Our "template" HOA organizational documents are
designed to correspond to a far more comprehensive type of protective
covenants . We should perhaps discuss if there is some other
alternative to forming a HOA for this project . For example, perhaps
your existing covenants could be amended to simply impose an open
space restriction on whatever parcel is to remain as open space, and
then you could then place title to that parcel in a separate entity
with no other assets . This differs from a typical ROA in that the
covenants would not address the ability of the other owners to govern
ownership and use of that entity. Again, involving the various owners
as members in an actual HOA would also involve a significant redraft
of your covenants .

The following information addresses the supplemental information required at the final plat
phase of the Twin View Estates development.
A. Twin View Estates will be a rural residential development that will adhere to the
Estate Zone District requirements. Covenants may be more restrictive than the
Estate Zone District.
B. A total of Nine lots will be in the subdivision.
C. On-street parking will not be permitted or necessary, due to the large rural
residential lots.
D. The open space will be deeded to the homeowners association and it will be the
HOA's responsibility to maintain the open space.
E. Water will be supplied by Little Thompson Water District. An agreement was
approved by the LTWD Board of Directors on August 4, 2005. The agreement
was included with the COZ submittal and was approved by the Weld County
Attorney. A copy of the agreement is attached.
F. Covenants are attached.
G. A determination was provided by the law firm of Hasler, Fonfara and Maxwell
LLP regarding the irrigation ditch at the COZ submittal. Please see attached
correspondence.
H. Three copies of a subdivision improvements agreement are attached.
I. Three copies of an off-site road improvements agreement are attached.
J. Three copies of the final drainage report are attached.
K. Road plans stamped by a Professional Engineer are attached.
L. A warranty deed which deeds the open space to the HOA will be provided with
the final mylar plat.
