RESOLUTION
RE: VACATION OF DEVELOPMENT STANDARDS WITH ZONING CASE NUMBER
236, GOLOBE, LUCAS AND ESTAVENOVICH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on March 25, 1974, Zoning Case Number 236 was approved
C. by the Board of County Commissioners of Weld County, Colorado, and
WHEREAS, said Zoning Case was approved conditional upon four-
77 teen (14) Development Standards, and

—"' WHEREAS, the Department of Planning Services recommends that
the above mentioned Development Standards be vacated, and
WHEREAS, the Department of Planning Services further recom-
mends that approval for vacation of said Development Standards

BE IT FURTHER RESOLVED by the Board that the approval of the
vacation of said Development Standards is conditional upon the

constructed, maintained and kept free of debris by the applicants
and/or owner. The fence shall serve to screen the property' s
southern-most boundary from the mobile home park; and 2) Prior
to any building permits being issued for this property a geotech-
nical study is to be done to show that there is not a methane
gas problem.

The following business was transacted:
I hereby certify that pursuant to a notice dated October 13, 1982,
duly published October 14th, 1982 and November 4, 1982, in the La Salle
Leader, a public hearing was held on the request of Golobe, Lucas and Estavenovich
_for the vacation of the development standards with zoning case #236 and the
addition of two development standards. The Planning staff recommended that the
original fourteen development standards be vacated with the following additions:
1) A wooden fence, six (6) feet in height shall be constructed, maintained and
kept free of debris by the applicants and/or owner. The fence shall serve to
screen the property's southern-most boundary from the mobile home park; and 2)
prior to any _building permits being issued for this property a geotechnical study
is to be done to show that there is not a methane gas problem. The applicant
was represented by a realtor from a Fort Lupton firm. He answered questions.
After review, Commissioner Steinmark made a motion to vacate all fourteen
orginial development standards with the contition that the two conditions listed
above be adopted and accepted by the applicant. There were no objections. Commissioner
C. Carlson seconded the motion and it carried unanimously.

Subject: Methane at Ft. Lupton/Brighton Landfill
Recent monitoring (Sept. 21) by personnel of the Environmental Health Services
Division of the Weld County Health Department indicates that no methane is migrat-
ing offsite from the closed Ft. Lupton Landfill site, at least in the direction
and depth of the monitor wells.
Monitor wells located in the body of the former site do, however, show
significant levels of combustible gases (60%) . Our monitor wells offsite
are located south and west of the former facility and are approximately 15 feet
deep. No methane or combustible gases were found in those monitor wells.

Dear Mr. Allison:
We have reviewed the Souther application for a change of zone, and we have
-the following comments.
1 . The plat shows a 20-foot access easement within this property along the east
U.S. Highway 85 right-of-way line. We would like to emphasize that U.S. 85
is an access-controlled highway, and no direct access is permitted except
at existing public roads or deeded private access openings. This property
has no deeded access openings to U.S. 85.
We recommend that access be located well to the east o₹ U.S. 85 on County
Road 6i rather than at the access easement along the east highway right
bf way. Vehicular use of the easement could result in traffic conflicts
due to the limited distance for turning movements between the highway
-and this easement.
2. An industrial development on this 14.5-acre parcel could generate enough
traffic to warrant the installation of a median left-turn lane and a right-
turn deceleration lane on U.S. 85 at County Road 6z. We ask the County
to consider requiring these improvements as a condition of development
if they are warranted based on criteria in the State Highway Access Code.
A left-turning design hour volume onto the county road of 12 or more
would warrant a left-turn lane. A total design hour volume of 25 or
more would warrant the right-turn deceleration lane.

THE DEPARTMENT OF PLANNING SERVICE'S STAFF RECOMMENDS THAT THIS REQUEST BE
approved FOR THE FOLLOWING REASONS:
It is the opinion of the Department of Planning Services staff that
vacation of the development standards associated with the "I-3" district
is consistent with the Weld County Comprehensive Plan, and the proposed
district will be compatible with the existing surrounding land uses and
future development.
-These determinations are based in part upon a review o₹ the application
materials, other relevant information regarding the request and responses
of the referral entities which have reviewed the request.
The Department of Planning Services staff recommendation for approval is
conditional and based upon the following:
1. A wooden fence, six (6) feet in height shall be constructed,
maintained and kept free of debris by the applicant and/or
owner. The fence shall serve to screen the property's southern-
most boundary from the mobile home park.

- The Fort Lupton Planning Commission recommended Industrial II
Zoning for the subject site. I-2 districts require screening
from adjacent public rights-of-way, residential districts, some
commercial and industrial districts. Since the mobile home park
is a non-conforming use and zoned agricultural, the suggested
condition (wooden fence) would satisfy the requirements of an
I-2 District.
- She Fort Lupton Planning Commission thought that the possibility
of methane gas existed on the subject site because of the abandoned
dump site north and adjacent to Weld County Road 61.
- In a letter dated September 3, 1982, the State Highway Department
expressed concerns about possible increased traffic on U.S.
Highway 85 from the subject site. Prior to issuance of a
building permit, a site plan review would require the subject
site to comply with the performance standards on the I-3 zone
district. The performance standard set forth in Section 34.5.1.5
or the Zoning Ordinance addresses the State Highway Department's
concern.
