The applicant for 3rd AMUSR-842, Dwain Immel has submitted the attached letter dated March
21, 2006 with supporting documents addressing 1.A, 1.6, 1.C and 1.D that were required prior
to scheduling the Board of County Commissioners hearing. 1.A was regarding sign-off from the
mineral owners on site, 1.6 was regarding the Division of Water Resources, 1.C was regarding
a signage plan and 1.D is regarding a screening plan.

Dear Jacqueline:
Per our discussion, enclosed is our response to the four (4) items we discussed in your
March 7, 2006 letter that you needed Tire Recycling, Inc. (the "Applicant") to address
prior to the County Commissioners scheduled meeting in April.
A. Section 22-5-100.A of Weld County Code requires notification of oil and gas
and mineral owners interest and that their activities have been adequately
incorporated into the design of the site or show evidence that an attempt has
been made to mitigate the concerns of the mineral owners.
Applicant: We have identified all of the existing drilling envelops on the
Property and have notified the mineral owners in writing of the tire recycling
activities. The crumb rubber building and related operation at the Tire
Recycling, Inc. site will not encroach or encumber with any oil and gas
drilling and production activities. Any future mineral development will be
conducted outside of any building envelope on the property. The Applicant
has worked with the mineral owners for the past 25+ years to allow them
reasonable access to their mineral rights and ability to produce oil and gas
from their leases and will continue to do so in the future. The plat identifies
the existing oil and gas wells and future drill sites.
B. Applicant shall address concerns of the Colorado Division of Water Resources
as stated in their January 9, 2006 referral letter.
Applicant: Applicant does not intend to use any irrigation water wells as part
of its fire suppression system. The primary method of fire suppression of a
tire fire is to cover any tire fire with dirt, which the Applicant has adequate
supply on site and which is the preferred method of putting out tire fires.
After discussions with employees in the Colorado Division of Water
Resources on March 7, 2006, Applicant was informed that since they were not
going to use water from any irrigation well as part of the fire suppression
system for any potential tire fire, the Applicant would not need to amend any
of the water permits currently issued to third parties and leased to the
Applicant.

C. The Planning Department asked the Applicant to submit a "signage plan" to
the Department of Planning Services.
Applicant: The Applicant does not plan on making any changes to its existing
signage currently in place on the property, therefore Applicant would like to
have this request deleted from the Planning Departments requested changes to
the 3rd Amended USR-842 permit.
D. Tires have been placed adjacent to all County roads to discourage trespassers
from accessing the site. This is not an acceptable fencing method according to
the Department of Planning Services. The Department would like to
recommend that the Applicant submit a fencing plan to the Department to
ensure the facility is secure and not accessible to unauthorized personnel.
Applicant: The Applicant would like to request an exception to the
Department of Planning Services request to amend our fencing plan. The
County has allowed the Applicant to use large off-the-road ("OTR") tires as a
fence barrier around the perimeter of the property for the last 25 years to
ensure the facility is secure and not accessible to unauthorized personnel.
This method has worked in the past and is expect to be adequate in the future
to prohibit unauthorized access to the property in the future. Requiring a
change in this fencing would require a large and unreasonable cost to the
Applicant and would not serve any beneficial use. The existing large OTR
tire barricade has proven to be an effective barrier to secure the property in the
past and is expected to be adequate in the future. This property is unique in
Weld County, since it is the only legal tire monofill facility in the County and
one of only three (3) licensed monofill facilities in the State. Large OTR tires
are expected to be located on this Property and the use of them as a fence
barrier is a natural and beneficial use for a tire monofill facility.

RE: Amended Special Use Permit#842 for Tire Recycling, Inc.
Dear Jacqueline:
Attached is a copy of the letter we recently received from Noble Energy related to our
crumb rubber building and operation at our Hudson site.
In addition,you asked us to respond to a couple of other items prior to you placing our
Amended Special Use Permit application on the County Commissioners agenda.
1. The permit to use the Moser water wells as a fire prevention source well.
2. Any signage changes for the Tire Recycling, Inc. site.
First of all we are going to use an alternative fire suppression system approved by the
Platteville Fire District, since the use of water for fire suppression for any potential tire
fire is not the best alternative. Therefore we will not be using the Moser well in any fire
suppression capacity for our crumb rubber operation or for any fire suppression for the
site. We will be canceling our permit with the Moser's on this well.
Secondly,we do not anticipate any signage changes on the Hudson site. The existing
signs we have on the location are expected to suffice.

Mr. Dwain Immel asked Noble Energy Production, Inc. ("Noble") to determine whether
the structure that has been erected at 12311 Weld County Road 41, and his firm's
business operations there, would interfere with Noble's existing oil and gas operations on
the property at this address. Noble has reviewed the plans, specifications, and visually
inspected the site, and determined that they will not interfere with Noble's Field
Operations

I have been in contact with Mr. Dwain Immcl & Mr. Mike Venditto in
regards to the new building and operation at the Tire Mountain facility.
With the square footage of the building they have built it dose require a fire
suppression system. The only problem is the available water in this area.
The 2003 international Fire Code dose allow alternative suppression systems
other than water. I am willing to allow one of these alternatives for this
project.
In the case of a fire in one of the cells, dirt will be used to cover that
cell. Available dirt and the equipment needed are on site. Water will only
be used to protect the cells next to the cell that is on fire. If anything further
is needed please call me at the above number.
