OP//I(Mg lbTETRA TECH RMC September 6, 2006 Ms. Jacqueline Hatch, Planner II Department of Planning Services Southwest Office 4209 CR 24.5 Longmont, CO 80504 RE: Amended Recorded Exemption AMRE- 1363 Dear Jacqueline: On behalf of Michael and Yolanda Martinez, I respectfully submit this letter and attached documents as a response to the Conditions of Approval for the Amended Recorded Exemption dated July 11, 2006. Condition 1: Currently,no new septic systems are planned for the new lots. We anticipate that any new development on the property will be served by the Tri-Area Sanitation District; however, if a new septic system is required, a permit will be obtained and the system will be installed in accordance with the Weld County Individual Sewage Disposal System(I.S.D.S.) regulations. Condition 2: A. The plat is titled: Recorded Exemption No. 1313-25-1 AMRE-1363. B. It is understood that Lots A and B will use the existing access points and no additional access points are being granted. C. All approved, existing accesses are shown on the plat. No new access points are proposed. D. The plat shows the 60' ROW for Weld County Road 18 for future full build-out. Documentation that the ROW exists is noted on the plat. It is acknowledged that the road is maintained by the Town of Frederick. E. We have contacted the Town of Frederick regarding the need for an access permit and any additional requirements needed to obtain or upgrade the permit. Please see the attached letter to Richard Leffler with the Town of Frederick. F. The property owners will apply for building permits on any new structures located on the properties which require building permits, with the Department of Building Inspection for Weld County or the Town of Frederick, depending on the jurisdiction at the time of building permits. All respective building codes and requirements of the jurisdiction will be followed. According to the letter from the New Consolidated Lower Boulder Reservoir&Ditch Company, neither the Lower Boulder nor the Coal Ridge Ditches had any objection to this application. However, the Secretary of these Ditch Companies did make a general request that the County refer all applications that affect the South Platte Supply Canal to both the Lower Boulder Ditch and the Coal Ridge Ditch. H. There are no inoperable vehicles or other noncommercial junkyard items visible from County Road 18 or adjacent properties. I. An updated Statement of Taxes from the Weld County Treasurer showing no delinquent taxes will be provided when the mylar plat is submitted for recording. J. All of the requested notes have been added to the plat. Condition 3: Two paper copies of the plat are included with this letter for your review. Upon your approval of the plat, a mylar plat and recording fees will be submitted. Condition 4: Same as Condition 3 —see above response. Condition 5: The applicants acknowledge that if the plats are not recorded within 60 days of the Administrative review, an additional $50.00 recording continuance charge may be added. Condition 6: A digital file of the Amended Recorded Exemption will be provided to the County when the mylar plat is submitted. Box 435 Frederick, CO 80530 RE: Amended Recorded Exemption AMRE-1363 and Recorded Exemption RE-4448 Dear Mr. Leffler: We are in the process of completing an Amended Recorded Exemption and a Recorded Exemption application for Michael and Yolanda Martinez(see attached maps). The properties included in the applications are along WCR 18. As part of the review process for the two Exemption applications, the Weld County Public Works Department indicated that because Frederick has jurisdiction and maintenance over all access to WCR 18, we should verify the need for an access permit from Frederick. These applications were referred to Frederick for comment and this was not raised as a concern. In addition,we do not believe an access permit will be necessary at this time because, as you will see on the attached plat maps, no new access points are being proposed as part of this application. If you do not agree or have any questions regarding this matter, please contact me by Wednesday, August 23, 2006 so that we can address any concerns before recording the plat maps. No structures are proposed to be constructed on the properties included in these applications at this time; however, it is understood that while the properties are under the jurisdiction of Weld County, if any structures are built on the property, the following would apply: 1. Building Permits would be obtained prior to the construction of any building. All necessary electrical and plumbing permits would also be obtained, when applicable. 2. All building plans, except for Ag Exempt building plans, would need to be reviewed and some plans might require the wet stamp of a Colorado registered architect or engineer. 3. Buildings would need to conform to the requirements of the Codes adopted by Weld County at the time of permit application. 4. If a site-specific geotechnical report determines engineered foundations are necessary, the foundations will be designed by a Colorado registered engineer. 5. As part of the plan review, the County will review the fire resistance of walls and openings, construction requirements, maximum building heights and allowable areas. In addition, it is understood that setback and offset distances are determined by the Zoning Ordinance. 6. Building height and size and offset and setback requirements would need to conform to all related standards as set forth in applicable sections of the Weld County Code. 7.
