Dear Commissioners:
At yesterday's meeting one of the Board members alleged his unfamiliarity with the annexation
process. May I suggest that he consult CRS 31-12-101 et seq.,The Municipal Annexation Act of 1965.
It goes into great detail.
Once again a Board member brought up his concerns for property owners being protected in
exercising their rights to the fullest extent. Implicitly, this inferred a lack of consideration for the rights
of the public. However, on last analysis, there are no inherent property rights, only are those granted
property owners by the public. To give an extreme example, Article 5 of the U. S. Constitution states
that: "nor shall private property be taken for public use without just compensation". However, in an
unlikely event, this right might be repealed by an amendment to the Constitution ratified by the
Legislatures of three fourths of the several states; those legislatures being the representatives of the
public.
Thus, it might behoove the Board to give greater consideration of the public, and its rights and
welfare, in making wiser land use decisions.
