RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #11 - BETTY JO
HADLEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #680361, dated December 11, 1968, the Board of County
Commissioners approved Use by Special Review Permit #11 for a Dog Kennel Operation for
Betty Jo Hadley, 2000 West 92nd Avenue, Space 259, Denver, Colorado, on the following
described real estate, to-wit:
Part of the W1/2 of Section 9, Township 1 North,
Range 68 West of the 6th P.M., Weld County,
Colorado, being more fully described in Exhibit A, a
copy of which is attached hereto, and
WHEREAS, the Board has received a request from David Dugan, 4630 Weld County
Road 5, Erie, Colorado 80516; David Samoljan, 556 Weld County Road 16.5, Longmont,
Colorado 80504; Michael Thorne, 4620 Weld County Road 5, Erie, Colorado, 80516; Lawrence
Stuart, 4540 Weld County Road 5, Erie, Colorado 80516; and Anthony and Janet Cozza, 4520
Weld County Road 5, Erie,Colorado 80516,current property owners,to vacate said Use by Special
Review Permit#11, since the use is no longer being performed on the property, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicants and the recommendation of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#11 be, and hereby is, vacated.

more particularly described as follows: Commencing at the West quarter-corner of said
Section 9 and considering the West line of said Northwest Quarter(NW1/4)to bear North
00°00'00"East and with all other bearings contained herein relative thereto:thence North
00° 00' 00" East, along the West line of said NW1/4, 678.71 feet to a point from which

SUBJECT: Vacation of SUP-11
DATE: January 11, 2006
The Department of Planning Services has received the attached letters dated January 8, 2005,
and April 1, 2005 from David Dugan, David Samoljan, Michael Thorne, Lawrence Stuart, and
Anthony & Janet Cozza. The property owners are requesting that SUP-11 be vacated from the
following parcels, 1467 09 000057, 1467 09 000011, 1467 09 200089, 1467 09 200088, 1467
09 000058, 1467 09 000018 since the use is no longer being performed on the property.
Background information:
Legal Description: Part of W2 of Section 9, Ti N, R68W of the 6T" P.M., Weld County,
Colorado
Location: Approximately 1/2 mile east of County Road 5 and approximately 'A south
of County Road 12
SUP-11: SUP-11 was approved by the BOCC on December 11, 1968, for a Site
Specific Development Plan and Special Review Permit for a dog kennel
operation in the A (Agricultural) Zone District.
