HomeMy WebLinkAbout20063396 RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600284 AGAINST NEAL AND BETTY BOAL FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Neal and Betty Boal,VI#0600284,are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of December, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation,and WHEREAS,Neal and Betty Boal were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to continue this matter until January 9, 2007, to allow adequate time for the property owners to burn the mobile home and remove all debris. I have scheduled a meeting with the Board of County Commissioners on December 12,2006, at 10:00 a.m., to consider the violations occurring on the property. We also briefly discussed the mobile home. After research of my case files and computer, I still have not been able to locate any valid permits for the mobile home. Therefore: I. The presence of a NONCOMMERCIAL JUNKYARD consisting of Derelict Vehicles,tires, iron/metal and miscellaneous debris. (Please see definitions listed below) The Noncommercial Junkyard shall be removed, restored or completely screened from all adjacent properties and public rights-of-ways. ► The presence of a DERELICT MOBILE HOME; however, regardless of its condition, I have been unable to locate any permits necessary to have the mobile home. A NONCOMMERCIAL JUNKYARD may also include the storage or keeping of DERELICT VEHICLES registered last or currently registered under the property owner and/or tenant's name. This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or STRUCTURE or visually SCREENED from all ADJACENT properties and public rights-of-way.
