The site has been recommended for inclusion in the MRESA Planning Commission Summary 6 Andersen Annexation r by the Greeley Planning Commission. City Council will make a final decision at the June 6, 2006, City Council Meeting on whether to include the site in the MRESA. To date there has been no objection to its inclusion. The site is currently outside the Municipal Service Suitability Area (MSSA). This means that full urban services, are not available to the entire site at this time. The annexation complies with Comprehensive Plan policy GR3.4 as shown in the analysis section below. ANALYSIS: The areas of annexation comply with Colorado Revised Statute 31-12-104 and 31-12-105 and include: (I)Not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed is contiguous with the City of Greeley; (2) A community of interest exists between the territory proposed to be annexed and the City of Greeley; (3) The territory sought to be annexed is urban or will be urbanized in the near future; (4) The territory sought to be annexed is integrated or is capable of being integrated with the City of Greeley. Contiguity of the site is 65.9% with the City of Greeley, which exceeds the required 16.7% contiguity requirement. A community of interest exists between the property to be annexed and the City of Greeley in that approximately 25% of the site is currently in the City of Greeley city limits. From a service delivery perspective for the city, it is much more logical and efficient to have the entire site in the city rather than just a portion, particularly since the site is developed. The proposed annexation will fully integrate the site with the City of Greeley. The annexation complies with Comprehensive Plan policy GR3.4 which provides for the following: When considering a proposed annexation, the City should find persuasive evidence that the inclusion of the property into the City's jurisdiction meets Planning Commission Summary 7 Andersen Annexation comprehensive plan growth objectives and can be developed in a manner which will be a positive addition to the city, improve the quality of Greeley's neighborhoods, and can be provided with municipal services. A) for each proposed addition of land into the corporate boundaries, an annexation impact report will be completed which discusses the appropriateness of the annexation relative to the Long-Range Expected Growth Area (LREGA) boundaries, impact to taxing districts,financial impacts to provide services to the new site, environmental aspects, and other such considerations as may be called out in this Plan (see also policies EC4.6, ED1.3, EN6.6, LU1.ID and PSI.4A) As previously discussed, the entire site is currently within the LREGA and the portion of the site that is not being considered for annexation is currently within the MRESA but has been recommended for inclusion by the Greeley Planning Commission. The applicant submits that development of the site will be in accordance with the spirit and intent of the Greeley Comprehensive Plan so that it will be a positive addition to the city, improve the quality of development in the area, and provide the city with an important service. The only impact to taxing districts by this annexation will be the removal of the site from the Western Hill Fire Protection District and the addition of the City of Greeley. The fire district exchange will be in accordance with the existing fire district agreement regarding this matter. The site is currently served by Union Colony Fire Department. City sewer service is currently available, and the site will be converting from North Weld Water to Greeley water after the annexation. The site currently provides its own stormwater drainage services. All the service providers have indicated Planning Commission Summary 8 Andersen Annexation I, that there should be no significant financial impact to providing services to this site caused by the annexation. This annexation will not impact the local school district. The site contains a single residence belonging to the retired property owner with no school aged children. The residence has been on the property since 1920. The annexation should cause no environmental impacts. As part of the Poudre River Flood Study developed by the Army Corps of Engineers, under consideration by FEMA and adopted by the City of Greeley, the site will be removed from the floodway but will remain in the 100 year floodplain. The site is in an area of high ecological interest; however it has been fully developed for over 25 years. The site is located within the Greeley Stormwater Drainage District, which has developed an agreement with the applicant with regard to site development and environmental impacts which allows the applicant to provide its own stormwater detention and treatment. In addition, as part of the site development and approval process, the applicant will be dedicating and landscaping land along the Poudre River for trail development. Since the site is developed, there will be no new environmental development impact to the site as a result of the annexation. To the degree the applicant will be dedicating easements for the Poudre Trail and landscaping the adjacent area, the environmental impacts will be decreased. The annexation of this site into the City would be consistent with present growth patterns and Comprehensive Plan policies. There is clear evidence that this site shares a common interest with the City's future. The requirements of State statutes and City of Greeley guidelines for annexation have been met by this annexation. Said parcel contains 28.527 acres,more or less. -7 7 PETITION FOR ANNEXATION Andersen ANNEXATION TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF GREELEY, COLORADO: The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. seq., Colorado Revised Statutes, 1973, as amended,hereby petition the City Council of the City of Greeley for annexation to the City of Greeley of the territory described herein and described and shown on the map designated, Andersen Annexation." The applicable number of said map (at least four) are submitted herewith and by this reference are incorporated herein. The description of the territory hereby petitioned for annexation to the City of Greeley is set forth in Exhibit A attached hereto and incorporated herein by reference. In establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate comprising twenty (20) acres or more which, together with the buildings and improvements situated thereon have an assessed valuation in excess of$200,000 for ad valorem tax purposes for the year next preceding the filing of the written petition for annexation, has/have been included within the territory proposed to be annexed without the written consent of the land owner or land owners. 5. The territory proposed to be annexed does not include any area which is the same or substantially the same area in which an election for an annexation to the City of Greeley was held within the twelve months preceding the filing of this petition. 6. The territory proposed to be annexed does not include any area included in another annexation proceeding involving a city other than the City of Greeley. 7. The territory proposed to be annexed is not presently a part of any incorporated city,city and county, or town. 8. The property owned by each petitioner is described on each separate signature sheet and, when needed, described more fully in the exhibits attached hereto and incorporated herein by reference. 9. The signer(s)of this petition comprise(s)more than fifty percent(50%) of the land owners and owning more than fifty percent(50%) of the property,excluding public streets and alleys, and any land owned by the annexing municipality, and are,in fact, owners of one hundred percent(100%) of the property set forth in Exhibit A attached hereto and incorporated herein by reference. Accompanying this petition are the original and four copies of an annexation plat map containing the following information: A. A written legal description of the boundaries of the area proposed to be annexed. B. A map showing the boundary of the area proposed to be annexed. C. As an expressed condition of annexation, land owner(s) consent(s) to inclusion into the Northern Colorado Water Conservancy District and the municipal subdistrict pursuant to Section 37-45-136 (3.6) C.R.S. As for utilities, an existing City of Greeley 16"water main and a 12" sewer main exist on the north side of East 8th Street, within proximity of this site. Existing and Proposed Land Use Patterns and Existing Zoning Andersen's Sales and Salvage, Inc. is a recycling company dealing in metals of all kinds and used auto and truck parts. The business has and will continue to operate as a high- intensity industrial business. Andersen's is located within a highly industrial area; East 8th Street has similar types of uses on both the north and south sides of road, primarily east of US Highway 85. Andersen Annexation January 6,2006 Attachment Presently, Andersen's is located in Unincorporated Weld County, and is presently zoned I-3,the highest Industrial zoning allowed in the County. Once annexed into the City of Greeley,my client respectfully requests that the site be zoned Industrial-High Intensity (I-H), a zoning comparable to the present zoning. KS Properties own the property where Andersen's Sales and Salvage operates. Both companies have common ownership. Andersen's has been serving the northern Colorado area for 44 years, and intends to continue to be a part of the thriving community. The property is located in the Southwest Quarter(SW ''A) of Section 3 and the Southeast Quarter (SE 'A) of Section 4 within Township 5 North(T.5N.), Range 65 West(R.65W.) of the 6th P.M. More specifically,the property is located south of East 8th Street and north of the Cache La Poudre River. To the east of the subject property is land owned by the Bliss Produce Company and to the west is land owned by Ed Duggan and the Ed Duggan Trust, and the Greeley Urban Renewal Authority. The land to the west, including the southwest corner of the subject property, has been previously annexed into the City of Greeley as part of the Ogilvy Second Annexation(Rec. No. 01999988). East 8th Street,to the north, is also located within the city limit. Currently,28.527 acres within the Andersen's Sales and Salvage Inc. property is located within Unincorporated Weld County. The property is currently located within the County's I-3 zoning district. Our client, KS Properties, LLC,has elected to annex their remaining land into the City of Greeley. They respectfully request that the property be zoned Industrial-High Intensity(I- H), a zoning comparable to their present zoning. CONFORMANCE WITH THE CITY'S COMPREHENSIVE PLAN In reviewing the Policies and Strategies of the City of Greeley's 2020 Comprehensive Plan,the annexation of the remaining Andersen's Sales and Salvage Inc. property is in conformance with the comprehensive plan as follows: • GR3.1A The east half of the subject property is located within the City of Greeley's Urban Growth Area(UGA). • GR3.1B The east half of the subject property is located within the City of Greeley's Long Range Expected Growth Area(LREGA). • GR3.2 The west half of the subject property is located within the Mid-Range Expected Service Area(MRESA). In respect to Goal GR3.1A, minor adjustments can be made to the MRESA should the subject property be located within Y4 mile of the present MRESA boundary. Water and sewer serviceability is within reach of this property. An existing City of Greeley 16"water main and a 12" sewer main exist on the north side of East 8 Street, and can be utilized by this property. The City Council should find sufficient evidence that the east half of this property can be included within the MRESA. Pickett Engineering, Inc. High industrial uses can be found on both the north and south sides of East 8th Street, east of U.S. 85 Bypass. As a metal recycling company, this type of business is a necessary service for a thriving community. By recycling unwanted cars, machinery, and other metal products into reusable scrap metal,this type of business will assist in maintaining an improved quality of life for many generations to come. • LU4.1 Presently, the properties along both sides of East 8th Street consist primarily of high industrial uses. East 8th Street, an arterial street, will provide good access to the site. • LU4.2 Presently, there are no residential developments surrounding this site. A single-family residence currently exists on the site, and Andersen's would like the residence to remain, as it belongs to the owners of the property. • LU4.8 Andersen's Sales and Salvage will provide berming and landscaping along the front property line adjacent to East 8th Street and along the south property line adjacent to the Cache La Poudre River. The intent is to screen the industrial operations from the street and those traveling on the future trail system parallel to the river. • LU8.6 Andersen's Sales and Salvage is willing to provide the City the necessary right to construct a trail system along the south property line, paralleling the Cache La Poudre River, with the understanding that the donated land counts toward the 10% landscape requirement. INTENT TO INCLUDE THE PROPERTY IN THE NCWCD AND SUBDISTRICT By accepting the annexation of the remaining approximate 28.527 acres of Andersen's Sales and Salvage, Inc. into the City of Greeley, KS Properties intends to include their property in the Northern Colorado Water Conservancy District(NCWCD) and Subdistrict. Presently, the property is being serviced by a NCWCD water tap and credit will be transferred for a City of Greeley water tap. INFORMATION ON ECOLOGICAL OR LAND USE CONDITIONS Andersen's operates a shredder, and the shredder uses water during the grinding process. The concrete pavement surrounding the shredder's operation area slopes to existing storm inlets. Pipes will direct runoff collected by the existing inlets to an industrial pond located south of the shredder. The purpose of this pond is to collect both the water used during the shredder operation and the stormwater runoff from the shredder pad and adjacent concrete pad. The water in this pond will be re-used in the shredder operation. If the pond should fill to a specified capacity, a pump and oil separator in a nearby concrete vault will skim oils off the excess water, and pump the water to an existing, lined, industrial evaporation pond near the west boundary line of the property. This existing industrial evaporation pond also receives runoff from an existing engine pad located to the northeast, and this pond does not have an outlet. The owner has the option to pump the water from the existing industrial evaporation Pickett Engineering, Inc. This water recycling operation is closely monitored by the Stormwater Discharge Permit issued by the State of Colorado to Andersen's Sales and Salvage, LLC. WAIVE THE PETITION FOR ANNEXATION Since a single property owner is petitioning for annexation to the City of Greeley,the Petition for Annexation form has been omitted from this submittal.
