RESOLUTION RE: DENIAL OF USE BY SPECIAL REVIEW FOR A GREYHOUND KENNEL - MELVIN JOHNSON AND CHARLOTTE WATKINS WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter , is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 3rd day of October, 1984 , at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Melvin Johnson and Charlotte Watkins, 905 South Denver, Fort Lupton, Colorado 80621 , for a Use by Special Review for a greyhound kennel on the following described real estate, to-wit: Part of the NWQ SE4 , Section 2 , Township 1 North , Range 66 West of the 6th P .M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , although only three members of the five-member Board of County Commissioners were present, the applicants chose to proceed with the hearing as scheduled rather than continue the hearing until a date when all Commissioners would be present, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present and studied the request of the applicant and the recommendations of the Planning Com- mission and all of the exhibits and evidence presented in this matter , and WHEREAS , the motion to approve the Use by Special Review for a greyhound kennel on the hereinabove described parcel of land did not receive the required three votes for passage , with Commissioner Johnson voting aye and Commissioners Brantner and Martin voting nay for the following reasons : 1 . The applicant has not shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is not consistent with the Weld County Comprehensive Plan. b. The proposal is not consistent with the intent of the Agricultural District in which the proposed use is located. 840945 Page 2 RE: DENY USR - JOHNSON AND WATKINS c . The uses which would be permitted will not be com- patible with the existing surrounding land uses , as shown by the lack of support from surrounding land owners . d. The uses which would be permitted may not be com- patible with the future development of the sur- rounding area. e . Although there is adequate provision for the pro- tection of the health and safety of the neighbor- hood and County, the welfare of the inhabitants of the neighborhood would be affected by this proposal . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for a greyhound kennel on the herein- above described parcel of land be, and hereby is , denied . Martin HEARING CERTIFICATION DOCKET ,1O. 84-61 RE: USE BY SPECIAL REVIEW, GREYHOUND KENNEL - MELVIN JOHNSON & CHARLOTTE WATKINS A public hearing was conducted on October 3 , 1984, at 2:00 P.M. , witn the following present: Commissioner Norman Carlson, Chairman, Excused Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner Commissioner Chuck Carlson, Excused Commissioner John Martin Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Bruce Barker Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated September 12, 1984, and duly published in the La Salle Leader on September 20, 1984, a public hearing was held for the purpose of considering the request of Melvin Johnson and Charlotte Watkins for a Use by Special Review for a Greyhound Kennel. Chairman Pro-Tem Johnson asked the applicants if they wished to have this request heard today with only 3 Commissioners present, or if they wished to continue to a date when all 5 Commissioners could be present. The applicants wished to proceed today. Assistant County Attorney Bruce Barker read this request into the record. Rod Allison, Planning Department representative, read the favorable recommendations of the Planning Commission with conditions. Mr. Allison also stated. that there are nine Operation Standards. Charlotte Watkins, one of the applicants, came forward to explain this proposal and answer questions of the Board. Those speaking in opposition to this proposal included Sharon McAdams, J.J. Jones, (TAPE CHANCE #84-90) William Hake, Jim Vawter, Wanda Keeton, and George Spilman. Kenneth Neff, Panhandle Eastern Pipeline Company, noted that there are gas lines running through the property and that no structures can be built within the easement-on this property. Charlotte Watkins explained all of the procedures for the feeding and caring of the dogs in answer to the complaints made by the neighboring landowners, The Board discussed adding ownership as one of the Standards, with the provision that the Use by Special Review permit shall expire if the property is sold and another stating that the applicant enclose the kennel exercise area with a 6-foot picket fence. After review of the findings to be made, Commissioner Brantner moved to deny the request for a Use by Special Review for Melvin Johnson & Charlotte Watkins. Commissioner Martin seconded the motion. The notion failed with Commissioners Brantner and Martin voting aye and Commissioner Johnson voting nay. Conmssioner Johnson then moved to approve the application with the addition of the Standards stated hereinabove. Commis- sioner Brantner seconded the motion. This nation failed with Commissioner Johnson voting aye and Commissioners Brantner and Martin voting nay; therefore; the request for a Use by Special Review for a Greyhound Kennel is denied. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 6. This shows five runs and will have a small shed at the end of each run for a bitch and her pups. I find no problem with this. This would add to the overall greyhound population permitted on these premises. It would not change the number of greyhounds allowed to be housed in the main kennel building. SOILS: The soils on this land are 70-Valent Sand, 3 to 9 percent slopes and 72-Vona loamy sand, 0 to 3 percent slopes. The surface water runoff of these soils efts slow, and the erosion hazard from water is low. When water is allowed to concentrate and runoff these soils` will then erode easily/ . The wind erosion potential is high for these soils. When the vegetation cover becomes poor, then blowout conditions can occur. The six foot solid picket fence should adequately protect the turn out pens. The dog runs and exercise area may need protection ttiion from wind erosion. GRASSES: The grasses that are adapted to these soils are Sand bluestem, Little bluestem, Sideoats grama and Blue grama. We believe that one or a combination of these grasses should be used, when native grasses are preferred. Contact the Soil Conservation Service if introduced grasses are preferred. The soil should be interseeded where a poor stand of grass exists. Where the land was previously used for cropland, it should be seeded to sorghum first:) then grass should be seeded into firm, clean sorghum stubble. We race our dogs in Colorado and surrounding states'and would like to build a kennel that would be our own and a home to raise and breed our racing stock. The surrounding properties bordering our property is zoned agricultural and is dry land. The distance from the proposed kennel property to any residential house to the west is approximately 200 yards; to the north, 1 mile; to the east approximately 300 yards; and to the south, at lease 100 yards. These are distances from the outside boundary of the eleven acres and not from the kennel itself. We plan to kennel our own dogs only and to not employ any outside help. A domestic well permit has been issued for this eleven acre parcel but a commercial permit would be needed and the application to change the use is in this packet . The present access drive would be used to enter and exit the property which connects Highway 52 at the top of a hill and has a good view from both east and west traffic.. A pickup with a dog van or two wheel pull dog van trailer would be used to transport the dogs. The only other traffic would be automobile. A septic system would be installed to Weld County Health Department specifications to handle the kennel and residential home. The kennel would meet all Weld County and State fire codes plus the fire codes of the Colorado racing Commission and other requirements the Commission might have. The Fort Lupton Fire Department would handle this location. The maximum number of dogs to he on this property would be 100. The The manure would he placed in plastic garbage bags and hauled away from the kennel daily. This is also one of the rules of the Colorado Racing Commission and the Commission makes at least two unannounced inspections each year. There would not be enough change in the land, such as cement or asphalt, to warrant installing any storm water retention facility. This ground is -not betng used to any advantage at present . A new home and kennel would improve and enhance this eleven acres. Since the manure would be disposed of daily and the dogs kept in the kennel or a fenced run, there would be no health or safety problems to the inhabitants of the neighborhood. This ground is not located in a Flood Plan geologic hazard or Weld County Airport overlay district area. A kennel should be compatible to with any future development in the surrounding area.
