RE: APPROVE EXCLUSIVE SANITARY SEWER EASEMENT AND TEMPORARY
CONSTRUCTION EASEMENT DEED FOR WEST POUDRE SANITARY TRUNK
PIPELINE PROJECT AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with an Exclusive Sanitary Sewer Easement and
a Temporary Construction Easement Deed for the West Poudre Sanitary Sewer Trunk Pipeline
Project, between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and the City of Greeley, 1000 10th Street, Greeley, Colorado
80631, commencing upon full execution of said easement and deed, with further terms and
conditions being as stated in said easement and deed, and
WHEREAS,after review,the Board deems it advisable to approve said easement and deed,
copies of which are attached hereto and incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Exclusive Sanitary Sewer Easement and the Temporary Construction
Easement Deed for the West Poudre Sanitary Sewer Trunk Pipeline Project, between the County
of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
and the City of Greeley be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said easement and deed.
The above and foregoing Resolution was,on motion duly made and seconded, adopted by
the following vote on the 6th day of September, A.D., 2006.

Interests to be Acquired: 30 foot wide "Exclusive Sanitary Sewer Easement"
25 foot wide "Temporary Construction Easement Deed"
Easement Description: A portion of SE ''A of Section 33, T 6 N, R 66 W, Weld County,
aka Weld County Assessor Parcel No. 080533000088
Described in Property Description and depicted on Exhibit Map
Following is brief summary of values & percentages identified and used to establish a fair
compensation offer for these interests:
I) $10,000.00 per acre is the Estimated Market Value (EMV) determined by an
independent appraiser - i.e. fee value of the land:
This parcel is presently zoned agricultural with proposed future use as a gravel
mining operation. The EMV is based on the analysis of the appraiser using recent
sales in the area and excluding any water rights allocations.
2) 50% of EMV (fee value) for the Exclusive Sanitary Sewer Easement
The new 30" pipeline is to be located within the permanent easement and
50% accurately reflects the value of the easement location and rights being
granted by the Exclusive Sanitary Sewer Easement.
3) 10% of the EMV for the Temporary Construction Easement
This is the temporary use of the surface of the land for construction purposes.
This % represents the industry standard for establishing compensation for a
Temporary Construction Easement.

Weld County Property
A strip of land Thirty feet (30') in width and being a part of the Southeast Quarter (SE1/4) of
Section Thirty-three (33), Township Six North (T.6N.), Range Sixty-six West (R.66W.), Sixth
Principal Meridian (6thP.M.), County of Weld, State of Colorado the centerline of which is more
particularly described as follows:
BEGINNING at the South Quarter(S'/) Corner of said Section Thirty-three (33), monumented by
a#6 rebar with a 2 '2 Aluminum cap, stamped L.S. 28259, dated 1995, and assuming the South
line of the Southeast Quarter(SE1/4) of said Section Thirty-three (33) as bearing North 89°00'37"
East, being a Grid Bearing of the Colorado State Plane Coordinate System, North Zone, North
Atnerican Datum 1983/92, a distance of 2642.13 feet with all other bearings contained herein
relative thereto:
THENCE along the West line of the Southeast Quarter(SEI/4) of said Section Thirty-three(33),
North 00°21'16" West a distance of 1288.17 feet;
THENCE leaving said West line, North 89°38'44"East a distance of 40.03 to the centerline of the
permanent easement;
THENCE along said centerline, North 39°23'55"East a distance of 45.12 feet to the TRUE

shortened to intersect the North line of a parcel of land recorded in Weld County Records under
Reception No. 2649512, dated October 27, 1998, and at the Terminus Point to be prolonged or
shortened to intersect the East line of the Southeast Quarter(SE1/4) of said Section Thirty-three
(33).
Said permanent easement contains 2,136 acres more or less (±), and is subject to any rights-of-way
or other easements of record or as now existing on said described parcel of land.
TWO (2) TEMPORARY CONSTRUCTION EASEMENTS
Together with a Twenty-five foot (25') Temporary Construction easement on the Northerly side of
the permanent easement.
It is the intent of this description that the sidelines of said Temporary Construction Easement are to
be prolonged or shortened to intersect the East line of the Southeast Quarter(SE1/4) of said Section
Thirty-three (33) and the North line of a parcel of land recorded in Weld County Records under

Dear Mr. Carroll:
Reference is made to the attached copy of Tracy Kittell's letter to Leon Sievers of June 28, 2005,
concerning this project. At this time, the easement agreements, compensation offer, and property
description and exhibit map have now been finalized in connection with the need to acquire the property
interests referenced above to accommodate this project. The enclosed Easement Plan map dated April 21,
2005, correctly reflects the easement interests proposed to be acquired.
This letter is being sent to provide you official notice of the City's proposed project and the need to
acquire these property rights. Following is specific information/attachments for review and approval in
connection with this offer to purchase:
Original Easement Documents, with Property Description and Exhibit Map, for your acceptance and
execution:
A. Exclusive Sanitary Sewer Easement —dated August 8, 2006
B. Temporary Construction Easement Deed—dated August 8, 2006
The City will require that its construction contractor maintain access to your property at all times during
construction and will restore any damages to the surface of your property caused by the construction
activities to a condition comparable with its original condition, as explained in the Temporary
Construction Easement.

Compensation Offer: It is the City of Greeley's policy and obligation to pay the fair market value for the
interests in your land that the City will receive along with any damages, which are a direct consequence
of this acquisition. The City has endeavored to determine the fair value for the interests in your land that
are to be acquired. Based on this analysis and as per the enclosed Summary of Compensation Offer dated
August 8, 2006, the City offers to pay to you:
$10,700.00 for the 30 foot wide"Exclusive Sanitary Sewer Easement"and
$ 1,900.00 for the 25 foot wide "Temporary Construction Easement"
for a total sum of$12,550.00 in return for your grant of the Exclusive Sanitary Sewer Easement and the
Temporary Construction Easement.
Upon completion of your review, acceptance of the documents and this compensation, and in order to
finalize this acquisition please:
I) Sign and return the duplicate copy of this letter.
2) Complete, sign and return the enclosed W-9.
3) Sign, have notarized and return the Original of the Permanent Easement Deed
4) Sign, have notarized and return the Original of the Temporary Construction Easement
Upon receipt of the above,the check can be processed and the Permanent Easement will be recorded. A
copy of the recorded permanent easement and the accepted temporary construction easement will be

SUBJECT: POUDRE SANITARY SEWER TRUNK EASEMENT
Dear Leon:
The City of Greeley Water and Sewer Department is proposing to extend a
30-inch diameter sanitary sewer trunk line from 83rd Avenue, just south of the Poudre
River, east to a point of connection on the existing sanitary sewer trunk located
approximately 2000 feet east of 59th Avenue, just north of F Street. The purpose of
the Poudre Sanitary Sewer Trunk Extension project is to eliminate the need for a
large regional sanitary sewer pump station (lift station), allow an existing lift station to
be removed from service, provide sanitary sewer service to property adjacent to the
proposed pipeline and provide a future means to serve areas west of 83`d Avenue
with a gravity sanitary sewer trunk. The proposed pipe alignment basically parallels
the Poudre River from 83rd Avenue east to the#3 Ditch diversion. At this point the
alignment parallels the #3 Ditch to its point of connect to the existing sanitary sewer
system. Please refer to Figure 1 for the overall pipe alignment.
To enable the City to maintain the proposed Poudre Sanitary Sewer Trunk
Extension a 30-foot wide exclusive sanitary sewer easement will be required. The
purpose of an "exclusive" easement is not to keep other utilities out of the easement
but rather to control where and how they cross the sanitary sewer line. For example,
it would not be safe to have a high pressure gas line installed over and parallel to the
sanitary sewer line should the sanitary sewer need to be excavated for repair but it
would be acceptable to have this gas line cross the sanitary sewer pipe
perpendicular with adequate clearances. In addition a 25-foot wide temporary
construction easement will be required to facilitate the project construction.

The City of Greeley would like to obtain a 30-foot wide permanent exclusive/
sanitary sewer easement and 25-foot wide temporary construction easement from
the County for this project. Please refer to Figure 2 for the location of the easement
request through the affected County property. We have been working with Jeff

EXCLUSIVE SANITARY SEWER EASEMENT
KNOW ALL MEN BY THESE PRESENTS,that Weld County, Colorado, a Body Corporate and
Politic of the State of Colorado, whose address is 915 10t" Street, Greeley, Colorado, 80631, hereinafter
referred to as "Grantor", for and in consideration of Ten and no/100 dollars ($10.00) and other valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, hereby grants and conveys to
the City of Greeley, a Municipal corporation, whose address 1000 10th Street, Greel y, Colorado 80631,
hereinafter referred to as "Grantee", a permanent exclusive sanitary sewer eas ent. Below is the

The permanent exclusive sanitary sewer easement hereby granted shall entitle the Grantee, its
successors and assigns, to install, lay, construct, relocate, change the size of, replace, repair, inspect,
maintain, remove and operate an underground pipeline and all appurtenances thereto. The permanent
exclusive sanitary sewer easement also shall permit uses clearly incidental to those specified and shall
include the right of ingress and egress over and across the Grantor's property to the extent reasonably
necessary to exercise and accomplish the operational purposes and the right to clear and keep cleared all
trees and other obstructions as may be necessary.
The Grantor shall have the right to make use of the surface overlying the exclusive sanitary sewer
easement granted by this instrument so long as such use does not interfere with the exercise by the
Grantee of the rights granted and conveyed by this instrument. No permanent structures or detention
ponds are to be built within this easement. Grantor shall not install berms, fences, or plantings, which
exceed three feet in height when mature in the easement. In no event shall the Grantor make claim
against the Grantee for damages to any improvements or fixtures hereafter installed by the Grantor within
the area of the permanent sanitary sewer easement.
This Grant shall be binding upon the heirs, executors, administrators, successors and assigns of
the parties hereto.

This Temporary Construction Easement Deed is made this 6 day of

of Greeley, a Municipal corporation, whose address is 1000 10th Street, Greeley, Colorado 80631
("GRANTEE").
GRANTOR,for and in consideration of the sum of ten and no/100 dollars($10.00)and other
valuable consideration paid by the GRANTEE to the GRANTOR, the receipt and sufficiency of
which is hereby acknowledged, has granted, bargained, sold and conveyed, and by this Temporary
Construction Easement Deed does grant, bargain, sell, convey and confirm to the GRANTEE, its
successors and assigns forever,a temporary non-exclusive easement on and under the property as per
the Property Descriptions and Exhibit Maps attached hereto and incorporated herein by this
reference, located in Weld County, Colorado ("Property"); for the purposes of:
1. Surveying, locating, installing and constructing a buried sanitary sewer pipeline on
lands adjacent to the Property, in whole or in part;
2. Cutting and clearing trees, brush, debris and other obstructions on the Property that
might interfere with GRANTEE'S activities on the Property; and
3. Access for purposes of surveying, locating, installing and constructing a buried
sanitary sewer pipeline across property owned by the GRANTOR that is contiguous
to the Property with the GRANTOR'S consent, which consent shall not be
unreasonably withheld.
Temporary Construction Easement shall begin on the date set out above and shall terminate
upon completion of construction or on June 30, 2007, whichever occurs first.
During the term of this Temporary Construction Easement GRANTOR shall not place,erect,
install or permit any above or below ground building, structure or other obstruction on the Property
that may interfere with the GRANTEE'S activities on the Property hereunder.
The GRANTEE shall:
4. Insofar as practicable, restore the surface of the ground to its condition prior to
GRANTEE'S activities on the Property;
5. Insofar as practicable, restore fences, drain tile, irrigation systems, landscaping,
private roads and other improvements, to the conditions existing prior to
GRANTEE'S activities on the Property, or at GRANTEE'S option pay the actual
damages to such items caused by GRANTEE'S activities on the Property; and
