I met with Sheri in Planning on Monday and she caught me up on a few things, as well as gave me the official Change of Zone Comments. I am transmitting an updated plan that will reflect an eyebrow equidistant from other proposed possible turnarounds. Please, note that the distance from the edge of pavement on the north to the perpendicular point on the radius of the brow, is 50'. A circle with radius of 50'will entirely be overlayed on the roadway by pavement with this layout. I believe that the emergency jurisdictions will want at least an emergency access easement and a restriction of fences and structures on the south Emergency Access Road, but am not sure that they will mind that it's overlaid on lots. The fencing will end at the north edge, per the CC&R's, and this may help the access road to be policed and maintained year round by the lot owner, since they will own it. I believe that I will be working with you on the Sage Hill Final Development Documents if the project is approved by the Board of Commissioners on December 14, 2005. I'm hoping that the Board agrees with the Council's unanimous approval. If you'd like me to, after that date, I will PDF a set for your preliminary review. Grantor hereby covenants and agrees: 3.01 The Grantor shall not erect or place any permanent building, structure, improvement, fence or tree on the described easement. The Ditch Company shall not be liable for the removal of any items placed on the easement in violation of this provision. Grantor agrees to remove such items at Grantor's sole expense. 3.02 Grantor shall not excavate in or near the ditch and shall not diminish nor substantially add to the ground cover in the easement or over the pipelines, if any, or appurtenances. 3.03 Grantor shall not grant any other easement, right-of-way,permit or license upon, under or over the easement without the written consent of the Ditch Company. 3.04 Grantor warrants that Grantor is the owner in fee of the above-described lands and will defend the title thereto against all claims, and that said lands are free and clear of encumbrances and liens of whatever character, except those appearing of record. 3.05 The Grantor reserves the right to use the easement for any purpose that is not inconsistent with or detrimental to the occupancy and/or use of the easement by the Ditch Company, including ingress to and egress from lots bordering the easement by the Grantor, its designated successors,their contractors, employees,materialmen, and assigns for the purpose of conducting therein and thereon such work of maintenance,improvement, construction, utility installation, development, installing and maintaining landscaping using plants and grasses that do not jeopardize the integrity of the ditch and/or pipeline, and other reasonable activities as the Grantor may deem necessary or desirable, and emergency access by public safety agencies. 4.
