Department of Public COLORADO Health and Environment CASE NO.: MF-1039 NAME: Charles Messerlein/Prairie Hollow Estates The Weld County Health Department has reviewed this final plat proposal. It appears the name of the subdivision has changed from Black Hollow Estates to Prairie Hollow Estates since the Change of Zone review. The draft covenants included in the application are for Moorea Manor Subdivision. All reference to Moorea Manor and Harpenden Lane should be removed. The covenants also do not specifically follow the language requested for the protection of the primary and secondary septic envelopes, as outlined in Section 3 (C) of the resolution. The plat notes appear to be correct and the primary and secondary septic envelopes meet all setbacks. The Board of County Commissioners approved the application with the following conditions: 1. Water service shall be obtained from the North Weld County Water District 2. A Weld County septic permit is required for each proposed septic system,which shall be installed in according to the Weld County individual sewage disposal system regulations. Each septic system shall be designed for site-specific conditions, including, but not limited to: maximum seasonal high groundwater, poor soils, and shallow bedrock. 3. All septic system envelopes must be located a minimum of 100 feet from all irrigation ditches, wells, and/or ponds, and 25 feet from a detention pond. 4. Language for the preservation and/or protection of the second absorption field envelope shall be placed in the development covenants. The covenants shall state that activities such as landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.) are expressly prohibited in the designated absorption field site. 5. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 6. During development of the site,all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions,at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 7. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and t. EXHIBIT 2006-0371 practical methods which are technologically feasible and economically reasonable in order to minimize dust emissions. 8. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration,the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 9. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. COLORADO SUBJECT: MF-1039 Prairie Hollow Estates Minor Subdivision (Final Plat) Weld County Public Works Department has reviewed final plan materials and has the following development referral comments Comments External Roadways: ❑ CR 21 and CR 84 are classified by the County as local roads and require 60-foot rights-of-way. o The rights-of-way are not dimensioned and labeled on the final plat. o The 30-foot rights-of-way shall be shown dimensioned and labeled on the final plat by the surveyor. o The proposed subdivision increases traffic on unpaved County roads, creating fugitive dust and surface maintenance problems. The applicant will be required to apply dust suppression chemicals (magnesium chloride or calcium chloride)to adjacent county roads and in front of impacted existing homes along the proposed traffic route. o Public Works has supplied a general road maintenance agreement for dust suppression chemicals - - - attached to this memorandum. o The applicant must submit a signed agreement prior to scheduling the(planning commission)hearing. Internal Roadways: ❑ Intersection sight distance triangles at development entrances shall be shown on the resubmitted final plat to comply with AASHTO's "A Policy on Geometric Design Highways and Streets". The plans submitted to Public Works do not include sight distance triangles. ❑ Re-submitted final plat drawings and roadway / construction & grading plan drawings shall be stamped, signed and dated. Construction details must be included. ❑ The Improvements Agreement According to Policy Regarding Collateral For Improvements (Private Road Maintenance) submitted to Public Works is generally acceptable. o The "Exhibit A"must be itemized. The lump sums provided are too general and give no indication to the required itemized costs. Street signs must be included; the water mains and culvert quantities appear low; and the unit cost for class 6 road base is low. o The Improvements Agreement shall be resubmitted in whole to Public Works for review and acceptance. o The agreement shall be approved by the BOCC prior to recording the final plat. Drainage: a The Final Drainage Report for Prairie Hollow Estates, dated April 20, 2005, by Team Engineering, Inc. is generally acceptable with the following exceptions: o The final drainage report shall include a flood hazard review documenting any FEMA defined floodways. The engineer shall reference the specific map panel number, including date. The development site shall be located on the copy of the FEMA map. Page 1 of 2 o The Overall Grading& urainage Plan shall label the ponds on the plans and these must correspond to the final drainage report. The pond elevations appear to be incorrect. The sub-basin areas do not correspond to the report calculations. o Elevations of the detention ponds (especially berm) shown on the final drainage report do not appear to correspond with elevations shown on the overall grading and drainage plan. Re-submitted materials shall address the discrepancy. o Stormwater / drainage facility details must be provided in the construction plans for the proposed headwall with orifice plate. Additional information must be provided for the Type C inlet construction. o All culverts shall be labeled (called-out to include lengths and size, including flared end sections) on the construction plans. o Design compliance with the 100-year storm event has been shown; however no design calculations relating to the 5-year storm event have been located within the final drainage report. o The final drainage report (sealed by the engineer of record) shall be resubmitted to Public Works for review and acceptance. ❑ The Engineering Geology Report for Proposed Black Hollow Estates, dated February 14, 2003, by Church & Associates, Inc., states that groundwater was encountered in test holes. o A note has been placed on the final plat stating that "lots may not accommodate full-depth basements" due to groundwater levels. A permanent sign should be placed at the entrance to the subdivision detailing the name of the sub-division, address,and a graphical presentation of the roadways within the subdivision. There should be a plan developed to maintain this sign. 2. If the roadways within this sub-division are not maintained or adopted by the county, individuals purchasing property in this sub-division should be notified that the Sheriffs Office will have limited traffic enforcement powers. 3. A plan should be developed to maintain roadways within the sub-division especially during inclement weather conditions for emergency vehicles. 4. The Sheriffs Office is very supportive of homeowner funded homeowner's associations. These associations provide a contact for the Sheriffs Office and a means of maintaining common areas. 5. If there are oil or gas production facilities within this sub-division,they need to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. 6. The names of all streets within the sub-division should be presented to the Sheriffs Office for approval. This will eliminate duplication of street names within the county. The name of the street in this sub-division is approved. The street name in this sub-division has been approved. The Sheriff's Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. A building permit shall be obtained prior to the construction of any new building except those exempted by the Weld County Building Code. 2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Plans may be required to bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback requirements are measured to the farthest projection from the building. Water Division 1,Water District 3 Dear Ms. Lockman: We have reviewed the above referenced proposal to subdivide an 80-acre parcel into 9 single-family residential lots of approximately 8.9 acre in size. The State Engineer's Office previously commented on this subdivision by our letters dated April 23, 2003, October 10, 2003 and November 3;2003,when the proposal was submitted as Black Hollow Estates Subdivision. Information from this submittal indicates that this is the Final Plat for this subdivision and water is to be provided by North Weld County Water District(District). In our letter dated November 3, 2003 (copy attached) this office already rendered an opinion on the proposed water supply indicating that the proposed water supply can be provided without causing material injury to the existing water rights and the proposed water supply is adequate. However, according to our records, well permit nos. 257093 and 258025 were issued on May 21, 2004 and July 7, 2004, each as the only well on tract of land of 40 acres described as a portion of the NE1/4 of the NE1/4 (permit no. 258025)and a portion of the NW 1/4 of the NE1/4 (permit no. 257093), both in Section 10, Township 7 North, Range 67 West of the 6th P:M. The use of ground water from each of the above wells is limited to fire protection, ordinary household use inside three (3)single-family dwellings, the watering of poultry, domestic animals and livestock on a farm or ranch and the irrigation of not more than one acre of home garden and lawns. Our records show that well permit nos. 257093 and 258025 have not been constructed, and permit no. 257093 is due to expire on May 21, 2006 and permit no. 258025 is due to expire on July 7, 2006, if the wells are not constructed, or extensions are not obtained. Since the 80-acre parcel proposed to be subdivided is presently encumbered by these two well permits (nos. 257093 and 258025, copies enclosed), the applicant needs to provide information if well permit nos. 257093 and 258025 (if constructed)will be used to supply water to any of the lots in the subdivision. Nothing in this letter or in the previous letters should be construed as an opinion regarding the use of the wells in the subdivision. Since insufficient information was provided, we cannot comment on the potential for injury to decreed water rights under the provisions of CRS 30-28-136(1)(h)(I). Based on the above-mentioned letter the District is able and intends to serve-the proposed-9-residential--lots. The District will supply treated water to the subdivision, charging fees for the water supply on a per tap basis payable prior to the activation of the tap. Based on current records on file in this office, the District currently has an adequate uncommitted water supply to provide the water associated with this subdivision. In addition a Water Supply Information Summary Sheet was also provided. The household use water requirement for the residential lots is estimated at 5,400 gallons per day (6.04 acre-feet per year). Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's office offers the opinion that the proposed water supply will not cause material injury to existing water rights, and the supply is expected to be adequate with the North Weld County Water District supplying the water to the subdivision.
