This application is being submitted in order to correct an active Zoning Violation(VI-0500351)in Aristocrat
Ranchettes. Due to their current property being situated within the boundaries of a subdivision, staff
recommended them to look for another property not situated within a subdivision and apply for a Use by
Special Review on that lot. The property referenced in this USR application(parcel#1309-22-2-00-001)
is NOT in violation.
This application if approved by the Board of County Commissioners and once all commercial equipment
has been relocated to this site will correct the zoning violation inside Aristocrat Ranchettes.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview of the
Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002) WCR 20 and 31 are local gravel roads and require a 60-foot
right-of-way at full build out. There is presently a 60-foot right-of-way. These roads are maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured
from the future right-of-way line.
ADT: WCR 20 between U.S. Highway 85 and WCR 31 has a most recent traffic count of 88 vehicles taken in a 72-hour
period. WCR 31 between WCER 20 and WCR 22 has an ADT of 151 vehicles per day taken in a 72-hour period.
&QUIREMENTS:
'Access: Utilize the existing access identified on the plat drawing.
The access shall be a graded and drained to provide an all-weather access.
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and
shall be graded to prevent drainage problems.
Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending
beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or planting.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it
will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to
run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best management
practices.
Dust Suppressant: The applicant shall be required to provide adequate dust suppressant chemical (magnesium chloride or
calcium chloride) for approximately 300 feet from the adjacent residents on WCR 20 as your proposed oil and gas business
will additionally impact the adjacent neighbor with additional employees and heavy hauling of oil field equipment to and from
the site. Dust suppressant shall be placed a minimum of twice a year or as needed and determined by the Weld County
Pubic Works Department, Motor Grader Division Supervisor.

Environmental Health Services has reviewed this proposal for a storage garage and
small office for an oil field roust-a-bout business. We have no objections to the
proposal, however, we do recommend that the following conditions be part of any
approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall provide current evidence that the facility has an adequate
water supply. The applicant has submitted a "Permit to Construct a Well"
#64214-F"documentation from Office of the State Engineer, Colorado Division of
Water Resources. At this time the well has not been drilled.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more
information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed house, shop
and office and shall be installed according to the Weld County Individual Sewage
Disposal Regulations. (Septic permit number SP-0600102 has been issued but
has not been finaled).
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".

5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
6. Adequate handwashing and toilet facilities shall be provided for employees and
visitors of the facility.
7. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
8. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
9. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

1. Building permits shall be obtained prior to the construction of any building. .
2. A plan review is required for each building. Plans may require the wet stamp of a Colorado registered
architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. The office will most likely be classified as a B occupancy.The storage portion will most likely be
classified as a S-2.
4. Buildings may require an engineered foundation based on a site-specific geotechnical report or an open
hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by
a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
6. Building height shall be measured in accordance with the adopted building code at the time of the building
permit application for the purpose of determining the maximum building size and height for various uses and
types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld
County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in
order to determine compliance with offset and setback requirements. Offset and setback requirements are
measured to the farthest projection from the building.
7. Provide letter of approval from Fort Lupton Fire Protection District prior to new construction.

Dear Ms. Hatch:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to
satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
According to the submitted information the site will be served by a proposed well
64214-F. The well is currently permitted for commercial uses for oil field company, 5000
square foot garage and domestic uses. In addition the well is limited to a maximum
pumping rate of 15 GPM and an annual withdrawal of 4 acre-feet. Therefore, the well can
be used for the commercial operation as long as the well is operated in accordance with the
conditions of the well permit.
