HomeMy WebLinkAbout20060414.tiff RESOLUTION RE: APPROVE PURCHASE OF SERVICES AGREEMENT AND AUTHORIZE CHAIR TO SIGN - PATRICIA SCHENE WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Purchase of Services Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,on behalf of the Department of Social Services, and Patricia Schene, Ph.D,commencing January 1, 2006, and ending March 30, 2006,with further terms and conditions being as stated in said agreement, and WHEREAS,after review,the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the Purchase of Services Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and Patricia Schene, Ph.D., be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Griego, Director, Social Services - Li ( RE: Purchase of Services Agreement—Patricia Schene, Ph.D. Enclosed for Board approval is a Purchase of Services Agreement between the Weld County Department of Social Services and Patricia Schene, Ph.d. This Agreement was reviewed at the Board's Work Session of January 30, 2006. The major provisions of the Agreement are as follows: 1. The term of the Agreement is January 1, 2006 through March 30, 2006. 2. Dr. Schene will assist the Department in its re-design efforts regarding Residential Treatment Center care by transitioning its Core Services Programs for 2006-2007 as an integral part of its balanced systems of care. This transition will include reviewing this year's Core Services Programs' Request for Proposals, integrating specified values into all core services programs, identifying evidences based and promising practices and how to evaluate them, and to focus on Homebased Intensive Family Intervention for specific results. 3. The Department agrees to provide reimburse Dr. Schene a total of$6,062.50 from Child Welfare Administration funding. 2006-0414 Contract No. FY05/06-Child Welfare PURCHASE OF SERVICES AGREEMENT 1,1 THIS AGREEMENT is made and entered into this day ot< 1 (�t2006,by and between the Board of County Commissioners of the County of Weld, State of Colorado,sitting on b alf of the Weld County Department of Social Services,hereinafter referred to as"Social Services",and Patricia Schene, Ph.D.,hereinafter referred to as"Consultant". WITNESSETH: WHEREAS, Social Services has as its goal to intervene successfully with families in the least intrusive manner while maximizing safety before they enter the judicial system; and upon their entry into the child welfare and juvenile justice systems,to expedite the positive resolution of their treatment or case plans; and WHEREAS, Social Services wishes to develop a balanced systems of care in Weld County under a community based services integration process,emphasizing family strengths through interagency and community collaboration;and WHEREAS, Social Services' balanced systems of care must be developed under a continuum of evidenced-based and promising practices that are outcome based;and WHEREAS, Social Services' Core Services Program, as established under C.R.S. § 19-1-116(2)(b) is an integral part of the balanced systems of care; and WHEREAS, Social Services will be responding to major revisions to the statewide re-design of the Residential Treatment Center Care by June 30,2006,which will require revisions to its Core Services Program to be better able to meet the needs of its families; and WHEREAS, the Consultant has the expertise and knowledge to assist Social Services in its efforts to develop and further define expectations of potential contract services providers under its Core Services Program in meeting evidence-based and promising practices; and WHEREAS,the Consultant will focus on Social Services' expectations of potential contact services providers under its Core Services Program to promote a continuum of care. NOW,THEREFORE, in consideration of the mutual promises and covenants contained herein,the parties hereto agree as follows: 1. TERM: The term of this Agreement shall be from January 1,2006,through and until March 30, 2006. 2. SERVICES PROVIDED BY CONSULTANT: The Consultant agrees to assist Social Services in its preparation for programs and services under its Core Services Program for 2006-2007 by focusing Social Services' expectations of potential contract service providers related to: • Defining the substantive content of services more fully • Identifying promising practices that could be incorporated in the delivery of services • Articulating the ways the broad values of Social Services'services could be manifested in the expectations of the specific services to be provided • Integrating these definitions,promising practices, and broad values more systematically into evaluative criteria to be utilized by the bidders and the data to be collected for evaluation Page 1 of 3 O7,4O7 -,ns�/�/ Contract No. FY05/06-ChildWelfare A. Review this current year's set of Request for Proposals (RFPs)related to the following core services and identify specific places for augmentation in Fiscal 2007: o Homebased Intensive Family Interventions o Day Treatment Program o Adoption,Foster Care, Expedited Permanency Home Studies, Relinquishment Counseling o Intensive Family Mediation and Facilitation under Intensive Family Therapy o Foster Parent Consultation o Foster Parent Core Training o Life Skills—Household Management o Mental Health Services o Sex Abuse Treatment B. Utilizing specified values that under gird all core services to help in the clarity and comprehensiveness of the description of the services and in the expectations of successful bidders. Provide generic examples for set of Core Services. These values include: o Assuring the safety of children o Preventing family disruption by services to preserve families and/or reunifying children with families whenever safely possible o Engaging parents to participate in services o Assuring the collaboration of all formal and non-formal services and supports to maximize achievement of goals for families C. Review the literature to suggest specific promising practices from throughout the child welfare field that should be incorporated into the services in one of the Core Service areas. D. Expand and develop additional language in the RFP for one of the Core Services -Homebased Intensive Family Intervention—in the areas related to definition of the service to be provided,the expectations of Social Services of the bidder,the expected outcomes for clients as a result of receiving the services,the evaluation of activities,and the necessary data to be provided to support the evaluation. E. Define within the continuum of evidence based practices and ways to evaluate where on the continuum any one practice falls. F. Document the outcomes of the tasks as outlined in Item 2 and 3 of the Agreement. 3. COMPENSATION: Social Services agrees to pay the Consultant for professional services pursuant to this Agreement a sum of$6,062.50 according to the schedule and time frames provided as follows: Agreement Total Time Expected Completion Costs Task Date Task Item 2,A 15 hours January 20, 2006 $ 937.50 Task Item 2,B 20 hours January 30, 2006 $1,250.00 Task Item 2,C 30 hours February 13,2006 $1,875.00 Task Item 2,D 32 hours February 24,2006 $2,000.00 The parties agree that the service rate as contemplated herein shall constitute the entire amount of compensation due to the Consultant for any work performed hereunder. 4. INDEPENDENT CONTRACTOR: Consultant agrees that it is an independent contractor and will not become an employee of Social Services,nor is the Consultant entitled to any employee benefits under Social Services as a result of the execution of this Agreement. INDEMNIFICATION: Consultant shall indemnify Weld County, its officers and employees, against liability for injury or damage caused by any negligent act or omission by Consultant in the performance of this Agreement and shall hold Weld County harmless from any loss occasioned as a result of the performance of this Agreement. 6. NON-ASSIGNMENT: Consultant may not assign or transfer this Agreement, any interest therein or claim thereunder,without the prior written approval of Social Services. 7. ACCESS TO RECORDS: Social Services shall have access to Consultant's financial records as these records relate to payment and expenditures under this Agreement for the purposes of audit. Such records shall be complete and available for audit 90 days after final payment hereunder and shall be retained and available for audit purposes for at least five years after final payment hereunder. 8. TERMINATION: Either party may terminate this Agreement at any time by providing the other party with a 10-day written notice thereof. Furthermore,this Agreement may be terminated at any time without notice upon a material breach of the terms of the Agreement. 9. TIME OF THE ESSENCE: Time is of the essence in each and all of the provisions of this Agreement. 10. ENTIRE AGREEMENT/MODIFICATIONS: This Agreement constitutes the entire understanding between the parties with respect to the promises and covenants made therein. No modification of the terms of this Agreement shall be valid unless made in writing and agreed to by both parties. 11. NON-APPROPRIATION:No portion of this Agreement shall be deemed to create an obligation on the part of Social Services to expend funds not otherwise appropriated in each succeeding year. 12. WAIVER OF IMMUNITIES/THIRD PARTY LIABILITY:No portion of this Agreement shall be deemed to constitute a waiver of any immunities of Social Services or its officers or employees may possess, nor shall any portion of this Agreement be deemed to have created a duty of care with respect to any persons other than Social Services and not a party to this Agreement.
