SUBJECT: USR-1568 Pedro Saucedo
The applicant for USR-1568, Pedro Saucedo has submitted the attached documentation.
The applicant has addressed 1.A and 1.C of the staff comments regarding a signage plan and a
dumpster screening plan that were required to be completed prior to scheduling the Board of
County Commissioners hearing.
Item 1.B required the applicant to submit a copy of a recorded agreement for the shared access
specifically outlining the commercial use. The applicant has submitted the attached letter dated
October 4, 2006. The applicant is asking to utilize an existing oil and gas access point onto
County Road 20 instead of the shared access as outlined on their Recorded Exemption. Staff is
in support of this request.

RE:SAUCEDO USE by SPEPCIAL REVIEW—USR 1568 Driveway Access Approval

Dear Ms.Hatch:
In our attempt to design a driveway from Mr. Pedro Saucedo's property Parcel #130922200001 to
Weld County Road 20 through an existing 30-foot access easement, we have been unable, after
repeated attempts,to make contact with Mr.Richard E.&Carolyn Sue Bauserman,adjoining property
owners of parcel #130922000056. We need to contact the Bausermans to gain their approval of a
proposed increase in traffic in the 30-foot easement and to have them remove an existing fence that is
currently located on the property line dividing the 30-foot easement of RE No.1309-22-RE-2809. We
have the following concerns In continuing to pursue usage of the 30 foot easement for driveway
access:
1. A driveway located in this area would be considerably dose to an existing of and gas driveway
approximately 150-feet to the East creating a"double access"to WCR 20.
2. Our legal counsel has advised us that should our pursuits to have the Bausermans comply with
our request to remove their fence go into litigation, the Mr. Saucedo could anticipate having to
spend at least$25,000 to$50,000 in legal fees.
To avoid a double access and potential litigation,we have looked at another way to provide access to
the Saucedo property. We have coordinated with Kerr-Mcgee Oil&Gas Onshore LP to share usage
of the existing oil & gas access located on Mr. Saucedo's property. Kerr-Mcgee Oil has agreed to
allow Pedro Saucedo to share this existing oil&gas access. (Kerr-Mcgee and Mr.Tom Bennett have
executed a Recorded Exemption recorded on 02-22-06 at Reception #3364753, the terms of which
govern the parties' simultaneous use). We are requesting that the Weld County Department of
Planning Services review our concerns in pursuing usage of the existing 30-foot access easement to
WCR 20 and allow the usage of the alternate access currently designated as oil & gas access.
Please advise us of any necessary amendments to Recorded Exemptions that we might need to
prepare. Also, please verify and advise us as to which Recorded Exemption we might need to
amend.

EASEMENT AND RIGHT-OF-WAY GRANT
(Roadway)
For and in consideration of the sum of$10.00 (Ten Dollars) and other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, Saucedo Oilfield
Services, whose address is 15463 Barley Ave, Fort Lupton, Colorado 80621, ("Grantor," whether
one or more) hereby grants, bargains, sells, assigns and conveys to Kerr-McGee Oil & Gas Onshore
LP, a limited partnership, whose address is 1999 Broadway, Denver, Colorado 80202 ("Grantee"),
an easement and right-of-way in and across the following real estate,to wit:
Township 2 North, Range 66 West, of the 6th P.M.
Section 22: A part of the E/2 of the NW/4 as shown in Exhibit"A"
(the "Land") together with full rights of ingress and egress to and from the Land for the purposes
hereafter specified.
The easement and right-of-way is granted for the purpose of providing Grantee, its
employees, agents, contractors and licensees access to the W/2E/2NW/4 Section 22, Township 2
North, Range, 66 West to conduct any activities that are necessary for its current or future oil and
gas operations, including, without limitation, the right to build, construct, improve, repair, use and
maintain a roadway ("Roadway"), to transport, haul, or provide access for drilling rigs, workover
rigs, tractor trailers, drillpipe, casing, production tubing, water, perforation and fracture treatment
trucks, tank batteries, treater facilities, tanker truck service, daily pumpers and meter readers
utilizing standard-sized pickup trucks, and other equipment and vehicles necessary to carry on
Grantee's oil and gas drilling and operations.
It is agreed that the easement and right-of-way granted herein shall be binding upon and run
with the surface ownership of the Land and shall not be held or transferred separately there from
and shall continue for the benefit of Grantee and its successors and assigns, as owners of the oil, gas
and associated liquid hydrocarbons in the Land, including any operator or unit operator, and for the
benefit of other lands within any unit area within which the Land or any portion thereof may be
included.
The easement and right-of-way granted herein shall be effective as of November 1, 2006,
and shall remain in effect for so long thereafter as the oil and gas rights in the W/2E/2NW/4 Section
22, Township 2 North, Range 66 West are committed to an oil and gas lease, license or unitization
agreement, or so long as a well capable of producing oil or gas or associated liquid hydrocarbons is
located upon the land, or drilling or reworking operations are being conducted thereon, or as long as
any pipeline or any other oil or gas facility serviced by the Roadway is in use, or as long as plugging
and abandoning operations are being conducted, whichever occurs last.
This easement and right-of-way grant shall be binding upon the heirs, executors,
administrators, successors, and assigns of the parties hereto.
Executed this 1st day of November, 2006,to be effective as of the date first above written.

The language for the first sentence for Development Standard 18 for USR 1568 should be changed to: The
applicant shall apply an adequate dust suppressant chemical (magnesium chloride or calcium chloride) for
approximately 600 feet of WCR 20, being 150 feet east and west of a centerline extending out of the residence at
15104 WCR 20, and 150 feet east and west of a centerline extending out of the residence at 15284 WCR 20, Fort
Lupton, Colorado 80621.
