Mr. Ogle,
As you are aware, the Torgerson PUD was approved with the condition that an agreement be
reached with the Pierce Lateral Ditch Company. As I represented in the hearing, an
agreement had been reached by both the ditch company and the developer, but we were
awaiting final engineering, and attorneys fees to finalize the agreement. Due to
circumstances beyond our control, the Pierce Lateral Ditch Company legal representative
has now withdrawn the agreement. I am entirely confident that this can be resolved, but
wanted to let my client know what deadlines loom, and how long he has to finalize the plat
recordation.
All final engineering has been submitted, as has the on-site and off site agreements.
Could you please email me a summary of what remains to be done to finalize the project as
well as any expiration dates, or times that things need to be submitted or recorded by.
