RE: APPROVERESUBDIVISION, RS #1113, FOR LOT LINE ADJUSTMENT IN THE
DEARFIELD TOWNSITE - JAMES AND ROIANN MARES
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners held a public hearing on the 13th day of
March, 2006, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the
application of James and Roiann Mares, 24718 County Road 32, Snyder, Colorado 80750, for
Resubdivision, RS #1113, for a Lot Line Adjustment in the Dearfield Townsite, on the following
described real estate, to-wit:
Blocks 53 and 54, Dearfield Townsite; part of the
SE1/4 of Section 30, Township 4 North, Range 61
West of the 6th P.M., Weld County, Colorado
WHEREAS,the applicant was not present at said hearing, and
WHEREAS,Section 24-5-30 of the Weld County Code provides standards for review of said
Resubdivision, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendation of the Weld County
Department of Planning Services and all of the exhibits and evidence presented in this matter and,
having been fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24-5-30.B of the Weld County Code.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 24-5-30.C of the Weld County Code, as follows:
a. Section 24-5-30.C.4 -- The lot line revision complies with the approved
recorded final plat. The lot line revision will comply with the Amended Map
of the Dearfield Townsite, dated August 6, 1914.
b. Section 24-5-30.C.4-Compliance with the adopted rules, regulations, and
Ordinances currently in force and affecting the subdivision. The lot line
adjustment will comply with the adopted rules, regulations, and Ordinances
currently in force and affecting the subdivision. The lot line adjustment will
address a single-family residence that presently encroaches on the boundary
between Block 53 and Block 54, and will allow a well used by the owners of
Block 54 to be located entirely within the boundaries of Block 54.

NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the application of James and Roiann Mares for a Resubdivision fora Lot Line
Adjustment, RS#1113, on the hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1. Prior to Recording the Resubdivision Plat:
A. The following information shall be placed on the plat prior to recording:
1) All plats shall be labeled RS-1113-A Resubdivision for a Lot Line
Adjustment between Blocks 53 and 54 of the Amended Map of
Dearfield Townsite and Settlement.
2) The resubdivision plat shall comply with sections 24-4-40.D.6
through 24-4-40.D.9 of the Weld County Code.
B. The applicant shall submit two paper copies of the plat for preliminary
approval to the Weld County Department of Planning Services
C. The applicant shall create a digital file of all drawings associated with the
Resubdivision application. Acceptable CAD formats are.dwg, .dxf,and.dgn
(Microstation); acceptable GIS formats are .shp (Shape Files), Arclnfo
Coverages and Arclnfo Export files format type is.e00. The preferred format
for Images is .tif(Group 4) ... (Group 6 is not acceptable). A copy shall be
submitted to the Weld County Department of Planning Services at the time
of Mylar plat submittal.
2. Upon completion of Condition of Approval#1 above, the applicant shall submit a
Mylar plat, along with all other documentation required as Conditions of Approval.
The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder
by the Department of Planning Services. The plat shall be prepared in accordance
with the requirements of Section 24-4-40.D.6 through D.11 of the Weld County
Code. The Mylar plat and additional requirements shall be submitted within sixty(60)
days from the date of the Board of County Commissioners Resolution. The
applicant shall be responsible for paying the recording fee.
3. In accordance with Weld County Code Ordinance#2005-7,approved June 1,2005,
should the plat not be recorded within the required sixty(60)days from the date of
the Board of County Commissioners Resolution, a $50.00 recording continuance
charge shall added for each additional three (3) month period.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section

2. It is the opinion of the Department of Planning Services' Staff that the application has
shown compliance with Section 24-4-30.C of the Weld County Code, as follows:

NARRATIVE
FOR APPLICATION FOR RESUBDIVISION FOR LOT LINE CHANGE
This narrative is submitted with the Resubdivision for Lot Line Change
Application submitted by Dearfield Homes, LLC. The original subdivision was originally
platted in 1914 pursuant to an amended map of Dearfield Townsite and Settlement. In
particular, properties involved are Block 53 and Block 54 of the Dearfield Townsite.
Block 53 is owned by Dearfield Homes, LLC, a Colorado limited liability company.
Block 54 is owned by James John Mares and Roiann Patricia Mares. The Townsite has
not been significantly developed. Blocks 53 and 54 have not been broken down into
lots, and on the original plat Block 53 and Block 54 each contain approximately 8.5
Acres. The property line has not been readily defined between Block 53 and Block 54.
Mr. and Mrs. Mares, the owners of Block 54 had a house constructed on their property.
The dividing line between Block 53 and 54 was miscalculated, and the single family
residence constructed on the Mares' property was constructed overlapping the property
I!i line. As constructed, the house lies partially on Block 53 and Block 54.
A water well was also dug by the Mares on what they thought was their property. The
water well, likewise, was in actuality drilled on Block 53.
In order to correct the situation and to provide for the appropriate Weld County set back
requirements and to include the water well on the Mares' property, it is necessary that
the property line between Block 54 and 53 be moved fifty feet to the west as shown on
the land survey plat prepared by Absolute Surveying, Inc.
Because of the size of the Blocks, and the fact that the Blocks have not been
subdivided, there is more than adequate space to adjust the property lines. The
adjustment of the property line dividing Block 53 and 54 would result in Block 54
containing 9.421 acres +/- and Block 53 containing 8.01 acres +/-.
Dearfield Townsite and Development has not adopted any rules or regulations or
homeowner's association. The adjustment of the property line will not be in violation of
any adopted rules, regulations, and ordinances currently in force and effecting the
subdivision. Change in the lot line will not effect, or alter access for ingress or egress,
and will not effect providing utilities to the property. The change in the lot line will not
effect fire protection or law enforcement agencies' access to the property. The moving
of the lot line will not create a new lot and will only effect the property line between
Blocks 54 and 53.
The remaining acreage in Block 53 of 8.01 +/- acres is more than adequate to provide a
homesite. The owners of Block 53 and Block 54 are in agreement and have no
objection to the adjustment of the property line between Block 53 and Block 54. The
adjustment of the property line will not affect any other property owners.
The owners of Block 53 and 54 have joined together in this application, and request that
the property line adjustment as requested be approved.
