J. Geile, Chair Commissioner David E. Long, Pro-Tem Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad - EXCUSED Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Cyndy Giauque Planning Department representative, Brad Mueller Health Department representative, Char Davis Public Works representative, Peter Schei The following business was transacted: I hereby certify that pursuant to a notice dated August 31,2006,and duly published September 6, 2006, in the Fort Lupton Press, a public hearing was conducted to consider the request of Gold Stone Center, LLC, for a Site Specific Development Plan and Minor Subdivision Final Plan, MF#1081,for nine(9)residential lots and two(2)open space tracts in the E(Estate)Zone District. Cyndy Giauque, Assistant County Attorney, made this a matter of record, and advised the applicant's representative,Thomas Honn,that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes,or in the case of a tie vote,Commissioner Vaad will listen to the record and make the determining vote. Mr. Honn indicated he would like to proceed today. Brad Mueller,Department of Planning Services,presented a brief summary of the proposal,entered the favorable recommendation of the Planning Commission into the record as written,and gave a brief description of the location of the site and surrounding land uses. He stated the eastern one-third of the site is within the floodplain,and following discussion at the Change of Zone hearing, the applicant modified the site plan to situate the lots west of the floodplain. Mr. Mueller stated the application meets the 16 criteria for approval listed in Section 24-3-60.P of the Weld County Code. He stated the applicant did request approval of paved roads,which the Department of Public Works supports;however,the Planning Commission did not approve,and the applicant has since agreed to construct a gravel road as reflected in the Planning Commission recommendation. Mr. Mueller submitted the letter indicating agreement to construct a gravel internal road,marked Exhibit G,and stated the plat needs to maintain the septic envelopes,the road should be renamed to something other than a County Road reference,and that a common ownership parcel should be identified for the bus shelter and mail kiosk. Char Davis, Department of Public Health and Environment, stated she concurs with the Mr. Mueller's presentation regarding septic envelopes. 2006-2427 PL1810 (1(1 Pk), /`/t- /0 —/9 -os HEARING CERTIFICATION - GOLD STONE CENTER, LLC (MF #1081) PAGE 2 Peter Schei, Department of Public Works, stated the Department of Public Works supports an internal gravel road, with the understanding that it will be maintained by the Homeowners' Association. Mr. Honn stated he has reviewed and concurs with the Conditions of Approval as proposed, and noted that most of the issues will be addressed in the final Covenants, which will be submitted following approval of the Final Plan. He stated the Planning Commission indicated a paved internal road, which would be some distance from the closest paved County road, would create maintenance problems. He stated the Covenants will be modified to reference a gravel internal road. He further stated the right-of-way for Weld County Road 94 was vacated; however, an easement was created for the property owner to the north, as well as some additional setback distance. Mr. Honn stated the applicant has also discussed a land lease with the property owner to the east to utilize Parcel B for dryland farming or grazing. He clarified Parcel B will be owned by the Homeowners' Association, and if the neighbor chooses not to utilize the area, it will become open space for the residents. No public testimony was offered concerning this matter. In response to Chair Geile, Mr. Honn reiterated he and the applicants have reviewed and concur with the Conditions of Approval as proposed. Commissioner Long moved to approve the request of Gold Stone Center, LLC,for a Site Specific Development Plan and Minor Subdivision Final Plan,MF#1081,for nine(9)residential lots and two (2) open space tracts in the E (Estate) Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Jerke, and it carried unanimously. There being no further discussion, the hearing was completed at 11:45 a.m. This Certification was approved on the 25th day of September 2006.
