HomeMy WebLinkAbout20062136 RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST EDMUND AND JUANITA VICORY FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Edmund and Juanita Vicory,VI#0600202,are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of August, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Edmund and Juanita Vicory, property owners, were present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until November 8, 2006, to allow adequate time for the property owners to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way, and to complete the removal of the mobile home to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. If the mobile home is completely demolished prior to this hearing a Zoning Permit will not be required; however, if any portion of the mobile home remains prior to this hearing a Zoning Permit for the mobile home will be necessary. For you convenience, I am enclosing an application just in case you wish to take this avenue to allow additional time. D. Please call me if you choose to install screening so we can discuss the option. This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance to answer any questions the Board of County Commissioners might have about the violations.
