Site Specific Development Plan and Use by Special Review Permit for Mineral Resource Development
Facilities, including Open Pit Mining and Materials processing, including a Concrete Batch Plant, in the A
(Agricultural) Zone District..
1. A building permit shall be obtained prior to the construction or placement of any structure such as a
scale house/office, concrete batch plant, and any other structures placed on the parcels. An electrical
permit will be required for any electrical service to equipment. A plot plan shall be submitted when applying
for building permits showing all structures with accurate distances between structures,and from structures
to all property lines.
2. A plan review is required for each building for which a building permit is required. Plans shall bear the
wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when
applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2003 International Building Code;
2003 International Mechanical Code; 2003 International Plumbing Code; 2002 National Electrical Code;
2003 International Fuel Gas Code and Chapter 29 of the Weld County Code.
4. Each structure set on a foundation will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5. Building wall and opening protection and limitations and the separation of buildings of mixed occupancy
classifications shall be in accordance with the Building Code. Setback and offset distances shall be
determined by the Zoning Ordinance.

6. Building height shall be measured in accordance with the Building Code for the purpose of determining
the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall
be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance
with offset and setback requirements. Offset and setback requirements are measured to the farthest
projection from the building.
7. A Flood Hazard Development Permit shall be submitted for buildings constructed in the 100-year flood
plain.

This referral does not appear to qualify as a "subdivision"as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments.
According to the submitted information, the Gravel Mining operation will cause depletions to
the South Platte River due to evaporative losses from exposed ground water and operational losses.
A Substitute Water Supply Plan (SWSP) or court approved augmentation plan must be
obtained to replace the depletions caused by the operation.
Gravel pit operators typically must first obtain approval from the Colorado Division of Minerals
and Geology(DMG)prior to mining. As part of that process the applicant will need to address the
potential concerns of State Engineer's Office as they relate to water rights.

Dear Mr. Ogle:
I have reviewed the submitted material pertaining to the Site Development Plan and
Special Review Permit for gravel mining and batch plant activities north of and adjacent
to Weld County Road 26 and west of and adjacent to Weld County Road 15 (Case
Number: USR-1529, Case Name: Asphalt Specialties). The Fire District does not object
to this request if the requirements of the District can be met. Based on my review, I have
the following comments and stipulations:
• Approved address numbers shall be placed at the entrance to the site in such a
position to be plainly visible and legible from the street fronting the property.
Address numbers or letters shall contrast with their background.
• Fire apparatus roads shall be provided so fire apparatus may reach to within 150 feet
of all portions of buildings or facilities. Apparatus access roads shall be a minimum
of 20 feet in width and be designed and maintained to support the imposed loads of
fire apparatus (75,000 pounds). Roads must have a surface that provides all-weather
driving capabilities.
• Tanks installed for flammable or combustible liquid storage or dispensing, either
temporary or permanent need to be installed in accordance with the requirements of
the Uniform Fire Code. Tanks shall not be located within 100 feet of a property line
or a building. Guard posts shall be provided to protect the tank(s) from vehicular or
physical damage. Tanks shall be conspicuously marked with a label or placard
identifying the material contained and the area surrounding a tank or group of tanks
shall be diked to prevent accidental discharge of liquid from endangering adjacent

tanks, adjoining property or reaching waterways. Plans for the installation of fuel = 43
tanks must be submitted to the Fire District for review and approval prior to
installation.

Dear Mr. Ogle,
St. Vrain Sanitation District (SVSD) would like to state that it has interest in an
easement on the west side of the property for sewer pipe installation to serve the ultimate
build-out of the District. We have contacted the Nelson's, property owners, and they
appear to be willing to take this to the next step. Construction of the pipe could be in
conjunction with mining operation.
In addition, the St. Vrain Wastewater Treatment Facility is directly across the property
line on the northwest portion of the project. Consideration should be given to minimize
and control dust.
Lastly, SVSD has an easement on the north part of the defined property from our
property line to WCR 15. This is both an access and future utility easement to the plant.
Elevation along the length of easement is expected to be restored to preconstruction
conditions. This easement should be shown on the submitted drawings and is not. There
is also a conservation easement SVSD has on the property which also should be shown.

The Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of the
Use by Special Review Standards; Weld County Code, Chapter 23, Article 2, Division 4, Section 23. Our
comments and requirements are as follows:
COMMENTS:
WCR 26 is local paved road and requires a 60-foot right-of-way at full build out. This is road is maintained by
Weld County. WCR 26 was upgraded and paved to accommodate two gravel facilities utilizing this as their
designated haul route: L.G. Everist and Owens Brothers
REQUIREMENTS:
ccess: Access to WCR 26 shall be paved with adequate turning radiuses a minimum of 24 feet in width to
accommodate two-way traffic, match existing grade. The pavement shall extend through the scale
house/office area and a small parking lot accompanying that facility.
Long-Term Road Maintenance and Improvements Agreement: The applicant shall enter into a Long-Term
Road Maintenance and Improvements Agreement with the Weld County Public Works Department on the
designated haul route described in the Agreement.
Traffic Study: The applicant's engineer, LSC Transportation Consultants, has provided a traffic study
associated with the Nelson pit. In reviewing the document, the most effective intersection of WCR 26/WCR 13
is expected to operate at a very good Level of Service (LOS) "B" or better either with or without the addition of
site-generated traffic during the early morning and evening peak periods through the year 2017.
90% of the traffic will head southbound on WCR 13 to the signalized intersection of WCR 24. The additional
10% will head north to State Highway 66, a stop condition.
Storm Water Drainage: On site storm water drainage due to the new pavement will be handled with ditches
and culvert. Stockpiling will not be placed in the path of major historical drainage patterns. Best management
practices (BMP) for disturbed areas will be implemented to prevent excess sediment loads from entering the
gravel lake to the north.
Off-Street Parking/Loading Areas: These areas including the access to the scale house from the pit area
shall be surfaced with adequate gravel or the equivalent and shall have adequate dust control throughout the
approach and loading areas.

Environmental Health Services has reviewed this proposal for a mineral resource
development facilities, including open pit mining, materials processing, and a concrete
batch plant. We have no objections to the proposal, however, we do recommend that
the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
-- (A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment, if applicable.
2. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
3. The applicant shall submit evidence of a Colorado Discharge Permit System
(CDPS) from the Water Quality Control Division of the Colorado Department of
Health and Environment for any proposed discharge into State Waterways, if
applicable.
4. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The evidence of an existing water tap submitted by the applicant was
not appropriate because it did not show proof that the water bill was for this site
location.
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).

2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health and
the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed
scalehouse/office and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.

4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
vendors.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.Portable toilets may be utilized on sites that are temporary locations of the
working face and portable processing equipment, etc. for up to six months at
each location.
11.Bottled water shall be provided to employees at the temporary locations of the
working face at all times.
12.The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
13.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
14.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Kerr-McGee Rocky Mountain Corporation ("KMRMC") is the owner of valid oil and gas
leases underlying all or part of the Nelson Mining Resource Development, for which Asphalt
Specialties CO. is seeking USR approval. KMRMC and Asphalt Specialties have been
negotiating a Mining Agreement, the terms of which will govern the parties' simultaneous use of
the subject property. KMRMC does not object to the USR application for which Asphalt
Specialties is applying. However, the parties have not yet concluded an agreement, and
KMRMC therefore requests that the Planning Commission withhold final approval of this USR
application until the parties execute and record an agreement.

A meeting with the Weld County Planning Commission has been scheduled for
October 18, 2005, 1:30 pm at the Hearing Room, Weld County Planning
Department, 918 10th Street, Greeley, Colorado. The nature of the hearing is to
discuss a Request for a Site Specific Development Plan and Special Review
Permit for mineral resource development facilities including dry open pit mining,
materials processing and a concrete batch plant in the A (Agricultural) Zone
District on a parcel of land described as E2 SE4 SECTION 31, T3N, R67W of the
6th P.M.. Weld County Colorado.
The name of the applicant is Asphalt Specialties Co., Inc. whose address is
