Furthermore, our Weld County Code does not make allowances for mobile homes to be utilized as anything other than dwelling units. The only recommendation that staff can make is to remove the mobile home and obtain a building permit for the garage. She is the Executive Assistant to the President of UCAR(University Center for Atmospheric Research) and is generally required to be at these meetings to assist the President as well as take minutes for the meeting. Are there other dates that would be available in early July? Or, from June 16 - 21? We will be out of state June 22 - 30. The Weld County Code is very strict when it comes to mobile homes (even shells). That is why I suggest that the Board hear your plea. We realize that you bought this property after the mobile home/garage was already constructed. As for the general "clean-up", I was just wanting to make sure to allow adequate time to close that aspect of the violation before proceeding before the Board. I would be more than happy to answer any additional questions you may have. I can schedule your case either for May 9 or June 13 - both have a 10 am start time and typically end no later than noon. Which date works better for you? As do you and the board of commissioners, my lovely wife and I also have to work for a living and for me to take time off from work to meet with the commissioners, I lose income for every hour I am not at work. Surely you all can understand this. I am hoping the pics will show that the violations are no longer there and if you wish to do a drive by to see for yourself you'll see that is indeed the case. Now, there is just the issue of the garage/mobile home-shell for which we hope to get whatever paperwork or permit resolved so we can return to our normal daily life without the worry of these issues weighing upon us every day. Staff has reviewed every possible avenue in an effort to attempt to assist you with the garage/mobile home. We understand that you did not create this hardship, but have not been able to discover any feesable avenues to correct this issue. Staff determined that your best hope is to appear before the Board of County Commissioners at a Violation Hearing and see if they will have "mercy". We do not have the authority to disregard this violation once we have seen it. What I would actually suggest is that I send out a 30 day letter (Violation Notice) and hopefully this will give you enough time to work on the general yard clean-up so that this aspect of the violation would be closed before we needed to appear before the Board. Then schedule your case before the Board and try to have them help out or at least make a determination on the garage/mobile home. We can discuss this more on Monday. Had you seen his place when we bought it from the Williams in Oct. 1999, it would e obvious to you the amount of leanup and aesthetic improvements we have accomplished with this lace. When we first took ownership, it was n a very sad, dumpy state and it required massive amounts of leanup. On the other hand, we agree that Aristocrat as extremely dumpy overall and you have been doing a stellar job in etting people to clean it up. We were a bit offended o hear that someone would think our place was trashy especially with 04/13/2006 Page 4 of 6 as much as we've done to clean it up and keep it well organized. Then again, after taking another look since reading your letter, we can see the areas that could stand to be spiced up a bit more (and indeed we shall do so). In regard to the Hay Barn (old MH), what must we do in order to be able to keep it? We cannot afford to build a new Hay Barn thus, we would ask you to inform us on what it would take for us to keep it. Permit? External aesthetics? (ie. Siding matching that of the garage?) Can we have it classified as an out building? We want to be in compliance but we would like not to be forced into something that is un-affordable for us. Please understand that things mentioned above are not directed personally at you because we are well aware that you are doing your job, and doing it well! The 2nd Filing, simply refers to the legal description of the property. You are in the second filing of Aristocrat Ranchettes. It doesn't have anything to do with how many letters you may have received. 2.) Mobile homes (whether livable or not) are required to be permitted. I searched our records and the only permits I can associate with this property are for ZPMH-241 (the Zoning Permit for the Principle Dwelling Unit) and M00709 (the building permit for the Principle Dwelling Unit). I can not find any building permits for any other structures. In fact, the tax records indicate that you aren't even being taxed for any other structures (i.e., garage/barns). Grandfathering would not apply for the structures, since building permits have been required prior to the presence of Aristocrat. I can say with certainty that the single-wide was not present prior to 1973, because the Zoning Permit specifically states that there were no other mobile homes or structures on the property. Since the property owner (Williams) at that time applied for a Zoning and Building Permit at that time, it also leads me to believe that they were aware that a Zoning and Building Permit would be required for any additional mobile homes or structures. I will continue to check out this avenue and see what additional information I can locate. 3.) I did not run a "license plate"verification on the camper/trailer yet. I will remove the camper/trailer. More specifically I am referring to the items you mentioned below "wood that will be cut up for firewood and the pieces of an old metal garage door and other materials" Your neighbors to the North are also in violation and they are in the process 04/13/2006 Page 5 of 6 of cleaning as well. My suggestion would be to place a small amount of screening along the Northern corner so your items would not be visible from any adjacent properties or road rights-of-ways. 4.) I am sorry that you feel your are being "targeted by our office", I can assure you that is not the case. I am in Aristocrat on a weekly basis and am working very diligently throughout the entire subdivision. On my last count, I had 59 active violations in Aristocrat, of which 23 are at the County Attorney's Office awaiting legal action. The Subject line in the letter states; "VI-0600119, Lot 8, Block 28, Aristocrat Ranchettes, 2nd Filing, Weld County, Colorado" First, why is this listed as a 2nd filing since this is the first letter we have ever received in regard to the subject listed above? Second, in regard to the"un-permitted mobile home", there is no liveable mobile home on this property. There is a stripped-out shell of what used to be a mobile home that has been here for at least 30 years (maybe more) and has a garage that it is and has been a part of this structure for more than two decades. This structure was here when we bought this property and is none other than a storage barn for hay to feed our horses. It has been used for a storage barn since long before we owned this property and still continues in that use today. There is neither plumbing, nor electricity in that structure. It is simply a shell used for the protection and storage of hay. It is in no way occupiable as a living structure! Does something that has been here for so long, and that is being used for the purposes mentioned, not qualify for grand fathering? Third, what constitutes a junk yard? We have nothing on our property that would give a resemblance of a junkyard. The equipment and vehicles that we have on our property are all used, including the "so called" derelict camper/trailer, that is a perfectly good functional (though old) camper trailer that we keep licensed and use every year for extended camping trips. Surely there are no laws against keeping our camper trailer on our own property? We do have a couple of piles of wood that will be cut up for firewood and the pieces of an old metal garage door and other materials that were part of our continued renovation of this property. However, overall, we keep this place mowed and cleaned up (including picking up the sometimes horrific amounts of trash that blow 04/13/2006 Page 6 of 6 • in from other properties on windy days!) We are the sole occupants of this property. We are good tax paying law abiding citizens and don't understand why we are being targeted by your office. There are so many places that do look like junk yards around here that merit this type of attention more than our humble abode.
