The sheriff's office requests that gravel trucks transporting materials out of the area on county roads assure that their loads are covered, thus reducing loose materials on the roadway and the amount of damage to vehicles. 2. The Sheriff's Office also requests that gravel trucks and other vehicles leaving the site do not bring foreign materials on to the roadways on their tires. This may be accomplished by paving a short distance prior to entering the public roadway. 3. The sheriffs office would be willing to provide a program entitled Crime Prevention through Environmental Design to the developer. This program reduces the likelihood of criminal activity at a specific location by "hardening" it to crime. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. I have no other comments on this proposal. The resource will not be processed on to site where it is extracted from, however, through the use of a conveyor system the resource product will be conveyed across County Road 20 1/2 to the Cottonwood Pit operated by Western Paving and Construction, Company. The application's referral materials did not include a crossing agreement with Weld County Department of Public Works. One shall be obtained prior to scheduling a Board of County Commissioners hearing unless otherwise required by the Department of Public Works referral. The application's referral materials also did not include an agreement with the Smith and Emmons Ditch Company stating that this organization is in agreement with the applicant's statement that the ditch may be relocated. Written evidence of an agreement between the applicant and the Smith and Emmons Ditch Company shall be obtained prior to scheduling a Board of County Commissioners hearing. The application's referral materials also did not include an agreement with the Idaho Creek and associated ditch company. Written evidence of an agreement between the applicant and the Idaho Creek Ditch Company shall be obtained prior to scheduling a Board of County Commissioners hearing. The applicant shall contact Madoline Wallace of Bernard Lyons Gaddis and Kahn at 303/ 776-9900 to facilitate the obtaining of this agreement. The application's referral materials also did not include an agreement with the electrical service provider stating that they have no objection to a conveyor extending over or under their existing power lines. Written evidence of an agreement between the applicant and the electric service provider shall be obtained prior to scheduling a Board of County Commissioners hearing. Staff reviewed the Special Review Plan for this application, and staff did not review any associated maps usually present for this application. Further, there was not evidence provided stating that the applicant had obtained the Division of Minerals and Geology (DMG) Permit. Descriptive text associated with this application discusses the proposed treatment of the site at Duckworth Pit, Page 1 present, and the proposed treatment of the site when mining is finished. The post-mining land use is for open water for recreational use and wildlife habitat. Depending on the nature of the recreational use, staff does not believe that wildlife habitat will be conducive to recreational opportunities, except on a passive recreational basis. On-site landscape treatment consists of existing and proposed deciduous and evergreen trees with a dryland seed mix covering the ground plane. The plan is general and non-specific with no common, botanical or cultivar species noted. This plant material is located throughout the application boundary, typically at the edge of the proposed lined water storage reservoir and wildlife habitat areas. The shape of the reservoir has not been delineated, however, if the shape is as is proposed for mining, the non-undulating shoreline could be described as square at best. For the development of a wildlife habitat area, the reservoir shall have an undulating shoreline with terraced shelves to accommodate a wide variety of wildlife species. Further, the applicant shall contact the Colorado Division of Wildlife for direction on how to provide adequate cover and a positive environment to accommodate the newly created habitat area(s). Written evidence of the Colorado Division of Wildlife requirements and methods of implementing said requirements shall be submitted to the DMG and this office. These comments shall be reflected in the revised Reclamation and Landscape Plan. Per the application materials, the ground plane will be planted in native and/or drought tolerant grasses. Future correspondence shall identify the species of grass seed mix and whether the mix is to be drilled or broadcast for installation. Future correspondence shall identify the erosion control devices including but not limited to rip-rap and seeding that will be placed within and adjacent to this area. If plant material is proposed, please identify the species and how this plant material will be installed. Further, the text states that in the post-mining lake, marsh and aquatic plants will establish themselves, staff requests further information on how the applicant proposes this action to occur. Further, the proposed plant palette suggests that the installation of the plants would minimize the erosion potential, however, the information is incomplete, and staff requests additional information. Further, the application materials indicate that the slopes on site will be groomed to a 3:1 slope that appears to not be conducive to encouraging the establishment of riparian plant materials, shoreline vegetation, and terrace plant and aquatic life. Staff requests further clarification from the applicant concerning the post-mining reclamation. In the questionnaire, item number 6. States " No landscaping is proposed for this site." Staff requests additional information regarding this statement. Further, requirements for screening the operation from adjoining properties, including the public rights-of-way should be addressed. No discussion on this topic is presented. The overhead conveyor should be an enclosed to prevent the scattering of the resource as it it transported from the north side of CR 20.5 to the south side and the Cottonwood Pit. The applicant shall coordinate all conveyance activities, including design standards with the Weld County Department of Public Works. Written evidence of approval shall be submitted to the Department of Planning Services. Issues concerning potable water and septic, dust suppression and appropriate permits to be obtained prior to recording the plat(s) shall be coordinated with the Weld County Department of Duckworth Pit, Page 2 Public Health and Environment. Issues associated with on-site lighting shall be addressed to the Department of Planning Services and delineated on the recorded USR Plat(s). There was no discussion of the existing residence and outbuildings located within the USR boundary. Staff requests additional information on these structures including their utilization over the course of the mining and post mining time period. The applicant shall address Section 22-5-100.A of the Weld County Code which states "oil and gas exploration and production should occur in a manner which minimizes the impact to agricultural uses and the environment and reduces the conflicts between mineral development and current and future surface uses." Section 22-5-100.8 of the Weld County Code states "...encourage cooperation, coordination and communication between the surface owner and the mineral owner/operators of either the surface or the mineral estate." Finally, Section 22-5- 100.B.1 of the Weld County Code states "new development should be planned to take into account current and future oil and gas drilling activity to the extent oil and gas development can reasonably be anticipated." The applicant shall either submit a copy of an agreement with the property's mineral owner/operators stipulating that the oil and gas activities have been adequately incorporated into the design of the site or show evidence that an adequate attempt has been made to mitigate the concerns of the mineral owner/operators. The plat shall be amended to include any possible future drilling sites. The applicant shall apply for and be approved for a Flood Hazard Development Permit for any development that will increase or decrease the base flood elevation in the flood plain as delineated on FIRM Community Panel Map #080266 0850 C, dated September 28, 1982. Including the construction of any structures (conveyers, support structures), roads and parking areas. The applicant shall submit an Improvements Agreement for Public and Private Road Maintenance, as required by the Departments of Public Works and Planning Services for review and approval by these offices if so determined that one is needed. The Ditch Company recently received a referral for Mineral Reserves, Inc.'s ("Mineral Reserve") application, which requests Weld County's permission to mine gravel from the Duckworth Pit located on Lot B of RE-3714 in the NE '/ of Section 16, Township 2 North, Range 68 West of the 6th P.M. The Ditch Company owns the Smith and Emmons Ditch ("Ditch"), which through the proposed mining area. The Ditch Company also owns a 50-foot-wide easement being 25 feet-wide on either side of the Ditch's center line for the operation, maintenance, repair and replacement of the Ditch. Please ensure that any approval granted by Weld County to Mineral Reserve notes that ditch alterations (relocating, sloping or piping), ditch crossings (over, under, or through the ditch), encroachments on the easement (trees, structures, fences, etc.) and discharge of storm water into the Ditch is prohibited unless Mineral Reserve receives written permission from the Ditch Company. As part of the cleaning and maintenance of the Ditch, the Ditch Company may pile muck and debris from the Ditch on the Ditch's banks. The Fire District has no objections to the project if the requirements of the District can be met. The principal applications of the Code to a this type of operation will be for tank installations for flammable or combustible liquids, fueling operations, and any use of hazardous materials. Tanks installed for flammable or combustible liquid storage or dispensing, either temporary or permanent, need to be installed in accordance with the requirements of the Uniform Fire Code and plans for the installation must be reviewed and approved by the Fire District prior to installation. Water Division 1,Water District 6 Dear Jacqueline Hatch: Pursuant to the State Engineer's August 7, 1995 memorandum to county planning directors, this office is no longer providing comments on land use actions that do not involve a subdivision as defined in Section 30-28-101(10)(a), C.R.S. This referral does not appear to qualify as a"subdivision". However the following comments are provided for your information. We have reviewed the above referenced proposal to create a gravel mining operation on a 56.5-acre parcel. Based on the submitted information it appears that the Gravel Mining operation will cause depletions to the South Platte River due to evaporative losses from exposed ground water and operational losses. A Temporary Substitute Water Supply Plan or court approved augmentation plan must be obtained to replace the depletions caused by the operation. Gravel pit operators typically must first obtain approval from the Colorado Division of Minerals and Geology(DMG) prior to mining. As part of that process the applicant will need to address the potential concerns of State Engineer's Office as they relate to water rights. Lafarge West's Duckworth Pit is within the community's proposed future growth area. As a result, the Town offers the following comments. Vegetated berms The applicant has not sufficiently demonstrated that the site will be adequately screened and landscaped to mitigate visual impacts to adjacent land uses including the roads. The Town has received several applications for rural subdivisions near the proposed gravel operation. In addition, there are already two high-end residential developments along Weld County Road 7 (Rinn Valley Ranch and Lighthouse Cove) and several homes near the site. Traffic on Weld County Road 20 1/2 will continue to increase with the new development. The Town requests that the applicant construct a vegetated berm along WCR 20 '/2 to help mitigate the visual impacts from the site. The view to the south from the road is already impacted by the existing gravel operation. The mining operation will also be visible from the Lighthouse Cove subdivision. The Town recommends Lafarge construct an L-shaped berm along the northern property line. The berm should start at the western setback to Idaho Creek and run west approximately 250'. It should also extend southeast along the Idaho Creek setback for about 200' to screen the site from the existing homes. The Town recommends the berm be 8' to 10' high. Contact with the Community As we mentioned, residential development in this area is steadily increasing. The Town ft) z requests that the applicant describe a mechanism for resolving community issues and concerns throughout the life of the mining - operation. When possible, place rock piles along portions of the shoreline slopes to create additional wildlife habitat and reduce wind and surficial erosion. Re-evaluate seed mix The applicant is proposing a non-native seed mix for final reclamation. In order to maximize the benefit to wildlife, the Town strongly recommends using a native seed mix. The seed mix should include Blue Gramma, Western Wheatgrass, Little Bluestem and Green Needlegrass, Sideoats Gramma. The applicant should also consider using a native shoreline seed mix rather than solely relying on the volunteer establishment of plants. This will likely result in a weed patch rather than the desirable native species. The weeds will spread to adjacent areas and compete with the upland seeds the applicant is trying to establish. In addition, it has been our experience that Lewis' Page 2 Blue Flax can be extremely aggressive in certain situations. The applicant should consider an alternative forb such as Prairie Coneflower Scarlet Globemallow. Seeding Rate The proposed seeding rate of approximately 24 lbs/acre is too high. Planting too many seeds �4 # creates undesirable competition and can be = detrimental to the establishment of the grasses 'Pr s7 If a native seed mix is used, a seeding rate of x 4:8 pure live seed lbs/acre should be used for drill seeding. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. 2. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 3. Portable toilets may be utilized on sites that are temporary locations of the working face and portable processing equipment, etc. for up to six months at each location. 8. The Mineral Reserves, Inc. site will utilize conveyors to move material from the site across WCR 20.5 to the existing cottonwood processing facility. There will be no direct hauling from this location. REQUIREMENTS: Maintenance Improvements Agreement: LaFarge shall adhere to the existing maintenance and Improvements Agreement associated with the processing cottonwood pit M-1988-042, as there is no direct hauling identified or associated with this pit. All material will be moved by conveyor to the opposite side of the road for processing and dispersal. Future Right-of-Way: The applicant should reserve an additional 20 feet of property parallel to WCR 20.5 for future build out. From that point, the typical setback in an agricultural zone is 20 feet. No mining should occur within 70 feet of the center line of WCR 20.5. Conveyor Crossing: Weld County Public Works is requiring a detailed drawing to be submitted for review and approval of the conveyor crossing of WCR 20.5. Weld County participates in the National Flood Insurance Program, and Community Panel No. 080266 0850 C identifies the Special Flood Hazard Areas (SFHA) affected by the project. The project takes place within the SFHA created by Idaho Creek and Boulder Creek as shown on the attached Flood Insurance Rate Map. No base flood elevations are given, and no floodway is delineated for this reach. The applicant is reminded that ANY work performed in an SFHA requires the issuance of a Floodplain Development Permit (FDP). This may require certain conditions according to local ordinances.
