RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST RRRS, LLP CIO BRIAN PEARCE FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,RRRS, LLP c/o Brian Pearce,VI#0600011, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of April, 2006, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Brian Pearce, general manager, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until May 11, 2006, to allow adequate time for the property owners to submit an
amended Use by Special Review permit or remove all the outdoor storage, and to submit a parking
plan to bring the subject property into compliance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0600011 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against RRRS, LLP c/o Brian Pearce to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until May 11, 2006, to allow adequate time for the
property owners to submit an amended Use by Special Review permit or remove all the outdoor
storage, and to submit a parking plan to bring the subject property into compliance.

myself. They submitted copies of initial building plans.
March 13, 2006 Property inspected. Property remains in violation.
March 13, 2006 Bryon Horgen finaled BCS-060083 for'Boldt in Grill" internal expansion.
March 14, 2006 Letter sent to property owner indicating that the violation case was scheduled
before the Board of County Commissioners.

The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on April 11, 2006, at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property remains in violation of the

To bring the property into compliance, the following issues shall be corrected regarding SPR-107:
► Outdoor storage—The existing Site Plan Review(SPR-107) does not allow for outdoor
storage.
► Parking issues — It is my understanding that Kim Ogle is waiting for a parking plan.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.

Two arrested in prostitution bust

Weld County Sheriffs deputies arrested two Weld County women near Del Camino on Thursday in connection
with federal and county investigations of prostitution.
Yong Cho Gates, 67, and Ok Hui Yu, 52, both lived in the Sun Health Spas, 10763 Turner Blvd. No. 2, near Del
Camino in southwestern Weld, east of Longmont.
Gates, owner of the spa, told investigators she has lived in the spa for eight years. but also has a house in Mead.
Immigration and Customs Enforcement (ICE) federal agents notified the sheriffs office about an interstate
prostitution investigation. Sheriffs investigators began a local investigation in June, said sheriffs detective Alan
Caldwell.
An undercover investigator went to the spa last week,but did not get propositioned, said Caldwell, lead
investigator in the case. Yu allegedly propositioned a different undercover investigator at the spa on Thursday.
The women reportedly told investigators the spa charged $40 for a 30-minute massage and $60 for an hour-long
massage. Yu said the price for prostitution was an additional $140. She said she would keep $100 and give $40
to Gates.
Sheriffs deputies assisted ICE agents in an execution of a search warrant after Yu's reported offer.
Both women are Korean,but are legal U.S. residents, Caldwell said. Yu moved into the spa at the beginning of
the month when she arrived from Boston.
Gates was arrested and charged for keeping a place of prostitution and Yu was arrested in connection with
engaging in the act of prostitution.
Both women were taken to Weld County Jail on Thursday and posted bond early Friday.
Gates posted a $2,000 bond and Yu posted a$1,000 bond. No federal charges have been filed, but the case is
still under investigation, said U.S. Attorney Office spokesman Jeff Dorschner.
"Prostitution is, like they say, the oldest crime in the world," Caldwell said. "It's nice to be able to stop crime
where it's taking place. That's very rewarding."
