RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600065
AGAINST BECKLES, LLC FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Beckles, LLC, VI#0600065, is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of July, 2006, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Beckles, LLC was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Beckles, LLC to remedy the violation of the Weld County Code, and any other
persons occupying the properties, any persons claiming an interest in the properties, and any
persons acting in active concert with the identified parties.

REMEDY
To bring the property into compliance, the permit for the manufactured home shall have all inspections
completed and a certificate of occupancy issued or permit number BCN-060111 shall be issued, a plot plan
submitted, and the balance of$51.00 paid.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney for
immediate action as I have spoke with Mr. Buck several times and this matter has not been resolved.

expired.
February 16, 2006 30-day violation letter issued.
March 6, 2006 E-mail from Jack Buck requesting information on extension.
E-mail response to Jack Buck advising we cannot grant extensions on manufactured
home permits, a new permit could be issued to complete the steps and landings.
Response from Jack Buck, he will get a new permit for the steps and landings.
March 23, 2006 E-mail to Jack Buck to submit permit application to complete the manufactured
home to avoid a violation.
April 27, 2006 E-mail to Jack Buck advising permit is ready to be issued and balance of$51.00 is
due.

The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on July 11, 2006, at 10:00 a.m., to consider the violations. The
property is in violation of the following Section of the Weld County Code:
Section 29-3-290 "Manufactured home certificate of occupancy."
To bring your property into compliance:
The permit for the manufactured home shall have all inspections completed and a
certificate of occupancy issued or permit number BCN-060111 shall be issued,a plot
plan submitted, and the balance of$51.00 paid.
This meeting will take place at the Weld County Planning Department Office, 918 10th Street, Greeley,
Colorado. It is recommended that you or a representative be in attendance at this meeting to answer any
questions the Board of County Commissioners might have regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation,the action necessary to correct the violation, and that you

Dear Mr. Buck:
I have previously contacted you regarding expiration of the temporary certificate of occupancy on the above
noted permit for a manufactured home at 4513 Hot Springs Drive. On March 29, 2006, you submitted a
separate permit to complete the steps and landings and handrails so the permit could be closed. You have
been notified that the new permit (BCN-060111) has been approved and is ready to be issued. There is a
balance due of.$51.00 and a plot plan showing the distances to the lot lines is required. Until this permit is
issued, the permit for the manufactured home remains in violation.
Failure to submit the required information, pay the balance, and pick up the permit within 10 days from the
date of this letter will result in a notice to appear before the Board of County Commissioners to review the
violation. The Board will determine if an extension is warranted or if the case should be referred to the County
Attorney for legal action.

Thanks for your e-mail. Per the Weld County Code, we cannot extend manufactured home permits. We can
either schedule this case with the Board of County Commissioners (as they do have the authority to extend
these permits) or we can issue a new permit for a $21.00 fee for completion of the steps and landings.

What is in question, is the final on the step and landings. Our plan is to build a front and rear deck sometime in

It has been determined that the property located at 4513 Hot Springs Drive is currently in violation of the
following Sections of the Weld County Code:
Chapter 29,Article III "Building Permits"
Section 29-3-280 "Certificate of occupancy."
Section 29-3-290 "Manufactured home certificate of occupancy."
To bring your property into compliance with the Weld County Code:
The permit for the manufactured home shall have all inspections completed and a certificate of occupancy issued.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30(thirty)days from February
16, 2006, to correct this building violation. Failure to do so will result in this office scheduling the violation
before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's
Office for legal action.

manufactured home at 4513 Hot Springs Drive has expired and all required inspections have not been
completed. Section 29-7-130 of the Weld County Code states that a certificate of occupancy shall be obtained
on all mobile, manufactured, or factory-built homes no later than one hundred eighty (180) days after the
permit is issued. In the event the certificate of occupancy is not issued within 10 days from the date of this
letter, a meeting may be scheduled with the Board of County Commissioners to review the violation. The
Board will determine if an extension is warranted or if the case should be referred to the County Attorney for
legal action.

Section 29-7-130 of the Weld County Code states:
"The certificate of occupancy shall be obtained no later than one hundred

occupancy within the one-hundred-eighty-day period will be sufficient reason
