Dear Sirs:
We are in receipt of your letter dated December 8, 2005 regarding the above mentioned matter.
At this time we are disinclined to acquiesce to the addition of a commercial junkyard or salvage
yard to be incorporated into the landscape as proposed. Morganti Modular Homes has taken great
care and expense in creating an environment that is conducive to prospective home buyers in
being agreeable and neat in appearance. We have spent close to $15,000 for a site plan review to
clean up our property and do not want to see an infringement on our visual rights. We feel that an
introduction of this type of business at this time is non-compatible with our property and local
goals. Please consider this a formal denial of your proposal. Considering the growth and
urbanization of the local area perhaps another location would be more appropriate for this type of
business.

SUBJECT: AmUSR-1476, Fusaro LLC
At your request, I inspected the site prior to the Planning Commission Hearing on April 18, 2006.
The renovation of the building includes installing additional overhead door sections. The access improvements
and parking lot road base has been bulked in with no compaction. These areas need to be regraded and
compacted again. The site has been cleaned up, but is still pretty rough.
Once the site is near completion, please contact our office for a follow-up inspection.

RE: Objection to Development Plan - Case# AmUSR-1476 (Fusaro LLC)
As a the proper owner owning lots to the North, South and East of the proposed Fusaro
Development plan, I am vehemently apposed to a commercial junkyard and salvage yard,
proposed at Lot 4 Althen Boyer Subdivision, Weld county CO.
I consider a junkyard blight on any and all future development of surrounding properties. I
have also been in contact with the Colorado Department of Transportation, in regards to CCR
601-2 (control junkyards in areas adjacent to interstate and primary highways systems.) The
program enforcement is being handled by Tim Bilobran, in CDOT Region 3, and the new
program coordinator Manijeh Saeidi. The proposed plan must meet two primary applications
"the stated business must be beyond 1,000 feet of the nearest edge of the right-of-way and
may not be visible from any federally—aided primary, or interstate system"Due to the
location of the 1-25 right-of-way edge as well as its elevated position over the property, a set
back and screening program would not be feasible, according to CDOT.
As owner of Water Well # 015774-F which supplies water to surrounding business and
residences, I have been in contact with Char Palmer of Weld county health, asking for a
formal statement involving contamination and risks due to junkyard carcinogens and heavy
containment risk to the groundwater from storm runoff.

This letter informs you that the Colorado Department of Transportation(CDOT) considers your
access grandfathered. It is CDOT position that provided there is no increase of traffic proposed as a
result of the subdivision of the property, then the existing accesses may remain in their current usage.
If the traffic volumes increase, CDOT reserves the right to readdress your access and bring them into
compliance with the current Colorado State Highway Access Code.
