Environmental Health Services has reviewed this proposal for a Landscaping Materials
Yard. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval.
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
�1 The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
3. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is grater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information.
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).

2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1: All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. The facility shall utilize the existing public water supply. (Little Thompson Water
District)
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
t#. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.

j,6.AIl pesticides, fertilizer, and other potentially hazardous chemicals must be
stored and handled in a safe manner in accordance with product labeling and in
a manner that minimizes the release of hazardous air pollutants (HAP's) and
volatile organic compounds (VOC's).
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Michelle based on the original submittal Dated May 20, 2003 and the limited information
in that submittal the following was the Windsor-Severance Fire Protection Districts
original requirements. I have included additional requirements for this project as I have
been provided with a lot more detail as it relates to the entire site with this current
submittal. The first five conditions are the original requirements and the current
requirements follow the originals.
1. The lot shall have its own access; each access shall be designed to carry a
designed wheel load of 18000pounds (80000 pound gvw) (H2O loading).
2. The access shall be constructed of a permanent all weather road base.
3. Addresses shall be posted clearly on the road fronting the property.
4. Addresses shall be posted clearly on the structures.
5. If any structures are located more than 150' from an approved accessway there
shall be alternative fire protection requirements enforced.
6. This site shall be provided with a minimum of(2) two points of access designed
to our standards.
7. The internal circulation shall meet our standards. We utilize a B-40 turning
template for turning radi etc.
8. This site shall be provided with fire hydrants that are on a minimum of a 6"main
and this system shall be looped and capable of providing 1500 gpm at 20 psi with
a flow duration of 2hrs. Hydrant spacing shall be 300' apart and 150' from
structures.

A Site Specific Development plan and Special Review Permit for a Business permitted as a use in the
Commercial Zone District (Landscape Materials Yard) in the A (Agricultural)Zone District.
1. All structures unless exempted by Weld County Code Section 28-2-20 will require a Building permit.
A. Change of use of the 30'x40' pole building from private storage to Group M ( Mercantile.) This includes
the 10' x 10' public bathroom. The building and bathrooms shall be accessible to persons with disabilities.
B. The 13' x 36' 3- sided pole building for storage of loaders/attachments and various hard goods.
C. The retaining walls.
D. The Kiosk
E. The deck that will be attached to the office.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Access: WCR 17 (arterial roadway) and 60 feet of right-of-way at this location has been annexed by the City
of Greeley.
REQUIREMENTS:
vSite Access: The internal road shall enter on to the easement at a 90° angle for a minimum of one vehicle
length to provide adequate sight distance in both directions.
.,Easement: The 60-foot access easement is a joint ownership as per Book 648, Recording 1570019, and it
-Mould be identified on the plat drawing.
'Road Widening: The roadway narrows just past the entrance to Timberrock to a one-way lane across the
drainage pattern. This is a safety concern. There should be two driving lanes extended to your west property
line.
Dust Control: The applicant shall apply dust suppression chemical (magnesium chloride or calcium chloride)
on the haul road between Weld County Road (WCR) 17 and the entrance to the site no less than twice a year
or as determined by the Department of Public Works.
-64-Street Parking: The off-street parking including the access drive shall be surfaced with gravel and dust
control or the equivalent and shall be graded to prevent drainage problems. Each parking space adjacent to
the building shall be equipped with wheel guards or curb stops where necessary to prevent vehicles from
extending beyond the boundaries of the space and from coming into contact with other vehicles, walls, fences,
or planting.
v torm Water Drainage: Section 23-2-240 5a and b (drainage report), and Section 24-7-120 A(1) (storm
drainage requirements). The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.
I am referring a portion of the storm water drainage to the Weld County Health and Environment Department,
as some of the landscaping material may deal with dyed or stained bark or tree products.

The sheriffs office recommends the following improvements for this landscape materials
yard.
1. The sheriffs office requests that gravel trucks transporting materials out of the
area on county roads assure that their loads are covered, thus reducing loose
materials on the roadway and the amount of damage to vehicles.
2. The Sheriffs Office also requests that gravel trucks and other vehicles leaving
the site do not bring foreign materials on to the roadways on their tires. This
may be accomplished by paving a short distance prior to entering the public
roadway.
3. The sheriff's office would be willing to provide a program entitled Crime
Prevention through Environmental Design to the developer. This program
reduces the likelihood of criminal activity at a specific location by
"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

Thank you for the opportunity to comment on this USR for a landscaping yard in the
Agricultural Zone District. The City of Greeley Planning staff has reviewed the information
supplied to date for the proposed use and wishes to forward the following comments:
1. The subject property is located in the City of Greeley's Long-Range Expected Growth Area
(LREGA), as adopted by the City of Greeley 2020 Comprehensive Plan. The LREGA includes
those lands anticipated to accommodate the City of Greeley's urban development over the next
twenty years.
2. Outdoor storage should not be permitted within any applicable setback, public right-of-way,
or in landscaped areas.
3. Items not customarily used or stored outside or made of a material that is resistant to damage
or deterioration from exposure to the outside environment should not be placed, stored, or
maintained outside for a period in excess of 24 consecutive hours.
4. The access drives and parking areas should be paved with asphalt or concrete to reduce the
development's impact on air quality.
5. A landscaping buffer yard should be provided to ensure that the proposed use provides
sufficient buffering and screening to effectively shield neighboring properties. In addition, a
buffer yard should be provided between the future residence on-site and the proposed use.

6. The subject site is located in an area that is designated by both Windsor and Greeley as an
employment corridor. The proposed use is not compatible with anticipated uses in this area.

Upon review of my computer and files, the following violation was noted (VI-0300014). The violation is in
regards to the operation of a landscaping yard without an approved Use by Special Review permit;therefore, if
approved and once recorded this violation would be closed.
Please be advised that this case was referred to the County Attorney's Office after denial of USR-1430 by the
Board of County Commissioners. Subsequently,a separate Violation Hearing was not necessary. Therefore,
if denied, staff would request that 30 (thirty) days be allowed for all business equipment and storage to be
completely removed from the property before proceeding with legal action in District Court.

Subject: Weld County referral—Use by Special Review(USR-1495)—Timberrock—
Marcelle Geudner,property owner/Jess Aragon, owner's representative
Dear Ms. Martin:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting of
December 15, 2004. The subject property is located within the Town's Growth Management
Area (GMA) and is depicted as High Density Estate Single Family Residential on the Town's
Land Use Plan Map. The Windsor Comprehensive Plan states that the High Density Estate
Single Family Residential land use depiction provides for, "...single-family residential detached
homes at very low densities at a minimum density of one dwelling unit per acre." This land use
depiction is consistent with the existing surrounding residential land uses to the north.
Although the subject property is depicted as High Density Estate Single Family Residential on
the Town's Land Use Plan map, the adjacent property to the south is depicted as Employment
Corridor on the Town's Land Use Plan Map, which provides for, "...areas of targeted investment
centered on gateway development activities including significant new office, commercial and
housing opportunities." Additionally, the Town is currently in the process of annexing the
property immediately to the south of the subject site under the name of Southgate First, Second,
Third, Fourth, Fifth and Sixth Annexations and it is anticipated that these annexations will be
completed in early 2005. Furthermore, the Planning Commission reviewed a similar Use by
Special Review (USR-1430) Weld County application proposed by the same applicant on the
same property at the June 5, 2003 Planning Commission meeting and forwarded a
recommendation of approval of USR-1430 at that time.
With regard to the proposed landscape materials sales use, the applicant should be advised that,
in the event that contiguity can be demonstrated and a petition to annex the subject property is
submitted to the Town in the future, the subject use would be required to meet the Town's
standards. For example, additional improvements that the Town typically would require include,
but are not limited to: acquisition and dedication of public right-of-way to the site; paving of the
road to the site; paving of all parking and circulation areas; etc. The Town would also require
that all requirements of the Windsor-Severance Fire Protection District (WSFPD) be
satisfactorily addressed including, but not limited to, the conditions contained in a July 1, 2004
memo from Mr. Mike Davis, WSFPD.
Based upon the aforementioned information and the Planning Commission's previous
recommendation of approval of a similar Use By Special Review application on the same
property proposed by the same applicant, the Planning Commission recommends approval of the
Use by Special Review(USR-1495).
