HomeMy WebLinkAbout20061062.tiff RESOLUTION RE: APPROVE CONTRACT AMENDMENT #1 FOR THE EARLY AND PERIODIC SCREENING, DIAGNOSIS AND TREATMENT PROGRAM AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with Contract Amendment#1 for the Early and Periodic Screening, Diagnosis and Treatment Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment,and the Colorado Department of Public Health and Environment,commencing July 1, 2006,and ending June 30,2007,with further terms and conditions being as stated in said contract, and WHEREAS,after review,the Board deems it advisable to approve said contract amendment, a copy of which is attached hereto and incorporated herein by reference. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that Contract Amendment#1 for the Early and Periodic Screening,Diagnosis and Treatment Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,on behalf of the Weld County Department of Public Health and Environment,and the Colorado Department of Public Health and Environment be,and hereby is, approved. Funding from this contract will be used to provide case management, outreach, and support services for children ages birth to 21 who are on Medicaid in the northeast region of Colorado. Emphasis is on educating families about age appropriate well child services and helping them utilize these services which are available in our community. For these activities, Weld County will be reimbursed a sum not to exceed $125,317 for the time period July I, 2006 through June 30, 2007 I recommend your approval of this amendment. Agency or Department Name Health Care Policy&Financing Department or Agency Number UHA Contract Routing Number 2107-9020 CONTRACT AMENDMENT NUMBER 1 THIS AMENDMENT, made this first day of March 2006, by and between the State of Colorado for the use and benefit of the Department of Health Care Policy and Financing, 1570 Grant Street, Denver, Colorado 80203, hereinafter referred to as the Department, and Board of County Commissioners of Weld County, located at 1555 North 17th Avenue, Greeley, Colorado 80631, hereinafter referred to as the Contractor. FACTUAL RECITALS Authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made available and a sufficient unencumbered balance thereof remains available for payment; and Required approval, clearance, and coordination has been accomplished from and with appropriate agencies; and The parties entered into a contract dated May 1, 2005, to provide Early and Periodic, Screening, Diagnosis and treatment (EPSDT) outreach and case management services. The purpose of this amendment is to clarify a definition, revise and clarify the scope of work, extend the performance period and increase the not to exceed amount. NOW THEREFORE, it is hereby agreed that: 1. Consideration for this amendment to the original contract, Contract Routing Number 2106-0119, CLIN 06 UHA 00041, dated May 1, 2005, consists of the payments, which shall be made pursuant to this amendment and the promises, and agreements herein set forth. 2. It is expressly agreed by the parties that this amendment is supplemental to the original contract, Contract Routing Number 2106-0119, CLIN 06 UHA 00041, dated May 1, 2005, which is, by this reference, incorporated herein, that all terms, conditions, and provisions thereof, unless specifically modified herein, are to apply to this amendment as though they were expressly rewritten, incorporated, and included herein. 3. It is agreed the original contract is and shall be modified, altered, and changed in the following respects only: a. In Section I, the definition of "Early and Periodic Screening, Diagnosis and Treatment"shall be deleted and replaced with the following definition: "Early and Periodic Screening, Diagnosis and Treatment" (EPSDT) means those services set forth in 42 U.S.C. Section 1396d(r). b. The introductory paragraph of section II.B.l shall be deleted and replaced with the following: Contact all newly eligible pregnant women and those EPSDT eligible children and youth who have not received any Medicaid services/screens within 60 days of eligibility determination to ensure notification of EPSDT services and benefits. The contact shall include, but is not limited to: c. Section II.B.1.a. shall be deleted and replaced with the following: Providing an in-depth explanation of EPSDT benefits and the importance of preventive care and regular medical visits. The Contractor shall provide information to the parent or guardian that will facilitate overcoming barriers which may impede the client's access to EPSDT services. A tiered intervention shall be implemented with those at higher risk receiving more intensive interventions. The intervention shall be composed of reminder and recall letters and/or postcards, phone calls and home visits. d. Section II.B.1.c. shall be deleted and replaced with the following: Providing the phone number for the Colorado Medicaid Enrollment Broker to facilitate MCO enrollment. e. Section II.B.1.d. shall be deleted and replaced with the following: Informing parents or guardians of the need to utilize and arrange care and services with private primary insurance (if enrolled). £ Section II.B.1.f. shall be amended by adding the word "form" after the words "Add-A-Baby". g. Sections II.B.1.h. and i. shall be deleted. h. Section II.B.2. and 3. shall be deleted and replaced with the following: 2. Continue client follow-up if the client was not using an appropriate provider at the time the initial Outreach was completed or continue follow-up until the child or pregnant woman is in a Medical Home. "Medical Home" means an approach to health care that originates in a primary health care setting, which is family centered. It is not a place, but a team approach to providing health care. A partnership develops between the family and the primary health care practitioner. Together they access all medical and non-medical serviced needed by the child and family to achieve maximum potential. 3. Send a letter to the client's last known address after initial unsuccessful attempt to locate and inform the client via face-to-face or phone contact. Page 2 of 5 The letter shall contain information on the services necessary to bring the child up to date. Sections II.C.I. and 2. shall be deleted and replaced with the following: 1. Meet face to face with 50% of the currently available Medicaid providers or office staff in the contract service area to provide information on EPSDT benefits including covered mental health centers, available services and providers. Explain what the ESPDT Outreach coordinators can offer providers should the provider refer clients to the EPSDT Outreach office. 2. Make available to anyone who requests information, the accurate lists of community providers and Medicaid resource information such as Affiliated Computer Systems (ACS) Provider Bulletins and Medicaid program updates in written or electronic form. j. The title of Section II.E. shall be deleted and replaced with the word "Reporting". k. The paragraph that follows the title of Section II.E. shall be deleted and replaced with the following: The Contractor shall utilize a data tracking system. The Contractor shall use the tracking system to report electronically to the Department by the 10`h of each contract month and semiannually, no later than January 15, 2007 and on June 30, 2007, as final reporting documentation. Reports shall include the following information: II.F. shall be deleted and replaced with the following: Contractors may subcontract with other departments or agencies to provide EPSDT Outreach to eligible clients. Those agencies wishing to subcontract shall submit a plan to the Department which describes their relationship with any and all subcontractors who are completing the required activities. This plan will include an outline of the training to be provided, including samples of tools to be used, agreed upon expectations of the role the subcontractor, and the format in which the subcontractor will communicate client contact information with the EPSDT Contractor. The subcontractor will provide client contact information to the EPSDT Contractor to allow for the accurate tracking of encounters and referrals. m. The performance period set forth in Section III.B. shall be extended through June 30, 2007. n. The not to exceed amount set forth in Section III.C.1. shall be increased by $125,317.00 for a cumulative not to exceed amount of$248,634.00. Page 3 of 5 4. The effective date of this amendment is upon approval of the State Controller, or July 1, 2006, whichever is later. 5. Except for the "Special Provisions," in the event of any conflict, inconsistency, variance, or contradiction between the provisions of this amendment and any of the provisions of the original contract, the provisions of this amendment shall in all respects supersede, govern, and control. The "Special Provisions" shall always be controlling over other provisions in the contract or amendments. The representations in the Special Provisions concerning the absence of bribery or corrupt influences and personal interest of State employees are presently reaffirmed. 6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED, BUDGETED, AND OTHERWISE MADE AVAILABLE. This contract is not valid until the State Controller, or such assistant as he may delegate, has signed it. The contractor is not authorized to begin performance until the contract is signed and dated below. If performance begins prior to the date below, the State of Colorado may not be obligated to pay for goods and/or services provided.
