No. a—I State of Colorado, Weld County Clerk & Recorder RESOLUTION RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 132 - WHEELER FARM LAND AND RANCH COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, 0 ''' Colorado has reviewed the request of Wheeler Farm Land and Ranch Company for an exemption from the definitions of "subdivision" and "subdivided land" in Section 30-28-101 (10) , CRS 1973 , as amended, and Section 2-1 of the Weld County Subdivision Regulations , and WHEREAS , the Board of County Commissioners finds that Wheeler Farm Land and Ranch Company is the owner of a certain parcel of land located in part of the Southwest Quarter of Section 30 , Town- ship 4 North, Range 64 West of the 6th P.M. , Weld County, Colorado. This request would tie an additional 22 acres to the existing 42- acre parcel. The 185-acre parcel would be reduced by 22 acres . WHEREAS, the Board of County Commissioners has considered the recommendations of the Department of Planning Services and has reviewed the information submitted by the applicant and finds that said request should be granted. Special Use Permit Number 124-71-39 Dear Ms Traxler: This letter is an attempt to explain the request for the Sub-Division Exemption on the above discribed property. Per letter dated March 20, 1979 from Thomas E. Hahn, zoning administrator. Mr. Hahn pointed out that only a portion of the land that the Special Use Permit had been assigned to was being transfered and indicated in the letter that it would be better to have the Permit under one ownership. To correct this and place the permit under one ownership the Paynich's purchased an additional 22 ± acres . The parcel intended for sale contains greater than 35 acres . The remaining parcel is also greater than 35 acres. Therefore no requirements are necessary regarding com- pliance with subdivision requirements. The major concern discussed is one which will benefit the prospective purchaser. The Special Use Permit approved contained 40 acres. Only 20 acres will overlap the 40 acres being sold. It would be desirous for the new purchaser to amend the Special Use Permit boundary to be within the property he will acquire . At the same time he should file a plat showing location of existing and proposed structures of the hog facility. The material should be submitted as per the Special Use Permit guidelines available in this office. I recommend that the new owner make an appointment with Chuck Cunliffe or Vickie Traxler to discuss submittal requirements.
