RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR CONSTRUCTION,
MAINTENANCE AND USE OF PARKINGLOT FACILITIESANDAUTHORIZECHAIRTO
SIGN - CITY OF GREELEY
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement for
Construction,Maintenance and Use of Parking Lot Facilities between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, and the City of
Greeley,commencing upon full execution of said agreement,and ending March 8,2027,with further
terms and conditions being as stated in said agreement, and
WHEREAS,after review,the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the Intergovernmental Agreement for Construction, Maintenance and Use
of Parking Lot Facilities between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, and the City of Greeley be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreement.
The above and foregoing Resolution was,on motion duly made and seconded, adopted by
the following vote on the 8th day of March, A.D., 2006.

INTERGOVERNMENTAL AGREEMENT
BETWEEN WELD COUNTY, COLORADO AND
THE CITY OF GREELEY, COLORADO
FOR CONSTRUCTION, MAINTENANCE AND USE
OF PARKING LOT FACILITIES
THIS INTERGOVERNMENTAL AGREEMENT is made and entered this day of
ill((,"LC/( , 2006, by and between the CITY OF GREELEY, COLORADO
(hereinafter referred to as the"City")and the BOARD OF COUNTY COMMISSIONERS OF THE
COUNTY OF WELD, COLORADO (hereinafter referred to as "County") for the construction,
maintenance and use of a proposed parking lot facility located within the City of Greeley,Colorado.
WHEREAS, by and through a document entitled "INTERGOVERNMENTAL
AGREEMENT BETWEEN WELD COUNTY, COLORADO AND THE CITY OF GREELEY,
COLORADO FOR CONSTRUCTION, MAINTENANCE AND USE OF A PARKING LOT
FACILITY LOCATED WEST OF 11TH AVENUE, EAST OF ISLAND GROVE PARK AND
NORTH OF THE WALTON BUILDING" (hereinafter referred to as"the Original IGA")the City
and County memorialized their understandings and agreements with respect to construction,
maintenance and use of a parking lot on City property located north of the County's Walton Building
in the City of Greeley, Colorado; and
WHEREAS, the Greeley Urban Renewal Authority recently transferred to the County
ownership of the properties described in Paragraph 2 and located south of the Walton Building
(referred to herein as"the Stoll Lots"),where the County intends to place additional parking lots;and
WHEREAS,the City currently owns property located south and west of the Stoll Lots,which
the City and the County have identified as being best suited for parking lot use; and
WHEREAS, the parties hereto now desire to amend the Original IGA to include the City
owned properties located south and west of the Stoll Lots, under similar terms and conditions as
those set forth in the Original IGA.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES AND
COVENANTS CONTAINED HEREIN, THE PARTIES AGREE AS FOLLOWS:
1. Construction and Maintenance of Parking Lot Facility. The County shall
construct and maintain a parking lot facility on the properties described in Paragraph
2 and designated as"Weld County 1,2,3,and 24,"and"City of Greeley 4,5,22,23,
24, 25, and 26" on the map attached hereto as Attachment "A," which is
incorporated herein by this reference. The County shall construct and maintain all
parking lots in accordance with Sections Title 18, including Sections 18.42,
18.44.070, 18.38.020(1), 18.40.050, 18.40.110, 18.20.030, 18.16.030,and 18.16.040
of the City of Greeley Development Code Standards. The County intends to
construct and maintain a third building to house the Weld County Department of

Social Services,to be located immediately south of the Walton Building Annex,east
of the Walton Building where the existing Weld County employee parking lot is
located. Depending upon the current location of utilities and sewer easements, the
County may have to site the third building south of the Walton Building on the
properties designated as "Weld County 1, 2, 3 and 24" on Attachment A.
2. Property. The properties which will collectively form the parking lot are shown on
the Attachment A and are further identified as follows.
2a. The property subject to the leasehold as set forth in the Original IGA
(hereinafter referred to as the"North County Parking Lot Facility"), is legally described as
follows:
That part of Block 180,Town of Greeley and part of Lots 1 through 5,Block
33, Clayton Park Subdivision, together with vacated "C" Street and the
vacated North-South alley adjacent thereto; commonly described as lying
West of 11th Avenue, South of"D" Street, East of Field Five Island Grove,
and North of the Walton Building.
2.b. The Stoll Lot property, owned by the County(hereinafter referred to as the
"South County Parking Lot Facility"), is legally described as follows:
Lot 24 and the North 5 feet of Lot 25, Block 25, Clayton Park, City of
Greeley, County of Weld, State of Colorado;
and
Lot 3, Block 25, Clayton Park, City of Greeley, County of Weld, State of
Colorado;
and
Lot 2, Block 25, Clayton Park, City of Greeley, County of Weld, State of
Colorado;
and
Lot 1, Block 25, Clayton Park,City of Greeley,together with that portion of
B Street as vacated in Ordinance No. 7, recorded December 28, 1977, in
Book 818 at Reception No. 1739824, County of Weld, State of Colorado.

2c. The property subject to the leasehold as set forth in Paragraph 3,
below (hereinafter referred to as the "Leased Premises"), is legally described as
follows:
Lot 25,except for the North 5 feet,Block 25, Clayton Park,City of Greeley, County
of Weld, State of Colorado;
and
Lot 26,Block 25,Clayton Park,City of Greeley,County of Weld, State of Colorado;
and
Lot 23,Block 25,Clayton Park,City of Greeley,County of Weld, State of Colorado;
and
Lot 22,Block 25,Clayton Park,City of Greeley,County of Weld,State of Colorado;
and
Lot 4, Block 25, Clayton Park, City of Greeley, County of Weld, State of Colorado;
and
Lot 5, Block 25, Clayton Park, City of Greeley, County of Weld, State of Colorado;
and
A 25 foot wide strip West of the West edge of Lots 22 and 5, Block 25 and West of
the west edge of Lot 22, Block 33, Clayton Park, City of Greeley, County of Weld,
State of Colorado; extending from A Street to the North Parking Lot.
3. Lease of Premises. The City hereby leases to the County,for a period of twenty-one
(21)years,the Leased Premises for the construction and maintenance of a parking lot to be used by
County during the hours of 7:30 a.m. through 5:30 p.m., Monday through Friday, at no cost to the
County. The County shall construct and maintain the parking lot on the Leased Premises in
accordance with Title 18,including Sections 18.42, 18.44.070, 18.38.020(1), 18.40.050, 18.40.110,
18.20.030, 18.16.030,and 18.16.040 of the City of Greeley Development Code Standards,including
the installation and maintenance of appropriate landscaping,lighting and stormwater detention. Said
construction shall include curb,gutter and sidewalk along North side of"A"Street from the parking
lot access east to the corner of 11°' Avenue. The City shall construct all new curb, gutter and

sidewalk along 11th Avenue from "A" Street to "D" Street as part of the City's Northl 1th Avenue
improvement project. The parties agree that the City may, after consultation with the County,
terminate the lease in the event the County does not reasonably construct or maintain the parking lot
facility on the leased premises.
4. Construction of Access Driveway. The County shall construct,in accordance with
The County shall construct and maintain the parking lot on the Leased Premises in accordance with
Title 18, including Sections 18.42, 18.44.070, 18.38.020O), 18.40.050, 18.40.110, 18.20.030,
18.16.030,and 18.16.040 of the City of Greeley Development Code Standards,a 24 foot wide access
driveway. Said driveway shall include construction of drainage improvements to the North Lot,
including a water quality oil and sediment separator manhole such as a "Stormcepter" brand
separator. Said driveway shall be constructed so as to permit access to the parking lots owned by the
County or leased herein from"A" Street. Said access driveway shall extend from"A" Street to the
leasehold property granted by the Original IGA, but shall not connect to "D" Street. The access
driveway shall be constructed so as to allow access to the North County Parking Lot Facility the
Leased Premises and the South County Parking Lot Facility. The access driveway shall be
constructed with an asphalt curb on the western edge of the access driveway to reduce damage to the
City's property and fencing on the western side of the driveway. This driveway shall be located
west of the Walton Building and east of the existing baseball field fence line as shown on
Attachment A.
4.a. The County shall be responsible for the repair or replacement of any fencing
damaged by individuals using the County's access driveway during the leasehold hours of
7:30 a.m. through 5:30 p.m., Monday through Friday.
5. Removal of Basketball Courts. A portion of the Leased Premises is currently being
used as basketball courts. The County shall be responsible for the removal of these basketball courts
as part of their obligation to construct the parking lot. Any salvageable personal property from the
basketball courts(i.e. fencing,lights,hoops,rims,nets)shall be the property of the City and may be
removed from the property by the City at the City's option and at its cost prior to the County's
removal of the basketball courts. The County shall provide the City with not less than two weeks
notice prior to the commencement of the removal of the basketball courts.
6. Cooperation with North 11"' Avenue Improvements. The City will be making
improvements to the North 11°i Avenue corridor with which the County agrees to cooperate.
Specifically,the County will allow the City to remove the existing access from North 11 u,Avenue at
approximately"B"Street to the County's North Parking Lot property. Additionally,the County will
dedicate the City necessary rights of way for construction of the North 11th Avenue improvements.
As part of the North 11th Avenue improvements, the City will construct at its cost access to the
County's North Parking Lot property from 11°i Avenue at approximately"C" Street. This access
will provide full roadway access. The County agrees to construct the parking lot improvements
agreed to herein in advance of or in conjunction with the North 11th Avenue improvements, which
are anticipated to be constructed in the first half of 2007.

Agreement the date heretofore stated.

CITY OF GREELEY, COLORADO
RESOLUTION NO. 9 , 2006
A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT WITH WELD
COUNTY TO PROVIDE PARKING AT THE WALTON BUILDING.
WHEREAS, the City of Greeley and Weld County recognize the need for additional parking near
Island Grove Regional Park and the Walton Building located at C Street and 11th Avenue in Greeley; and
WHEREAS,on April 23, 1997 the City and County entered into an Intergovernmental Agreement
regarding the lease of property by the County from the City for parking at the Walton Building; and
WHEREAS,the County recently purchased land from the Greeley Urban Renewal Authority which
is adjacent to the property the County now wishes to lease from the City; and
WHEREAS, the County now wishes to lease additional property from the City for the purpose of
constructing a parking lot and to maintain the continuity of the properties;
WHEREAS, the County agrees to pave and maintain the parking lot facilities on all the leased
properties which will be available for Island Grove patrons after 5:30 p.m.on weekdays and on weekends;
and will additionally construct an access driveway which will be complimentary to the City's 11t Avenue
improvement project; and
WHEREAS, an Intergovernmental Agreement granting use of the proposed leased property by the
County has been drafted and said easement agreement is legally sufficient.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GREELEY, COLORADO AS FOLLOWS:
Section 1. The City Council authorizes the Mayor to sign the Intergovernmental Agreement
between the City of Greeley and Weld County to provide parking at the Walton Building.
Section 2. This resolution shall become effective immediately upon its passage,as provided by the
Greeley City Charter.
