We have attempted to resolve these issues as follows: 1. Fire District Boundaries Ron Gonzales of the Poudre Fire Authority agrees with the boundary changes and faxed his response to you on April 12, 2006. Mike Davis also agrees with this o information and after his weekly staff meeting on April 15, 2006, he will be making a formal response. 2. Mineral Rights The owner of the property is in the process of purchasing the mineral rights existing for this parcel. A copy of the offer and Mineral Deed is attached. 3. Open Space There will no longer be a need to accommodate drilling activities on this site since the owner is in the process of acquiring these rights. Structure Setbacks Within the entryway feature, we have proposed the addition of a subdivision identification sign, a pedestrian shelter to facilitate the transfer of school children and a neighborhood mail delivery unit. We will complete the following: A. Identification Sign We will move the subdivision identification sign within the entryway median to the south as needed to be outside of existing easements. B. Neighborhood Mail Delivery Unit and Pedestrian Shelter The locations of these improvements have been previously approved by the School District and Post Office. In order to facilitate the wishes of these referral agencies, we would like to maintain the current placement of these improvements. Therefore, by this letter, we are requesting a variance modification to allow us the , ability to place these structures within five(5)feet of proposed right-of-way lines. 1 C. Please note that we have changed the name of the subdivision from Mountain View Estates to Tranquility Estates as a result of name conflicts. We have also changed the name of the interior local roadway to Tranquility Lane. In response to item 1, A-F as located on page 3 of Staffs Land Use Application Summary Sheet, please review the following information: 1A. The deed restriction associated with this property is a setback from the Larimer County Canal because of concerns over groundwater along the Canal. This restriction is also placed on the property to the east owned by Charles Meserlian. Regardless, we have reconfigured the open space to eliminate the need for trails along the canal and along the west property line. (See attached revised Change of Zone plat.) ../1B. The open space areas were reconfigured to provide a large parcel at the southeast comer of the project. This change eliminates the need for a trail system, eliminates the need for access easements along lot lines and provides a larger, consolidated area. A 400' X 400' drill area has been provided in this larger area. Please note that newly approved Action 318A recently approved by the Oil and Gas Commission eliminated the need for drilling envelopes. / 1 C. We found discrepancies in maps prepared by both the Windsor-Severance Fire Protection District and the Poudre Fire Authority. Please see the attached letter and map which will provide clarification of the Fire District Boundaries in this area. Ms. Sheri Lockman Department of Planning Services March 20, 2006 Page Two 10. It was not the intent of the property owner to limit Home Occupations as defined by Section 23-1-90 of the Weld County Code. It is the intent of this application to create an Estate Zone and embrace all uses created by this zoning. No variances or special conditions are being requested. 1E. The property owner has indicated the desire to limit the large animal activity allowed on each individual lot. The owner/developer intends to limit large animal units to 0.5 animal units per acre. This regulation will be enforced through covenants prepared specifically for this development. In order to provide the quality product necessary for this area and maintain adequate ground cover and erosion control, our research has indicated that large animal limits should be implemented. ,, 1 F. The Change of Zone Plat has been amended to show the easements for the transmission lines running along the north edge of the property. Please note that the lots adjacent to this easement have been made larger to mitigate any impact from these lines. Attached are two paper copies of the Change of Zone Plat which reflects the items reviewed above. These plats were also completed to address items 2, A, items 1) through 5) and reflects the addition of note 3,A-Z. A portion of property owned by the Black Hollow Reservoir Company also pays taxes to the Poudre Fire Authority. If the roadways within this sub-division are not maintained or adopted by the county, individuals purchasing property in this sub-division should be notified that the Sheriffs Office will have limited traffic enforcement powers. 2. A plan should be developed to maintain roadways within the sub-division especially during inclement weather conditions for emergency vehicles. 3. The Sheriffs Office is very supportive of homeowner funded homeowner's associations. These associations provide a contact for the Sheriffs Office and a means of maintaining common areas. 4. If there are oil or gas production facilities within this sub-division,they need to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. 5. The names of all streets within the sub-division should be presented to the Sheriffs Office for approval. This will eliminate duplication of street names within the county. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. Planning Staff also recommends the following additional conditions of approval: 1. Prior to recording the Change of Zone plat: A. The plat shall be amended as follows: 6) Tranquility Lane shall be changed to Tranquility Way. 7) The proposed subdivision sign location shall be re-located outside of the easement. 2. The Change of Zone is conditional upon the following and that each shall be placed on the Change of Zone plat as notes prior to recording: AA.
