The submitted materials are in compliance with the application requirements of Section 27-7-30 of the Weld County Code. 2. The request is not in conformance with Section 27-7-40.C of the Weld County Code, as follows: A. Section 27-7-40.C.1--That the proposal is consistent with Chapters 19, 22,23,24 and 26 of the Weld County Code. Section 27-5-30.1 states: "A copy of an agreement with the owner of any ditch located on or adjacent to the site. OR The applicant shall provide written evidence that an adequate attempt has been made to mitigate the concerns of the ditch owners. The agreement shall stipulate that ditch activities have adequately been incorporated into the design of the site. If such agreement cannot be reached, the applicant shall present evidence that an adequate attempt to reach such agreement has been made. The applicant has submitted a copy of a Warranty Easement Deed dated March 1, 2004 that remains unsigned by a representative for the New Coal Ridge Ditch Company for the operation, maintenance, repair and replacement of the reservoir, pipeline and appurtenant facilities on and adjacent to that land, or any part thereof. PF-521, (Gloraloma Estates PUD) 2 The Warranty Easement Deed does not address the drainage easement issue as outlined in the department of Public Works referral dated April 5, 2006. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral agencies. Should the Board of County Commissioners approve the Planned Unit Development for 19 residential lots with Estate Zone uses,the following are recommendations for conditions of approval: 1. Prior to Recording the PUD Final Plat: A. The Board of County Commissioners shall review and approve the signed and dated Improvements Agreement According to Policy Regarding Collateral for Improvements (Public Road Maintenance) including the form of collateral. The security for the Agreement shall be tendered and accepted by the Board of County Commissioners. (Department of Public Works) B. The Restrictive Covenants for(Gloraloma Estates PUD) shall be approved by the Weld County Attorney's Office and be ready for recording in the Office of the Clerk and Recorder. The applicant shall submit to the Department of Planning Services the appropriate fee ($6 for the first page and $5 for all others) for recording the Restrictive Covenants in the Office of the Clerk and Recorder. Language shall be included in new Section 3.7.2 under the heading of Sanitary Sewer to include a statement specifically addressing the condition that this subdivision is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair replacement, or modification of the system. Septic systems shall be designed for site specific conditions including, but not limited to, shallow groundwater, bedrock, gravel and/or clay. At such time that the existing engineered septic system fails, each property owner shall be required to connect to the existing St Vrain Sanitary District System and pay the applicable fees for connection. The applicant shall submit written evidence to the Department of Planning Services indicating that all Weld County Department of Public Works concerns have been addressed. The applicant shall submit to the Department of Planning Services Certificates from the Secretary of State showing the Homeowners Association has been formed and registered with the state. (Department of Planning Services) E. The applicant shall submit to the Department of Planning Services a copy of a finalized Water Service Agreement between the applicant and Central Weld County Water District for service to the PUD. (Department of Planning Services) r PF-521,(Gloraloma Estates PUD) 3 F. The applicant shall submit to the Department of Planning Services written evidence that the appropriate postal district, fire protection district, sheriff, and ambulance service provider have reviewed the proposed addressing and interior street name. (Department of Planning Services) G. The applicant shall address the requirements of the Department of Planning Services landscape referral as stated in the referral received August 11, 2003. Evidence of such shall be provided to the Department of Planning Services. (Department of Planning Services) H. The applicant shall vacate that portion of USR-1120 (Gloraloma Ranch) that is located on the eastern portion of the property (east of Tract A and the Coal Ridge Ditch). The applicant shall address the requirements (conditions) of the Weld County Sheriffs Office as outlined in their referral received August 2, 2006. Written evidence of such shall be provided to the Department of Planning Services. (Weld County Sheriffs Office) J. The applicant shall submit to the Department of Planning Services a digital file of all drawings associated with the Final Plan application. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). (Department of Planning Services) K. The applicant shall address the requirements of the Longmont Soil Conservation District as stated in the referral received July 13, 2006, specific to the development of a weed management plan. Evidence of such shall be provided to the Department of Planning Services. (Longmont Soil Conservation District) L. The Pavement Thickness Design from Terracon Consulting engineers and scientists (Project No. 21995142)dated November 17, 1999 states the Aggregate Base Coarse Depth will be 4"thick based on the current foundation soil and subgrade. It appears that the Oil and Gas heavy vehicles will access the internal roadways of the subdivision. The applicant shall address the pavement design to support said vehicle loads. Further the applicant shall address the concern of pavement damage by the heavy oil and gas equipment. Written evidence of acceptance by the Department of Public Works shall be submitted to the Department of Planning Services. (Department of Public Works) M. The design of the thirty foot Oil/Gas and Irrigation easement in the Northwest corner of the development has turning radii which may be difficult for a larger Oil/Gas or drilling truck to maneuver through. The Department of Public Works requests written evidence on letterhead from each of these entities stating that the proposed geometries are sufficient to accommodate this equipment. Written evidence of acceptance by the Department of Public Works shall be submitted to the Department of Planning Services. (Department of Public Works) N. The applicants shall provide written evidence that an adequate attempt hs been made to mitigate the concerns of the New Coal Ridge Ditch Company or will provide written and recorded documents stipulating an existing Ditch Agreement. (Department of Planning Services) PF-521,(Gloraloma Estates PUD) 4 O. The Plat shall be amended to include the following: 1. The most recent version of Weld County's Right to Farm as listed in Section 22, Appendix 22-E of the Weld County Code. (Department of Planning Services) 2. County Road 19 is classified by the County as a collector road and requires a minimum 80-foot right-of-way. The applicant shall verify the existing right-of-way. The documents creating the right-of-way shall be noted on the Final plat. A 40- foot right-of-way shall be dedicated on the Final plat. The Final plat shall label the County Road 19 right-of-way as, "40-foot County Road Right-of-Way, to be dedicated on Final Plat" (Department of Public Works) 3. The applicant shall modify the road layout(C2, C3, C28, C29, C38, C40)to coincide with minimum"curb"/turn radii of 20-feet as per County Code 8-2-40 on the Final plat. (Department of Public Works) 4. Setback radius' from wellheads(150 feet) and setback radius' from tank batteries (200 feet) shall be indicated on the change of zone plat. (Department of Planning Services) 5. Lot 4, Block 1 is indicated as a detention pond on the Landscape and Layout Plans. Lot 4 shall be indicated as a non-buildable outlot on the Final plat. (Department of Planning Services) 6. The Utility Plan shall be amended to reflect the requirements of the Utility Board per the July 27, 2006 hearing. (Department of Planning Services) 7. The Utility Plan Approval signature box shall be replaced with a Utility Service Statement Block as required by Section 27-9-40.B of the Weld County Code. The Block shall be signed by the utility providers, Central Weld County Water District, Xcel Energy, United Power and Qwest. (Department of Planning Services) 8. The proposed development sign shall be located outside of all utility easements and shall meet the required ten (10) foot setback from future road rights-of-way. (Department of Planning Services) 9. The proposed pedestrian shelter shall be located outside of all utility easements and shall meet the required twenty (20) foot setback from future road rights-of- way. (Department of Planning Services) 2. The Final Plat is conditional upon the following and that each be placed on the Final Plat as notes prior to recording: A. The site specific development plan is for a PUD Final Plat for 19 lots with Estate Zone Uses with 36 acres of open space and equestrian uses to be located on Tract A as PF-521, (Gloraloma Estates PUD) 5 indicated in the application materials on file in the Department of Planning Services. Residential lots will adhere to the uses allowed in the E (Estate) Zone District. Tract A will adhere to the uses allowed in the A(Agricultural) Zone District. The PUD will be subject to and governed by the Conditions of Approval stated hereon and all applicable Weld County Regulations. (Department of Planning Services) B. Lot owners should be informed that an Equestrian facility is located directly west of this PUD. It is legally permitted through Use by Special Review Permit# 1120. (Department of Planning Services) C. Lot owners should be informed that an Oil and Gas Support Facility is located directly east of this PUD. It is permitted through 2nd AmUSR Permit#894. (Department of Planning Services) D. A Home Owner's Association shall be established prior to the sale of any lot. Membership in the Association is mandatory for each parcel owner. The Association is responsible for liability insurance, taxes and maintenance of open space, streets, private utilities and other facilities. Open space restrictions are permanent. (Department of Planning Services) F. Weld County's Right to Farm as delineated on this plat shall be recognized at all times. (Department of Planning Services) G. All signs within the PUD shall comply with the approved sign standards. All signs including entrance signs shall require building permits. Signs shall adhere to Section 23-4-80 and Section 23-4-110 of the Weld County Code. These requirements shall apply to all temporary and permanent signs. (Department of Planning Services) H. Lot 3, Block 1 and Lot 1, Block 3 shall be deemed non-buildable parcels for residential structures until a date uncertain where the existing oil and gas encumbrances (tank batteries and well heads and associated future equipment) on these parcels or adjacent parcels have been abandoned and removed. Lot 4, Block 1 is also deemed non-buildable due to the pond. (Department of Planning Services) Water service shall be provided by the Central Weld County Water District. (Department of Public Health & Environment) J. This subdivision is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair replacement, or modification of the system. Septic systems shall be designed for site specific conditions including, but not limited to, shallow groundwater, bedrock, gravel and/or clay. (Department of Public Health and Environment) K. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. (Department of Public Health and Environment) PF-521, (Gloraloma Estates PUD) 6 L. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. (Department of Public Health and Environment) M. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. (Department of Public Health and Environment) N. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. (Department of Public Health and Environment) O. Building permits shall be obtained prior to the construction of any building or structure. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section 29-3-20 B.13 do not need building permits, however a Certificate of Compliance must be filed with the Planning Department and an electrical permit is required for any electrical service to the building. P. A plan review is required for each building except for buildings that meet the definition of Ag Exempt buildings. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. Q. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Residential Code; 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. (Department of Building Inspection) R. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by Chapter 23 of the Weld County Code. (Department of Building Inspection) S. Each building will require an engineered foundation based on a site-specific geo-technical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. (Department of Building Inspection) T Building height shall be measured in accordance with the applicable Building Code(currently the 2003 International Building Code)for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine PF-521, (Gloraloma Estates PUD) 7 compliance with offset and setback requirements. Offset and setback requirements are measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior to the first site inspection. (Department of Building Inspection). U. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11) (Department of Planning Services) V. Effective August 1, 2005, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40) (Department of Planning Services) W. Installation of utilities shall comply with Section 24-9-10 of the Weld County Code. (Department of Planning Services) X. The property owner shall be responsible for compiling with the Performance Standards of Chapter 27, Article II and Article VIII, of the Weld County Code. (Department of Planning Services) Y. Weld County personnel shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations.(Department of Planning �-. Services) Z. The site shall maintain compliance at all times with the requirements of the Weld County Departments of Public Works, Public Health and the Environment,and Planning Services,and adopted Weld County Code and Policies and all applicable State and Federal regulations. No development activity shall commence on the property, nor shall any building permits be issued on the property until the final plan has been approved and recorded. (Department of Planning Services) AB. The site shall be developed in accordance with the recommendations contained in the geotechnical report. (Colorado Geological Survey) AC. Outdoor storage shall be screened from public rights of ways, and adjacent properties. (Department of Planning Services) AD. The site shall maintain compliance with the Platteville-Gilcrest Fire Protection District at all times. (Department of Planning Services) AE. Section 27-8-60 of the Weld County Code- Failure to Record a Planned Unit Development Final Plan - If a Final Plan plat has not been recorded within one (1) year of the date of the approval of the PUD Final Plan, or within a date specified by the Board of County PF-521,(Gloraloma Estates PUD) 8 Commissioners, the Board may require the landowner to appear before it and present evidence substantiating that the PUD Final Plan has not been abandoned and that the applicant possesses the willingness and ability to record the PUD Final Plan plat. The Board may extend the date for recording the plat. If the Board determines that conditions supporting the original approval of the PUD Final Plan cannot be met, the Board may, after a public hearing, revoke the PUD Final Plan; AF. Section 27-8-70 of the Weld County Code - Failure to Commence a Planned Unit Development Final Plan - If no construction has begun or no USE established in the PUD within one (1) year of the date of the approval of the PUD Final Plan, the Board of County Commissioners may require the landowner to appear before the it and present evidence substantiating that the PUD Final Plan has not been abandoned and that the applicant possesses the willingness and ability to continue the PUD. The Board may extend the date for initiation of the PUD construction and shall annually require the applicant to demonstrate that the PUD has not been abandoned. If the Board determines that conditions supporting the original approval of the PUD Final Plan have changed or that the landowner cannot implement the PUD Final Plan, the Board may, after a public hearing, revoke the PUD Final Plan and order the recorded PUD Plan vacated. AG. Section 27-8-80.A of the Weld County Code- Failure to Comply with the PUD Final Plan - The Board of County Commissioners may serve written notice upon such organization or upon the owners or residents of the PUD setting forth that the organization has failed to comply with the PUD Final Plan. Said notice shall include a demand that such deficiencies of maintenance be cured within thirty(30)days thereof. A hearing shall be held by the Board within fifteen(15) days of the issuance of such notice,setting forth the item, date and place of the hearing. The Board may modify the terms of the original notice as to deficiencies and may give an extension of time within which they shall be rectified. AH. Section 27-8-80.B of the Weld County Code-Any PUD Zone District approved in a Final Plan shall be considered as being in compliance with Chapter 24 of the Weld County Code and Section 30-28-101, et seq., CRS. Al. No development activity shall commence, nor shall any building permits be issued on the property until the final plan has been approved and recorded. (Department of Planning Services) 3. Upon completion of 1 and 2 above, the applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 27-9-20 and Section 27-9-30 [Landscape Plan] and section 27-9-40 [Utility Plans]of the Weld County Code.. The Mylar plat and additional requirements shall be submitted within thirty (30) days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. 4. Prior to the release of any building permits: .-- A. Dear Applicants: Your application and related materials for the request described above are being processed. I have scheduled a meeting with the Board of County Commissioners on August 30, 2006, at 10:00 a.m. This meeting will take place at the Centennial Building,First Floor Hearing Room,915 10'"Street,Greeley, Colorado. It is recommended that you and/or a representative be in attendance to answer any questions the Planning Commission members may have. It is the applicant's responsibility to comply with state statutes regarding notice to mineral estate owners. Colorado Revised Statute,C.R.S.24-65.5-103(adopted as part of H.B.01-1088)requires notification of all mineral estate owners 30 days prior to any public hearing. The applicant shall provide the Weld County Planning Department with written certification indicating the above requirements have been met. It is the policy of Weld County to refer an application to any town or municipality lying within three miles of the property or if the property is located within the comprehensive planning area of a town or municipality. Therefore,our office has forwarded a copy of the submitted materials to the Firestone and Frederick Planning Commission for their review and comments.
