Ed On,Property Owner Date Response to Department of Planning Services & Referral Agency Sketch Plan Comments New Cache Estates PUD The following statements are intended to address each of the specific County regulations, goals and policies as outlined in the July 18, 2005 letter from the Weld County Department of Planning Services, and to ensure this project is in compliance with the Weld County Comprehensive Plan. ADHEREANCE TO THE WELD COUNTY COMPREHENSIVE PLAN GOALS AND POLICIES PUD.Goal 5. — "Demonstrate that adequate facilities and public services are currently available or reasonable obtainable to serve the Planned Unit Development or zone district." As indicated in the April 27, 2005 letter from the Weld County Department of Planning Services, the proposal is being identified as urban scale development. This proposal does have an adequate water supply, which is evidenced by the North Weld County Water District water agreement, which has been reviewed by the County Attorney's office. According to the PUD performance standards identified in Section 27-2-176, all PUD's considered urban scale development shall be served by an approved sewer system, as defined by the Board of County Commissioners. The developer is requesting septic systems to be considered an approved sewer system for this subdivision. STREET/UTILITY/ACCESS STANDARDS PUD.Policy 5.3— "Creative and innovative approaches to internal road systems will be considered."The street design is a direct result of the configuration for all the house lots to locate adjacent to the lake feature that will be centrally located in the subdivision. In order to maintain a rural, estate lot feel to the subdivision, the developer is requesting a variance to the regulations requiring the installation of curb and gutter for urban scale developments. The developer will address the County Road Impact Fee Program and comply with the fee structure, per Ordinance 2002-11. In accordance with Weld County Public Works Department, the developer will construct the road with three inches of asphalt over six inches of base. A school bus turn-out is identified on the site plan. The developer will also provide a covered bus shelter in the turn-out, in accordance with Weld County School District RE-2 standards. Also, the developer will pay the required school impact fee prior to filing the final plat application. A designated road name will be identified on the Final Plan. Should a subdivision identification sign be installed, such signage will adhere to the Weld County PUD and Zoning Ordinance and the applicant will obtain the appropriate permits. OPEN SPACE/LANDSCAPING PUD.Policy 4.2—More than half of this subdivision consists of open space. Approximately 49%of the land area is open space, of which 11.24 acres of that area will be a lake feature. There will be no motorized vehicles or activities permitted on the lake. The lake is intended to be a passive open space feature for the residents as well as the wildlife. I— The detention facilities shall be located in outlots, which are maintained by the homeowner's association, and not the responsibility of individual lot owners. An HOA has been formed and will be registered with the State prior to final plat submittal. ENVIORNMENT CRITERIA Per the request of the Health Department,percolation data was submitted prior to the Change of Zone Application. In accordance with the Weld County Department of Public Health and Environment requirements,primary and secondary leachfield envelopes will be delineated on the plat and language restricting building on the leachfield envelopes will be included in the homeowner's association covenants. Since the applicant is submitting a specific development guide and to utilize the staff review option for final platting, the applicant has submitted a water service agreement to the County Attorney for approval. DESIGN STANDARDS/IMPROVEMENTS AGREEMENT/SUBDIVISION IMPROVEMENTS The bus pull-off and mailbox cluster boxes will be reviewed by both the school district and the post office for comments or suggestions. The applicant is requesting a variance to the curb &gutter standards for urban-scale subdivisions. SUMMARY The responses to the Sketch Plan comments are intended to address the concerns that Weld County staff and the referral agencies expressed. Minor changes to the design of the subdivision are delineated on the new drawings and all the reports should address the concerns that were identified. This PUD application is consistent with the goals and policies of the Weld County Comprehensive Plan as it proposes an urban scale development, which meets and exceeds the established requirements of the Weld County Subdivision, Zoning, and Planned Unit Development Ordinances. SPECIFIC DEVELOPMENT GUIDE New Cache Estates PUD The concept of this subdivision is to create a Planned Unit Development(PUD)consisting of nine Estate zoned lots and common open space. It is the intent of the applicant to create an urban scale subdivision that provides single-family estate residential lots around a lake, so all of the backyards would have lake frontage. New Cache Estates Planned Unit Development(PUD) is located'A mile west of WCR 37 and south of State Highway 392. The subject parcel contains approximately 65.313 acres, and is located south of the Cache La Poudre#2 Ditch. All nine lots would measure a minimum of 2.5 acres, and be compatible with the surrounding land uses, architectural style, character and zoning. It is the applicant's intent to establish a small lakefront neighborhood that will co-exist in harmony with the surrounding land uses. According to maps recognized by the Weld County Department of Planning Services, the site is located outside the Urban Growth Boundaries for the communities of Eaton and Greeley. Please refer to the attached vicinity map for property location. Agricultural activities have been occurring on and around the subject parceL The Right to Farm Covenant, as it appears in Chapter 22 of the Weld County Code will be placed on all recorded plats, by doing so,future residents of the subdivision will be aware of long-standing agricultural practices in the area. In accordance with Section 27-6-20.B., the following submittal entails a specjj lc development guide. Section 27-4-20.E Initial impact plan addressing all impacts this use will have on the proposed site and surrounding land uses. A listing of potential impacts is cited in Section 27-6-30 of this Chapter. (SPECIFIC DEVELOPMENT GUIDE) Section 27-6-40 Component One—environmental impacts 1. Noise and vibration 2. Smoke,dust and odors 3. Heat,light and glare 4. Visual/aesthetic impacts 5. Electrical interference 6 Water pollution Development of this proposal should not result in any adverse environmental impacts,including the above listed environmental concerns. Negative impacts from noise and vibration,smoke,odors,heat, glare,visual impacts,electrical interference and water pollution will not occur on the site. Since farming can be a more intensive use than residential, some of these factors will be significantly mitigated with the development of residential housing, such as smoke,dust and odors. Visual and aesthetic impacts will be enhanced by entrance landscaping treatments and landscaping within the subdivision. 7. Wastewater disposal All wastewater disposal within this development will utilize individual septic systems. The proposed lot sizes within the subdivision have been designed to meet the density requirements of the Weld County Code and the Weld County Health Department,therefore no negative impacts are foreseen on this site. The overall density will be on septic system per 2.5 acres. All septic systems shall be designed according to individual lot characteristics. In accordance with the Weld County Department of Public Health and Environment requirements,primary and secondary leachfield envelopes will be delineated on the plat and language restricting building on the leachfield envelopes will be included in the homeowner's association covenants. 8. Wetland removal No wetlands are located on this parcel;therefore,no wetland mitigation is necessary. 9. Erosion and sediments 10. Excavating,filling and grading 11. Drilling, ditching and dredging Any on-site grading, drilling,ditching or dredging will be done sympathetically. There are two drill windows located on this property. An oil&gas agreement has been included with this application. The construction of any lake feature will be in accordance with an erosion control plan,which will be submitted to public works and will be established according to the Phase II Storm water requirements. A preliminary on-site drainage plan has also been submitted. 12. Air pollution 13. Solid waste 14. Wildlife removal 15. Natural vegetation removal This proposal will not result in negative impacts to the above listed concerns. The residential uses should not create any adverse impacts to air pollution or contribute to solid waste concerns. The addition of a lake will be in accordance with state and county regulations as well as enhance additional wildlife to the area. 16. Radiation/radioactive material To the applicant's knowledge,there are no radioactive materials located on the subject parcel. 17. Drinking water source The public water system will be provided by Northern Weld County Water District. A water service agreement has been submitted to the County Attorney's office. 18. Traffic impacts MI residential lots will be served by an internal paved roadway, which will limit the number of access points onto Highway 392. There is an existing ditch access road to Hwy 392. Due to significant elevations differences with the ditch access road and the existing farm property the subdivision access will be located below the ditch, in coordination with CDOT. No additional road accesses will be created. Since the lake is internally located to the lots, all access roads are located along the perimeter of the subdivision. Two traffic circles are also being proposed within the subdivision to create unique subdivision identity features,as well as ensuring life safety needs are addressed. Any unforeseen traffic impacts resulting from the review of this proposal by the Weld County Public Works Department will be addressed in future application submittals. Please refer to the attached site plan. Section 27-6-50 Component Two—service provision impacts 1. Schools 2. Law enforcement 3. Fire protection 4. Ambulance Service providers for this PUD include Weld County School District RE-2, Weld County law enforcement, and the Eaton Fire Protection District. In cooperation with School District RE-2 a school bus turn-out will be created within the first traffic circle of the subdivision. Applicable school impact fees will be paid at the time of final plat submittal. The Eaton Fire Protection District has reviewed the conceptual plan with the applicant. Any comments will be provided through the referral process. S. Transportation (including circulation and roadways) 6. Traffic impact analysis by registered professional engineer The internal roadway in the PUD is designed to meet the requirements of Chapters 24 and 26 of the Weld County Code. Only one road access off Highway 392 is proposed. In accordance with Weld County street designs,the road will be constructed of asphalt and meet all emergency service loading requirements,as well as the Weld County Public Works standards and regulations. It is the developer's intent to construct a street design containing a 65' right-of-way, 50' roadway width with two traffic circles and the roadways encompassing the subdivision with cul-de-sacs at the terminus. The cul-de-sacs would also measure 65' rights-of-way with 50' roadway widths. There is only one farm access that is combined with the ditch access to the property. It is the property owner's intent not to create any additional access points other than what has been initially described. No off-street parking areas have been identified as the large lot sizes should provide adequate off-street parking needs for the residential properties. 7. Storm drainage Storm drainage will be handled on-site. A drainage report has been submitted to Public Works. 8. Utility provisions 9. Water provisions 10. Sewage disposal provisions Utility providers will have the standard easement dimensions of 20 feet on the sides and rear lot lines and a 15-foot perimeter easement. The drinking water source is through North Central Weld County Water District. All wastewater disposal within this development will be through the use of individual septic systems. Section 27-6-60 Component Three—landscaping elements 1. Landscape plan 2. Treatment, buffering or screening and perimeter treatment Subdivision landscaping is not proposed at this time. Entry signage will be placed at the entrance along Highway 392. Individual landscaping on each lot will be determined and maintained by the lot owner. A screening or buffering plan is not applicable to this project. 3. Maintenance schedule for landscaping elements 4. On-site improvements agreement S. Evidence of adequate water A Homeowner's Association will be created for the subdivision. It will be the responsibility of the HOA to maintain the lake feature. Limited lake activities will be incorporated into the HOA and covenants, for example,no motorized vehicles will be permitted. The subdivision covenants that will be created will be restrictive enough to guarantee a quality lake amenity is provided for the residents as well as the Ditch Company. All landscape materials will be maintained in a healthy state and all plant species selected should be drought tolerant and should require minimal water usage. Landscape species should also be selected to adapt to the soil conditions of the site. Section 27-6-70 Component Four—site design 1. Unique features The topography of the subject parcel allows for sweeping views of the Front Range Mountains even though the parcel is relatively flat with 1-3 percent land slopes. There are no other unique land features existing solely within the proposed PUD. 2. PUD rezoning consistent witk Chapter 22 of the Weld County Code In accordance with Section 22-2-60.C. "Provide mechanisms for the division of land which is agriculturally zoned." There are single-family dwellings within close proximity to the property and since the parcel is relatively small in comparison to the average farm size,the residential uses will be extremely compatible. Pinnacle Park and Sonny View Estates are located approximately a quarter of a mile to one mile from the subject parcel. However,this subdivision is relatively small in comparison to the existing subdivisions,and will therefore be extremely compatible with the existing land uses. 3. Compatibility within PUD zone district 4. Compatibility with surrounding land uses The applicant has carefully considered the uses on-site, adjacent properties and the existing agricultural use of the property. All recorded plats will include the Weld County Right to Farm Covenant. The bulk requirements of the Estate Zone District will be followed. The applicant proposes to adhere to the Estate Zone District unless otherwise listed or noted in the change of zone application and/or covenants. It is also important to realize this project will be served by public water. Therefore, the standard minimum lot size served by public water is one (1)acre. The mineral owners for this parcel have been notified. S. Overlay districts The site is not located within any overlay districts, including airport or flood. Section 27-6.80 Component Five—common open space usage 1-6 Open Space Regulations This proposal is consistent with Weld County's open space regulations. 7- 15% Common Open Space Minimum This project has been identified as urban scale and therefore shall comply with the required open space standards. The subdivision layout proposes 49%open space, or 32.234 acres. The lake feature would consist of 11.24 acres and the surrounding open space area measures approximately 20.994 acres. The open space will serve as distance buffers as well as passive recreational uses. Ownership of Common Open Space Construction of Open Space On-site Improvements Agreement The common usable open space will be owned and maintained by the homeowner's association. The property owner and the#2 Ditch Company have negotiated a mutually exclusive agreement regarding the storage of ditch water on the subject parcel to create the lake, a copy of which has been submitted with the Change of Zone application. As a result,the current ditch lateral that bisects the property in a southeasterly fashion will be relocated to the western property boundary. Section 27-6-90 Component Six—signore All signage within this PUD will comply with the sign standards set forth in Section 27-6-90 and Division 6,Article II, Chapter 19 of the Weld County Code. A monument sign will be designed for the subdivision entrance located on the south side of Highway 392. Section 27-6-100 Component Seven—MUD impact This component is not applicable to the subject parcel since this proposal is not located within the Mixed Use Development Boundary as identified by Weld County. Section 27-6-110 Component Eight—intergovernmental agreement impacts This component is not applicable to the subject parcel since Weld County and the City of Greeley have not entered into an intergovernmental agreement regarding urban growth boundaries. However,the site is located within what the City of Greeley identifies as their Long Range Expected Growth Area(LREGA), which is expected to build out by the year 2020. This property is located outside of Greeley's Mid-Range Expected Service Area. The City of Greeley does not allow a property to develop if it is not located within the Mid-Range Expected Service Area. r New Cache Estates Response to Referrals 1. Public Works. We are meeting with Jesse Hein at Public works on 03/02/06 to take care of any issues or concerns. 2. Dept. of Public Health& Environment. Septic Envelopes have been added to the plan. 3. Water Requirements. Required water will either be obtained by upgrading existing water lines or by obtaining a well permit to convert existing irrigation well to dedicate to fire hydrants. 4. Noble Energy. We are negotiating with Noble Energy to obtain a surface agreement. Attached is a copy of the last correspondence with Noble. At this time we are leaving existing drill windows on the plat. The drill window in the middle of the subdivision has been drilled and was plugged and abandoned in 1997. 5. Ditch Agreement is in the works. Letter of intent should be available by tomorrow. There is a pond planned for center of the New Cache Estates Site. The function of this pond is two fold. The pond will primarily be used to augment the ground water within the area as well as provide Stormwater retention. The pond will retain the 100-yr runoff plus fifty percent. The pond will remain wet through out the year therefore the design will incorporate features that will alleviate the breading of mosquitos. The pond will have an aeration system to circulate water since there will be no release. The pond will also have 3 to 1 side slopes which inhibit the survival of mosquito larva. The offsite drainage coming onto the site from the northwest corner will be conveyed to the onsite retention pond via a culvert underneath Cache Circle which will discharge into a swale leading to the retention pond. Recitals WHEREAS, The New Cache La Poudre Irrigating Company owns and operates a canal system known as the Greeley No.2 Ditch in Weld County ("Company Canal"); and WHEREAS, the New Cache La Poudre Irrigating Company has made application in Case No. 2004CW025 District Court, Water Division No. 1 of the State of Colorado for approval of a plan for augmentation ("Augmentation Plan"); and WHEREAS, the Company is to be assigned this rights and obligations of owning and operating the Augmentation Plan; and WHEREAS,the Landowner owns lands lying under the Company Canal described in Exhibit B (the "Property") and depicted on the map in Exhibit A, both of which are attached hereto and referenced herein; and WHEREAS,on the Property is a site which is appropriate for the construction of a recharge pond or ponds and related facilities to generate augmentation credits that accrue to the lower reaches of the Cache La Poudre River suitable for use in the Augmentation Plan, which site and the proposed facilities are depicted on the map attached and incorporated as Exhibit A.and are referred to as the"Recharge Project;" and WHEREAS,the Landowner wishes to construct the Recharge Project and the Company wishes to supply water to the Recharge Project for the purpose of obtaining recharge credits for use in Augmentation Plan, and to do so pursuant to terms and conditions described in this Agreement for the mutual benefit of Company and Landowner. Agreement NOW, THEREFORE, in consideration of the mutual promises and other consideration described below,the sufficiency of which is hereby acknowledged,Company and Landowner agree as follows: 1. Under the terms and conditions of this Agreement,the Company agrees that to the extent it has the legal right to deliver water through the Company Canal, it shall deliver water for use in the Recharge Project to a new headgate and weir to be installed in the Company Canal, which headgate is to be located on the south bank of the Company Canal(Headgate No.56)in the Northeast IA,Section 24.Township 6 North,Range 66 West, 6j' P.M. (the "Augmentation Headgate"). Landowner agrees that after delivery of said water, Landowner shall place the water into the recharge pond constructed as part of the Recharge Project and shall not thereafter divert or use the water for any purpose. 3. Water Right Ownership. The Company shall own the entire water right used to supply water to the Recharge Project as contemplated in this Agreement. Landowner shall have the right to receive a portion of the augmentation credits allocated to him pursuant to the terms of this Agreement,but shall have no other legal interest in the water or water right that will be used to supply water to the Recharge Project. 4. Water Right Appropriation and Adiudicatioq.The Company shall have the right to run water to which it is entitled from any source to the Recharge Project The Company and/or the New Cache La Poudre Irrigating Company intends to appropriate and adjudicate one or more water rights or conditional water rights to be used to deliver water to the Recharge Project in Case No. 2004CW025,and it or they are the sole applicant(s) in the Water Court case filed to adjudicate said rights and Landowner has no interest in said water right(s). 5. Allocation of Augmentation Credits. All augmentation credits resulting from water delivered by the Company to Landowner for use in the Recharge Project will be allocated between Company and the Landowner as follows: a. AU augmentation credits attributable to ditch loss in the Company Canal belong solely to Company. b. All net augmentation credits generated after water has been diverted from the Company Canal into the Augmentation Headgate will be allocated 50% to Company and 50% to Landowner. The determination of the amount of augmentation credits to which the parties shall be entitled and be split 50/50 shall be based upon the methodology decreed for making such determinations in Case No.2004CW025,or any substitute water supply approved by the State Engineer based upon the application in said case, or failing this, by determined of the Division Engineer for Water Division No. 1. 6. Recharge Project Development Costs. Except as described below, the cost of developing and constructing the recharge ponds and all facilities necessary for the operation of the Recharge Project shall be borne by the Landowner. Landowner agrees to develop and construct the Recharge Project to the specifications of the State Engineer and the Company. Further,Landowner shall be responsible for maintaining the Recharge Project(and the costs associated therewith),including dirt work,dikes,dams,pipelines,ditches,recharge pond(s) 2 .� 11,vu<voo 12.1:14 n,o371 t URN LAND PAGE 04 and all associated structures. The Landowner shall be responsible for constructing and maintaining all facilities beyond the weir at the Augmentation Headgate except those appurtenances necessary for measuring water. In the event Landowner fails to maintain said facilities, the Company shall have the right, but not the obligation, to dredge, maintain, repair and rebuild all facilities associated with the Recharge Project .42, , th event the Company elects to do so,it shall do so at the sole cost and expense of r: • _ - Further, in the event that the Company deems it necessary to maintain the Recharge Project,or any portion thereof,Landowner hereby agrees that the Company shall have an easement to come and go on the Property for the purpose of maintaining the Recharge Project. 7. Company Maintenance. The Company shall be responsible for the construction and maintenance of a"de-silting" facility to be located at or near the Augmentation Headgate. Landowner hereby grants to the Company an easement for the de-silting facility to allow the Company to come and go on the Property for the purpose of constructing and maintaining the de-silting facility. Further, all headgates,weirs,measuring devices and appurtenances necessary for measuring water shall be paid by Company. The Company shall be responsible for the construction and maintenance of all appurtenances necessary for measuring water and all facilities "upstream" of the weir and shall be responsible for maintenance and removal of silt from within the de-silting facility. 8. Control of Water Diversions and Ditch Operations. The New Cache La Poudre Irrigating Company and/or the Company shall retain exclusive control over when or whether diversions of water are made from the river and/or when and where water is delivered from the Company Canal into the Augmentation Headgate, and Landowner understands and agrees that neither the New Cache La Poudre Irrigating Company nor the Company has an obligation to deliver water to the Augmentation Headgate for delivery to the Recharge Project. The New Cache La Poudre Irrigating Company and/or the Company shall retain control over the operation of the Company Canal and all other ditch operations, which control shall include the right to use the Recharge Project facilities for emergency dumps of water running within the Company Canal whenever the New Cache La Poudre Irrigating Company or the Company deem the Recharge Project to be needed for that purpose. 9. Storatte by landowner. Landowner is developing a 9 lot subdivision near the Recharge Project. These lots are depicted on the map attached and incorporated as Exhibit A. Landowner shall be entitled to use the Recharge Project to store up to fifty (50)acre feet of water in the recharge ponds)at any one time within for non-potable irrigation purposes and to prevent the recharge ponds) from becoming void of water subject to the following restrictions: a. Water for purposes other than recharge,including but not limited to non-potable irrigation, shall be furnished by Landowner. b. In the event Landowner receives a bona fide offer which Landowner desires to accept, to rent or purchase the augmentation credits which are the property of Landowner as stated in paragraph 5 above, then Landowner shall give Company written notice of such bona fide offer. If the offer is for lease, Company shall have a period of seven(7)days from written notice to elect to rent the augmentation credits from Landowner under the same terms and conditions of the bona fide offer. If the offer is for purchase. Company shall have a period of thirty(30)days from written notice to elect to purchase the augmentation credits from Landowner under the same terms and conditions of the bona fide offer. In the event the Company does not elect to exercise this right within the allotted time, then this right shall expire and Landowner shall be free to transfer or lease the augmentation credits as the case may be to a third party. 11.The Parties Representations and Warranties. The parties make the following representations and warranties: a. The parties have full power and authority to enter into this Agreement. b. Compliance with the terms of this Agreement by the parties will not violate any provision of federal, state, or local law. c. The parties will use reasonable efforts to maximize the augmentation credits created by the Recharge Project and will endeavor to prevent the facility from becoming void of water and dry provided the terms of this Agreement are complied with, and in particular,the Recharge Project is properly maintained. d. If a notice of default is provided,the party accused of the default shall either cure it or provide a written statement explaining why it is not in default. If the alleged default is not cured or otherwise resolved within 30 days, the parties may resort to their remedies. In addition to any other legal remedy Company may have, if Landowner is in default under this Agreement and has not cured that default as provided in this paragraph, Company may refuse to deliver water under this Agreement until such default is cured. 0 13.Notices. If a well pump is necessary to meet the flow requirements, specifications will need to be submitted for review and approval by the Eaton Fire Protection District Fire Prevention Bureau. This well will be strictly for use by the fire department. We also discussed the use of a pull-off for both the school district use and for fire department access to the fire hydrant. The Eaton Fire Protection District has no conflicts with this as long as: 1. Hydrant can be readily accessible in case of emergency. 2. "No Parking" signs are posted near and around pull-off If possible, the well and well pump can be connected to a hydrant if water flows can still be met at discharge. Proposed Project Location The New Cache Estates PUD site is a proposed residential subdivision that is located within Weld County. The project site is located in the West V2 of the Northeast V4 of Section 24, Township 6 North, Range 66 West, of the 6th Principal Meridian, in the County of Weld, Colorado. The proposed development borders the southern right-of-way of Colorado State Highway 392 and agricultural land to the east, west, and south. B. Site Description The site consists of 65.3 acres and is currently zoned for agricultural use. The proposed New Cache Estates site will consist of 9 estate-sized lots, with a change of zone to PUD. There will be a central outlot, which the estate lots will surround, that will be used as a non-potable irrigation pond and detention pond. C. Existing Drainage/Irrigation Facilities The existing drainage for this site currently sheet flows generally from the north to the south with an average slope of approximately 0.7%. The site is split by two existing irrigation ditches which cause the existing runoff to leave the site in the southeast corner and along the south portion of the property. The New Cache La Poudre Lateral #2 borders the site along the northwest potion of the project. The site also has the Graham Seep ditch and the Van Goram irrigation ditch traversing the site generally from north to south. Both of these existing ditches will be relocated across the property to maintain existing irrigation flows and to accommodate the lot configuration for the proposed project. IL SCOPE OF WORK The intent of this report is to identify preliminary drainage patterns and calculations for the drainage design of the proposed New Cache Estates P . III. EXISTING (HISTORIC) DRAINAGE SYSTEM A. Historic Site Drainage Historically, the development was composed of three minor drainage basins, under agricultural land use. These basins were separated by the Graham Seep ditch and the Van Goram irrigation ditch traversing the site. B. Off-site Runoff Virtually no off-site runoff enters the New Cache Estates PUD site. The runoff from adjacent properties generally flows from north to south, where the runoff leaves the properties. There are three off-site basins on the New Cache Estates PUD site. A description for each basin is provided later in this report. The off-site basins contribute minimal runoff to the adjacent properties and follow historic runoff patterns. IV. PROPOSED DEVELOPMENT A. Criteria The New Cache Estates PUD site and its sub-basins studied were less than 160 • acres, thus the Rational Method was used to determine initial (5-yr) and major (100-yr) runoff volumes. The Modified Rational Method is a widely accepted predictor of flows from basins less than 160 acres in size. The rainfall intensity and runoff coefficients were determined from Figure 3-1 of the City of Greeley Storm • Drainage Design Manual and Tables RO-3 and RO-5 of the revised version of Vol.1 of the June 2001 USDCM. Preliminary detention pond sizing was analyzed using the FAA Method. An overall C factor of 0.31 was used, along with a 5-year historic release of 17.0 cfs to arrive at the required 100-year detention volume. Developed Runoff Development of the New Cache Estates PUD will increase runoff volumes and peak flowrates to this site's historic outfall point in the southeast corner of the site. Consequently, detention will be necessary to mitigate developed flowrates to the 5- year and 100-year historic rate. An irrigation pond/detention pond (Pond A) in combination with another detention pond in the southeast corner of the project (Pond B) will attenuate the site's runoff to the 5-year historic rate. Drainage swales, streets, and storm sewer will be used to convey concentrated runoff across the site to the proposed detention facilities. Basin Descriptions: Basin A (7.48 ac) • Basin A is in the northern portion of the proposed site as well as in the western portion of the property. This basin consists of open space and a portion of Cache r-- Circle. This basin generally flows from north to south to Design Point I. The flow is collected at Design Point I and conveyed to Basin B and eventually to the detention pond. Basin B (6.35 ac) Basin B is in the northern portion of the site as well as in the western portion of the property. This basin consists of a portion of Cache Circle as well as a portion of the lots. This basin generally flows from north to south to Design Point 2. The flow is collected at Design Point 2, where it is combined with flow from Basin A, and then conveyed to the detention pond via a grass-lined Swale. Basin C (4.61 ac) Basin C is in the eastern portion of the property and consists of a portion of Cache Circle as well as a portion of the lots. This basin generally flows from north to south to Design Point 3. The flow is collected at Design Point 3, where it is combined with flow from Basin D, and then conveyed to the detention pond via a grass-lined swale. This basin consists of open space and a portion of Cache Circle. This basin generally flows from north to south to Design Point 4. The flow is collected at Design Point 4 and conveyed to Basin C and eventually to the detention pond. • Basin E (29.77 ac) Basin E in the center of the proposed site and contains a portion of the lots as well as the entire irrigation pond/detention pond. Runoff from this basin generally flows from the perimeter towards the pond, which is in the middle of the basin. Basin OS-1 (7.14 ac) Basin OS-1 is in the northeastern corner of the site and contains open space. Runoff from this basin will generally follow the historic drainage pattern and will exit the site, via sheet flow, along the northeastern boundary of the project. Basin OS-2 (2.99 ac) Basin OS-2 is along the western property boundary as well as along the southern portion of the project. This basin contains open space and will generally sheet flow from north to south. The runoff from this basin will exit the site according to the historic drainage pattern. Basin OS-3 (2.25 ac) Basin OS-3 is along the eastern property boundary as well as along the southern portion of the project. This basin contains open space and Detention Pond B. Flow from this basin will generally drain from the north to the south. Runoff will leave this basin according to the historic drainage pattern. C. Pond A Design The irrigation pond/detention pond (Pond A) lies in the center of the site. This pond functions primarily as a non-potable irrigation pond with a maximum operating elevation. Additional volume above the normal operating elevation of the pond will .-. be used to attenuate developed flows. The 5 year historic release will flow into a shallow secondary detention pond B. V. STORMWATER QUALITY & EROSION CONTROL The overlot grading of the New Cache Estates PUD site will occur during the first phase of construction. All erosion control and stormwater quality measures will be incorporated into this initial phase of construction. Structural erosion control measures will consist of silt fencing and straw bales located in design channels. All drainage improvements shall be thoroughly cleaned and inspected once construction is completed. Any disturbed areas left exposed for more than thirty days will receive native (drilled) seeding and straw mulch at 2 tons per acre, until permanent landscaping has been provided. Vehicle tracking control will be used at construction entrances until paving operations are completed. VI. CONCLUSION A. Drainage Concept Detention will be necessary for this site to attenuate developed flowrates to the 5- year historic rate in order to mitigate downstream effects of the proposed development. The irrigation pond/detention pond (Pond A) will detain the majority • of the runoff from this site. The pond will release to Detention Pond B and then be released off-site. The preliminary storage volume for the irrigation pond/detention pond (Pond A) is 2.27 acre-feet. The size of this pond will be refined during the final design process. B. Compliance with Standards The proposed New Cache Estates PUD site does not lie within any known FIRM floodplain, and therefore it is not subject to any FEMA flood hazard regulations. This report complies with the Urban Storm Drainage Criteria Manual as well as the Weld County Development Code. The Permittee shall refer to all additional standard requirements included with this permit and any enclosed additional teens,conditions,exhibits,and noted attachments. 3. This permit is issued in accordance with the State Highway Armes Code(2 CCR 601-1),and is based upon the information submitted by the Permittee. This permit is only for the use and purpose stated in the Application and Permit. Any changes in traffic volumes or type,drainage,or other operation aspects may render this permit void,requiring a new permit to the be applied for based upon exisiting and anticipated future conditions. 5. Access construction methods and materials shall conform to the Colorado Department of Transportation Standard Specifications for Road and Bridge Construction(current edition). 6. If necessary,minor changes,corrections and/or additions to this permit may be ordered by the Department inspector,other Department representative or local authority to meet unanticipated site conditions. Changes may not be in violation of the State Highway Arens Code. All major changes to the plans must be approved in writing by the Department prior to commencement of any work on or within the State Highway right-of-way. 7. This permit is subject to revocation due to: 1)Noncompliance with the provisions of this permit; 2) Abandonment;3)Supersedure by new permit covering the same installation;or 4)Conflict with necessary planned highway construction and/or improvements. The Permittee shall promptly terminate occupancy upon notice of cancellation of the permit from the Department,unless a new permit is applied for and granted. 8. Reconstruction and improvements to the access may be required when the Permittee has failed to meet the required design and/or material specifications. If any construction element fails within two years due to improper construction or material specifications,the Pennittee is responsible for all such reparis. 9. The Department retains the right to perform any necessary maintenance work in this area. 10. Backing maneuvers within and into the State Highway right-of-way are strictly prohibited. All vehicles shall enter and exit the highway right-of-way in forward movement. Backing into the right-of-way shall be considered a violation of the terms and conditions of this access permit and may result in revocation of the permit by the Department and/or the issuing authority. II. The Pennittee is responsible for obtaining any necessary additional federal,state,and/or City/County permits or clearances required for construction of the access. Approval of this access permit does not constitute verification of this action by the Permittee. 12. All costs associated with the installation of this access are the responsibility of the Pennittee. This includes design,construction,signing and striping,utility relocation,testing of materials,and inspections. 13. No work will be allowed at night,or on Saturdays, Sundays,and legal holidays without prior authorization from the Department. The Department may also restrict work within the State Highway right-of-way during State Highway Access Permit Page 2 A"•chment to Permit No. 405103-Additional Terms and Conditions adverse weather conditions. 14. Traffic detours or lane closures will not be allowed,unless pre-approved by the Department. 15. Two-way traffic shall be maintained throughout the work area at all times unless specific written authorization is obtained from the Departmnent. 16. No construction vehicles shall be parked,or construction materials/equipment stored,on the State Highway right-of-way overnight. 17. No work shall be performed near a Department electronic traffic control device without coordination with Coble Garbiso at(970)350-2137. 18. Landscaping and site construction shall not obstruct sight distance at any State Highway access point. Landscaping within the State Highway right-of-way requies the Pennittee to obtain a CDOT Landscaping Permit from the Maintenance Section. The access permit does not authorize that activity,although a proposed landscaping plan shall be included in the access permitting document. Irrigation of features within the right-of-way may require the Permittee to install a subsurface drain in accordance with CDOT Standard M-605-1 or other approved system. The Permittee shall contact Linda McWilliams at the Greeley Traffic Office,(970)350-2147,to obtain the Landscaping Permit. 19. Routine,periodic maintenance and emergency repairs may be performed within the State Highway right-of-way,under the general terms and conditions of the permit. Any significant repairs such as culvert replacement,resurfacing,or changes in design or specifications,will require written authorization from the Department. The Department shall be given proper advance notice whenever maintenance work will affect the movement or safety of traffic on the State Highway. In an emergency,the Department Region Office and the State Patrol shall immediately be notified of possible hazards. 20. All work is to conform to the plans referenced by this permit on file with the Department or as modified by this permit. (If discrepancies arise,this permit shall take precedence over the plans.) The Department plan review is only for the general conformance with the Department's design and code requirements. The Department is not responsible for the accuracy and adequacy of the design,dimensions,elevations,and any other elements which shall be confirmed and correlated at the work site. The Department through the approval of this document,assumes no responsibility for the completeness and/or accuracy of the plans. 21. Survey markers or monuments must be preserved in their original positions. Notify the Department at(970) 350-2173 immediately upon damage to or discovery of any such markers or monuments at the work site. Any survey markers or monuments disturbed during the permitted work shall be repaired and/or replaced immediately at the expense of the Permittee. 22. Should any excavation encounter plant or animal fossils,the remains of historic or prehistoric structures, artifacts,(pottery,stone tools,arrowheads,etc.),the work shall be stopped and the Permittee shall notify the Department inspector. 23. The Permittee or the contractor shall notify Linda McWilliams at(970)350-2147 or(970)301-1127 at least two working days prior to beginning any access improvements or construction of any kind within the State Highway right-of-way. Failure to comply with this requirement may result in revocation of this permit. 14. If highway right-of-way fence exists or is proposed,the Permittee must contact Linda McWilliams at the Greeley Traffic Office,(970)350-2147,prior to removal or installation. 25. Construction traffic control devices,when not in use, shall be removed or turned away from traffic. 27. The access shall be constructed perpendicular to the travel lanes of the State Highway for a minimum distance of 40 feet,and shall slope down and away from the adjacent pavement edge at a rate of 2%grade for a minimum of 20 fret. 28. The access shall be completed in an expeditious and safe manner and shall be finished within 45 days from initiation of construction within State Highway right-of-way. 29. All required arms improvements shall be installed prior to the herein authorized use of this access. 30. The access shall be surfaced immediately upon completion of earthwork construction and prior to use. 31. Surfacing of the arms shall be completed as per Exhibit"A". 32. No paved surface shall be cut unless specified in this permit. Asphalt removal shall be saw cut to assure a straight edge for patching. 33. If frost,water or moisture is present in the subgrade,no surfacing materials shall be placed until all frost, water or moisture is gone or removed. 34. The access shall be constructed and maintained in a manner that will not cause water to enter onto the roadway,and will not interfere with the existing drainage system within the State Highway right-of-way. Drainage to the State Highway right-of-way shall not exceed historical rate of flow. r35. All existing drainage structures shall be extended,modified,or upgraded as necessary,to accommodate all new construction and safety standards,in accordance to the Department's standard specifications. 36. The Permittee shall request final inspection by Linda McWilliams at(970)350-2143,within 10 days following completion of access construction,and prior to authorized use. The Permittee or their representative shall be present. 37. A fully executed complete copy of this permit must be on the job site with the contractor at all times during construction. Failure to comply with this or any other construction requirement may result in the immediate suspension of work by order of the Department inspector or the issuing authority. 38. The design and construction of access and/or development of this property shall not negatively impact adjacent nearby properties. Correction of the problem and cost resulting from damages shall be borne by the Permittee. If required, such footwear shall meet the requirements of ANSI Z41-1999. Where any of the above-referenced ANSI standards have been revised, the most recent version of the standard shall apply. 3- The Perm&tee is responsible for complying with the Revised Guidelines that have been adopted by the Access Board under the American Disabilities Act(ADA).
