WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home

o s Rule Charter, is vested with the authority of administering the

W WHEREAS , a public hearing was held on the 31st day of October,
1984, at 2: 00 o' clock p.m. for the purpose of hearing the application
of Coval (Bud) Wilkinson, 24717 Weld County Road 47 , LaSalle,
Colorado 80645 , requesting a Change of Zone from C-1 (Commercial-
" '' One) to C-3 (Commercial-Three) for a parcel of land located on
the following described real estate, to-wit:

WHEREAS , Section 21. 6. 2 of the Weld County Zoning Ordinance
o m provides standards for review of such a Change of Zone, and
a WHEREAS , the Board of County Commissioners heard all the
o w testimony and statements of those present, has studied the request
o z of the applicant and the recommendations of the Weld County Planning
N Z Commission, and having been fully informed, finds that this request
shall be approved for the following reasons :

w 1. The applicant has complied with the application require-
ments listed in Section 21. 7 et seq. , of the Weld County
o Zoning Ordinance.

• w2 . The request is in conformance with Section 21. 6 of the ,
Weld County Zoning Ordinance as follows :
a. It has been shown by the applicant that changing
conditions in the area warrant a Change of Zone.
The current zoning Commercial-One (C-1) is intended
to establish and preserve areas which provide con-
venience goods and services primarily for residents of
a specific neighborhood. Uses allowed include stores
and shops which furnish personal services and mer-
chandise primarily intended for personal family or
household purposes by the residents of the area in
which the use is located. The subject site is not
in a residential neighborhood. Surrounding land
uses include a developed industrial park to the south,
commercial land uses to the west and northwest and
vacant Commercial-One zoned land to the east. A
four (4) lot residential subdivision exists in the
immediate area north of the proposed Change of Zone area.

b. The C-3 Zone District which is intended to establish
and preserve areas for activities that provide goods
or services for the benefit of the general public or
that require large amounts of space or high traffic
volumes for generating business is an appropriate
zone for this area.
c. The uses which would be allowed on the subject property
by granting the Change of Zone will be compatible
with the surrounding area. Surrounding land uses
include an auto and truck repair shop to the west,
a vehicle dealership (Wadsworth RV Center) to the
northwest, Garnsey and Wheeler Truck Shop, Herdman
Electric Warehouse, and Sharp Brothers Seed Company
to the south in the Industrial Park, and Commercial-
One zoned agricultural land to the east.
d. The City of Greeley Planning Commission recommended
no objections to this proposal.
e. The subject site is served by a septic system.
f. The subject site is served by a well water system.
g. A private road will provide adequate access to the site.
h. The proposed Change of Zone is located in a Flood
Hazard Overlay District. The applicant has received
approval of a Flood Hazard Overlay District Development
Permit from the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado, that the application of Coval
(Bud) Wilkinson for a Change of Zone from C-1 (Commercial-One) to
C-3 (Commercial-Three) on the above referenced parcels of land be, and
hereby is, granted.

A public hearing was conducted on October 31 , 1984, at 2:00 P.M. , with

The following business was transacted:
I hereby certify that pursuant to a notice dated September 24, 1984, and duly
published in the La Salle Leader on September 27 and October 18, 1984, a public
hearing was conducted to hear the application of Coval (Bud) Wilkinson for a
Change of Zone from C-1 (Commercial-one) to C-3 (Commercial-three) . Chairman
N. Carlson informed the applicant that only three Commissioners were present and
that he could continue this hearing to a date when all five Commissioners could
be present. The applicant chose to have this request heard today. Lee D.
Morrison, Assistant County Attorney, read this application into the record.
Rod Allison, Planning Department representative, made the favorable Planning
Commission recommendation of record. Coval Wilkinson was present to answer any
questions. Cumnissioner Brantner moved to approve the application for a Change
of Zone for Coval Wilkinson. Commissioner Martin seconded the motion and it
carried unanimously.

APPEARANCE:
Coval (Bud) Wilkinson, property owner and applicant, stated this request
is for a change of zone. He felt Commercial—Three zoning is actually
more appropriate for this area than Commercial—One as it is now zoned.
They wish to erect an overnight parking garage for trucks that are used
on oil well sites on this property.
The Chairman asked Mr. Wilkinson if he had reviewed the recommendations
and conditions as outlined by the Department of Planning Services staff.
He stated he has and has no objections to anything stated.
The Chairman asked that reading of the recommendations and comments of
the Department of Planning Services staff be dispensed with and that
they be filed with the summary as a permanent record of these proceedings.
The Chairman called for discussion from the audience. There was none.
MOTION:
Jack Holman moved Case Number Z-410:84:45 for Coval (Bud) Wilkinson for
a change of zone from commercial-one to commercial-three be forwarded
to the Board of County Commissioners with the Planning Commission's
recommendation for approval based upon the testimony of the applicant,
and the recommendations and conditions as outlined by the Department of
Planning Services staff. Motion seconded by Louis Rademacher.
The Chairman called for discussion from the members of the Planning Commis-
sion. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Louis Rademacher - yes; Bill McMurray
yes; Sharon Linhart - yes; Stephen Hamilton - yes; Paulette Weaver

Dear Mr. Mayerl:
We have reviewed the above referenced rezoning application from Cl to C3.
An existing well is proposed as the source of supply. We assume this is an
old well constructed before 1972. It appears the well will only be used for
drinking and sanitary purposes in this proposed building. Our recommendation
for approval of this application is based on this existing well only serving
this new structure and no future buildings will be allowed to use this well.

Dear Jim:
The Greeley Planning Commission at its meeting on September 11, 1984, reviewed
the request by Bud Wilkinson for rezoning from C-1 to C-3 for property located
northeast of 5th Street and U.S. 85 Bypass.
The Commission recommended no objections to the request since the zoning would
permit uses consistent with other uses in the surrounding area and is consistent
with the types of uses suggested by the Greeley Comprehensive Plan for this area.

COMMENTS:
Access to the subject site is via a private gravel road off 1st Avenue Street
east of Highway 85. The site is in the 100 year flood plain of the Cache La
Poudre River. There currently exists 2 mobile homes, two sheds and one vacant
dilapedated house on the site. Site is fenced in with 4 strand barbed wire. It
is currently in weeds and grasses. Several junked vehicles are on the north
-part of the site.

As requested , we have reviewed the legal description of your property being
part of Lot 2 of the Southwest Quarter of the Northwes-t Quarter of Section
4, Township 5 North, Range 65 West of the 6th P.M. , Union Colony of Colorado
(See attached Assessor: legal formore complete description ) . We have also
located this tract ant the proposed building location on the available Flood
Plain maps .
During an actual and rccurate survey, which was conducted cn June 12, 1984 ,
it was determined that the actual ground elevation at the building site is
4634.8, U.S.G.S. Datum. The Benchmark set at the Southeast Corner of the
building site is at Elevation 4634 .81.
The attached Flood Plan Maps show the property to be located in the FP-2
Weld County Flood Hazard Overlay District. The maps also show the Flood
Zone to be designated AO, i .e. "Areas of 100-Year shallow flooding where
depths are between one (1 ) and three (3) feet: Average depths of innunda-
tion are shown, but -no flood hazard factors determined" . The average depth
shown at the site is two (2) feet. Therefore, it is our judgemerrt that the
finished floor of the proposfd building should be located at Elevation
4637.8. This is one foot above the regulatory flood protection elevation.
It is also our opinion that the Post-Frame building with 6" Concrete Slab
Floor and the built sip pad will be adequate to provide anchorage and fload

damage protection to the building.
As the location is essentially in -a "back-water" portion of the Flood Plain,
there will be negligible effect on the watercourse of the Poudre River. The
fill used to rais2 the pad will be "pit run" gravel material and will extend
a minimum of 20 feet beyond each wall line and then sloped at a minimum
4h : lv slope to existing ground. This fill system in conjunction with the
location will protect the fill material and pad from the erosional forces
of the Intermediate Regional Flood (100-Year).
There is an existing, approved, water well on the site located in a pump
building. Inspection shows the using and pump -extend about 2 foot above
the ground. This elevation should provi-de reasonable protection from inun-
dation and infiltration by the Intermediate Regional Flood.
The proposed sewage system Consists of a buried service line to concrete
holding vault. A standard 6' X 10' X 5'4" vault will hold about 2400 gallons.
Total vault weight is 15,380 pounds with 4" tank walls. One foot of ground
cover is required above the tank to prevent floating when the tank is empty.
This system will prevent inundation and infiltration of floodwater and dis-
charges from the system into the floodwater.

Gentlemen:
At; the request of Mr. Jack Renfroe of Foundations, Inc. , Greeley,
Colorado, Empire Laboratories, Inc. was present at the above site on
December 1 , 1982 and logged seven (7) test pits dug at the site. The
test pits were dug,adjacent to each corner of the proposed building and
at two locations in the center portion of the building area.
The majority of the test pits were dug to the natural sand and gravel
stratum at approximate depths of seven (7) feet below the surface. Fill
was encountered in all test borings and varied in thickness from two and
one-half (2-1/2) to five and one-halt (5-1/2) feet. The majority of the
fill consists of relatively _clean silty sand and gravel material containing
• minor amounts of bricks and traces of glass. In Test Pits 3 -and 6,
heavy concentrations of debris were encountered below the _clean fill at
depths of two and one-half (2-1/2) and four (4) feet below the surface.
This debris consists of organic clay mixed with bricks, bottles, wood,
and other materials. Groundwater was encountered in the majority of
the test pits at depths seven (7) feet below the surface.
A review of the soils report indicates that these subsurface conditions
are similar to those encountered in the three (3) test -borings drilled at
the site and described in -our "Report of a Geotechnicai investigation"
prepared for the project October 2b, 1982. It is our opinion that the
recommendations set forth in our report for the construction of the
