HomeMy WebLinkAbout20060377.tiff HEARING CERTIFICATION DOCKET NO. 2006-12 RE: SITE SPECIFIC DEVELOPMENT PLAN AND MINOR SUBDIVISION FINAL PLAN, MF #1039, FOR NINE (9) RESIDENTIAL LOTS - CHARLES MESERLIAN A public hearing was conducted on March 1, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem - EXCUSED Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad - EXCUSED Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Sheri Lockman Health Department representative, Pam Smith Public Works representative, Peter Schei The following business was transacted: I hereby certify that pursuant to a notice dated February 3, 2006, and duly published February 8, 2006, in the Fort Lupton Press,a public hearing was conducted to consider the request of Charles Meserlian for a Site Specific Development Plan and Minor Subdivision Final Plan, MF#1039,for nine(9)residential lots. Bruce Barker, County Attorney, made this a matter of record. Chair Geile advised the applicant's representative, Jeff Couch, TEAM Engineering, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today,it will require three affirmative votes,or be deemed denied. Mr.Couch indicated he would like to proceed today. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written,and gave a brief description of the location of the site and surrounding land uses. She stated numerous subdivisions have been approved in the vicinity in the recent past. She further stated 14 referral agencies reviewed this proposal, 11 responded favorably or provided comments that have been addressed in the Conditions of Approval,and staff received no correspondence from surrounding property owners. Ms. Lockman stated the applicant was required to resolve the issue of future oil and gas drilling on the site prior to scheduling the Commissioners' hearing. She explained the applicant purchased the mineral interests,therefore,she recommended adding a new Condition of Approval #1.B to state, "The applicant shall submit a recorded deed which transfers the mineral interest associated with the property to the Prairie Hollow Homeowners'Association,"and relettering accordingly. Pam Smith, Department of Public Health and Environment, stated minimum lot size is 6.7 acres, with an overall density of 9 acres. She stated the Covenants will need to be modified to include language regarding the preservation of primary and secondary septic envelopes,and the applicant 2006-0377 (Y) PG PL1712 /014),ffc- HEARING CERTIFICATION - CHARLES MESERLIAN (MF#1039) PAGE 2 is aware of the request and will make the necessary changes prior to recording the Covenants. In response to CommissionerJerke,Ms.Smith explained septic envelopes should be preserved since the minimum lot size is 6.7 acres, there is drainage through the site,and livestock will be allowed. She stated the site is bordered by the Larimer Canal,and contains various ditches and a detention pond. She further stated most of the lots will require engineered septic systems due to the high percolation rates. She explained the space required for animals and their associated corals and outbuildings reduces the area that is suitable for secondary septic leach fields. Peter Schei, Department of Public Works, stated all of the lots will be accessed from an internal road extending from Weld County Road 21. He stated the internal road will be gravel and maintained by the Homeowners'Association. He further stated Weld County Roads 21 and 84 are classified as local gravel roads,and staff is working with the applicant to resolve some minor issues with the Drainage Report. Mr.Couch stated there have been no major changes since the Change of Zone hearing. He stated the applicant completed a Hydrological Report on the entire parcel, and he has no objection to designating two septic envelopes. He stated the lots will be restricted to two large animals,and the historical drainage patterns will be maintained. He further stated the Larimer Canal is located along the west property line, there will be a 250-foot setback to accommodate for any seepage, and the applicant did purchase the mineral rights. In response to Commissioner Masden, Mr.Couch stated the Covenants address maintenance of the road,open space,animals,and the type of homes that will be allowed. He stated there is a 15-acre tract for the applicant's home,and the remaining land will be divided to create the remaining lots. In response to ChairGeile, Mr.Couch stated he and the applicant have reviewed and concur with the Conditions of Approval,as proposed and modified. No public testimony was offered concerning this matter. Commissioner Jerke moved to approve the request of Charles Meserlian for a Site Specific Development Plan and Minor Subdivision Final Plan, MF#1039,for nine(9)residential lots, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval as entered into the record. His motion also included adding Condition of Approval#1.6 to state,"The applicant shall submit a recorded deed which transfers the mineral interest associated with the property to the Prairie Hollow Homeowners'Association,"and relettering accordingly. The motion was seconded by Commissioner Masden, and it carried unanimously.
