RE: APPROVAL OF RECORDED EXEMPTION NO. 501 - STEPHEN KORAS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 10th day of June, 1981 in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 501, being the property of
Stephen Koras, described as part NW4 Section 21, Township 1
North, Range 65 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows :
A tract of land located in the Northwest
Quarter (NW;) of Section 21, Township 1
North, Range 65 West of the Sixth Principal
Meridian, Weld County, Colorado, and being
more particularly described as follows:
Commencing at the Northwest Corner (NWCor)
of said Section 21, and considering the
West line of the Northwest Quarter (NW4)
of said Section 21 to bear South 00°06 ' 50"
East, and with all other bearings contained
herein relative thereto:
Thence South 89°28 ' 50" East, 542 . 67 feet;

authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of
land from the definitions of "subdivision" and "subdivided
land" pursuant to its authority under Seciton 30-28-101 (10) (d) ,
CRS 1973, as amended, and Section 2-lA (3) of the Weld County
Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the hereinabove
described parcel of land owned by Stephen Koras be, and hereby
is, exempt from the definition of the terms "subdivision"
and "subdivided land" pursuant to its authority under Section
30-28-101 (10) 9d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 10th
day of June, A.D. , 1981.

Re: Recorded Exemption #501
Dear Commissioners:
The attached letter and related materials are in reference to a request
for a recorded exemption by Mr. and Mrs. Stephen Koras. The property
is described as the NWI, Section 21, T1N, R65W of the 6th P.M. , Weld
County, Colorado. This property is located 111 miles south of Hudon,
Colorado on the north side of I-76.
The property contains approximately 35 acres of class IV and VI non-
irrigated soils. Mr. and Mrs. Koras wish to sell the existing house
and 30 acres and build a new home on the remaining five (5) acres.
On March 18, 1981, the Board of County Commissioners approved a request
by Mr. and Mrs. Koras for a lot size variance so that they could make
application for this recorded exemption. At the time they made the
decision on that request, the Department of Planning Service's staff
submitted a letter of recommendation for denial to the Board. A copy
of the letter for denial is included in the attached packet. Nothing
has been received by our office that would change our recommendation
for denial for this request, as outlined to the letter to the Board of
County Commissioners dated March 18, 1981.

RE: Lot Size Variance #123:81: 1
Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from Stephen and Mary Koras. The property on
which this request has been made is described as NWa of Section 21,
- T1N, R65W of the 6th p.m. , Weld County, Colorado. This property is
located 11/2 miles south of Hudson on the north side of I-76.
The property under consideration contains approximately 35 acres of
class IV & VI non-irrigated soils. The request is to obtain a vari-
ance from the minimum lot size requirement, Section 9-4. A. (6) of
the Weld County Subdivision Regulations, so that they may make appli-
cation for a recorded exemption.
Mr. and Mrs. Koras desire to sell the existing house and 30 acres and
build a new home on the remaining 5 acres for retirement purposes.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services staff recommends the request
be denied for the following reasons:
1. The proposed request does not comply with the Weld County Compre-
hensive Plan because it would promote non-agricultural use of agri-
cultural land and it would encourage urban encroachment on rural
land use. The Plan urges residential development to be closely
connected to and served by municiapl utilities with towns being
encouraged to service new developments within a reasonable service
area from its incorporated boundaries. The Plan further indicates
subdivision of land should conform to the overall development goals
and policies of the Comprehensive Plan.
2. This request is not in conformance with the intent clause of the
Agricultural Zone District, Section 3.3.A. of the Weld County Zoning
Resolution. This request would not be encouraging agricultural uses

as the highest and best uses, it would not be providing for the
orderly expansion of.urban growth, it would be promoting the div-
ision of agricultural land into smaller, less economic parcel sizes,
and increasing the residential density on the property.
The approval pptj� s request would allow another residence to be
built on the;4"acire parcel . While the addition of one residence
does not in itself create an urban encroachment, the cumulative
effect of land divisions on the surrounding area may have future
negative impacts on the agricultural economy. Increased residen-
tial density results in greater demands on the services which resi-
dential development requires and therefore higher costs of those
services to the residents of the County.
3. This request is not in compliance with the intent clause of the
recorded exemption procedure, Section 9-2 of the Weld County Sub-
division Regulations. The parcel is not prime agricultrual land
because of past division of land creating rural residential tracts.
The nature of the request is not, however, providing for the orderly
expansion of urban growth in accordance with the Comprehensive Plan.
The Department of Planning Services staff feels that if residential
development increases in the area, inefficient development will
result.
4. The minimum lot size in the Agricultural Zone District for irrigated
parcels is 80 acres and for non-irrigated parcels is 160 acres.
The intent is to maintain tracts which are large enough for farm
purposes, and to assist in the encouragement of agricultural uses
as the highest and best use of the land.. This request is in conflict
with that intent.

RE: APPROVAL OF LOT SIZE VARIANCE NO. 123 : 81 : 1 - STEPHEN AND
MARY KORAS
WHEREAS, the Board of County Commissioners of Weld County ,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County , Colorado, and
WHEREAS, the Board of County Commissioners has determined,
at a public meeting held on the 18th day of March, 1981 in the
Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain tract of land is owned by Stephen and
Mary Koras , which land is more particularly described as follows :
The Northwest Quarter of Section 21, Town-
ship 1 North, Range 65 West of the 6th P .M. ,
Weld County , Colorado containing approxi-
mately 35 acres.
WHEREAS, Stephen and Mary Koras desire to obtain a variance
from the minimum lot size requirement so that they may apply for
a recorded exemption, as set forth in Section 9-4 .A. (6) of the
Subdivision Regulations , and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado feels that the applicant has shown good cause for granting
a lot size variance under Section 9-4 .A. (6) of the Weld County
Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a variance from lot size
requirements be, and hereby is , granted to Stephen and Mary Koras
for the above described parcel of land.
