A public hearing was conducted on November 1, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem Commissioner William H. Jerke Commissioner Robert D. Masden - EXCUSED Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Jacqueline Hatch Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 13, 2006, and duly published October 18, 2006, in the Fort Lupton Press,a public hearing was conducted to consider the request of Mineral Reserves, Inc., c/o Lafarge West, Inc., for a Site Specific Development Plan and Use by Special Review Permit #1455 for Mineral Resource Development Facilities, including sand and gravel mining, in the A(Agricultural)Zone District. Bruce Barker, County Attorney, made this a matter of record. Jacqueline Hatch, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and gave a brief description of the location of the site and surrounding land uses. She stated presently there are no improvements on the site,which is within the three-mile referral area for the Towns of Firestone and Frederick and the City of Longmont. Ms. Hatch stated the Town of Firestone did not respond to the referral request,and the Town of Frederick expressed concern with screening,preservation of existing trees,surrounding property owner concerns,setbacks from the Idaho Creek Subdivision, and reclamation of the site. She stated initially the City of Longmont expressed concern with the Reclamation Plan; however, a subsequent response indicates the applicant has addressed the issue. She further stated the permit boundary includes 56.5 acres,of which 50 acres are proposed to be mined in two phases over a period of three years. Ms. Hatch stated the mined material will be conveyed across Weld County Road 20.5 to the Cottonwood Pit, permitted under Second Amended Use by Special Review Permit #488 (2ndAmUSR-488), for processing. She stated this will be a dry mining operation, the sand and gravel deposits vary in depth from 13 to 18 feet,the maximum excavation depth will be 25 feet, and the resource deposit is estimated to contain 1.5 million tons. Ms. Hatch explained the excavation process, and stated reclamation of the site will be completed in two to five years, following completion of the mining operation. She stated reclamation will include the creation of unsealed ponds for recreational purposes and wildlife habitats. (USR#1455) PAGE 2 to six feet, and the noise levels will comply with the requirements of the Weld County Department of Public Health and Environment. Ms. Hatch stated sixteen referral agencies reviewed the proposal, one did not respond, twelve provided comments that have been addressed in the Conditions of Approval and Development Standards,and staff received no correspondence from the Colorado Division of Wildlife,Colorado Division of Minerals and Geology,Town of Firestone,or any surrounding property owners. In response to Commissioner Vaad, Ms. Hatch stated the Rinn Valley Ranch is within the municipal boundary of the Town of Frederick, the Reclamation Plan is under the jurisdiction of the Colorado Division of Minerals and Geology,and there is a neighboring property that experienced drainage problems south of the site. Responding to Chair Geile, Ms. Hatch stated staff received no comments from surrounding property owners, and there is a Condition of Approval which requires the applicant to respond to the letter received from the Town of Frederick. Char Davis, Department of Public Health and Environment,stated staff is requiring the applicant to provide bottled water and portable toilets for the employees. She stated they are also required to submit an Air Pollution Emission Notice, Dust Abatement Plan, and Colorado Discharge Permit. Donald Carroll, Department of Public Works,stated the haul route is along Weld County Road 20.5, between Weld County Roads 1 and 7,then north or south on Weld County Road 7. He stated the only difference for this application is that the mined material will be conveyed north to the Cottonwood Gravel Pit. He stated staff will review the design to ensure the conveyor is out of the existing right-of-way and that the proper height is allowed for clearance of vehicles in the area. He further stated the applicant will also be required to obtain a crossing permit from the Department of Public Works. Eric Reckentine,Area Managerfor Lafarge West, Inc.,represented the applicant and stated as the second phase is being stripped, the first phase will be reclaimed, and there will be no additional truck traffic due to the conveyance system. Responding to Chair Geile, Mr. Reckentine confirmed there will be no additional truck traffic leaving the existing site. In response to CommissionerJerke, Jerke, Mr. Reckentine stated the project will result in recreational ponds, wildlife habitats, and possibly some low-density residential development of one or two lots; it will not have a water storage component. Responding to Commissioner Vaad,Mr. Reckentine stated the ponds will be unsealed, and Lafarge West, Inc., will augment the site in perpetuity. In response to Chair Geile, Mr. Reckentine stated he and the applicant have reviewed, and concur with, the Conditions of Approval and Development Standards, as proposed. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Mineral Reserves, Inc., c/o Lafarge West, Inc., for a Site Specific Development Plan and Use by Special Review Permit#1455 for Mineral Resource Development Facilities, including sand and gravel mining, in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Long,and it carried unanimously.
