HomeMy WebLinkAbout20062989.tiff RESOLUTION RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #580 - GEORGE STRUBLE WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #830177, dated November 16, 1983, the Board of County Commissioners approved Use by Special Review Permit #580 for the expansion of an egg production facility for George Struble, 3198 Weld County Road 4, Erie, Colorado 80516, on the following described real estate, to-wit: Lot 3, Block 1 of Ranch Eggs Subdivision, being part of the NW1/4 of Section 34, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, the Board has received a request from Melvin and Bernadine Dirksen, 3198 Weld County Road 4, Erie, Colorado 80516, current property owners,to vacate said Use by Special Review Permit#580, since the use is no longer being performed on the property, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicants and the recommendation of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Use by Special Review Permit#580 be, and hereby is, vacated. The Department of Planning Services conducted a site visit of your property and noticed the Use by Special Review USR-580 for an expansion of an egg production facility originally approved on November 16, 1983 by the Board of County Commissioners is no longer being conducted on the property. The Department of Planning Services request that you submit in writing to our office a request to either vacate the Use by Special Review or submit written evidence that the approved uses are still in operation. I have enclosed a form for you to indicate your wishes and sign along with an envelope for you to mail the form back to the Department of Planning Services. If no response is received the Department of Planning Services will be setting up USR-580 for a probable cause hearing before the Board of County Commissioners to review compliance with the permit. All conditions of the original permit must be in compliance by October 30, 2006 or a Probable Cause public hearing, pursuant Chapter 23, Article II (2), Division 4, Section 23-2-270 of the Weld County Code, will be scheduled. If the Probable Cause Hearing is scheduled, the purpose of this public hearing will be to review case number USR-580, for compliance with the Development Standards and Conditions of Approval, as approved by the Board of County Commissioners on November 16, 1983 to determine if probable cause exists to hold a hearing on revocation of the permits. The Department of Planning Services has determined that per section 23-2-200 of the Weld County Code the Use by Special Review (USR-580) for an expansion of an egg production facility is not being conducted on site.
