HomeMy WebLinkAbout830397.tiff RESOLUTION RE : APPROVAL OF MEMORANDUM OF UNDERSTANDING BETWEEN WELD COUNTY, COLORADO AND SOIL CONSERVATION DISTRICTS WHEREAS, the Board of County Commissioners of Weld County, Colorado pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a memorandum of understanding between Weld County, Colorado and the Soil Conservation Districts has been presented to the Board of County Commissioners for its approval, and WHEREAS, said memorandum of understanding would include the following Soil Conservation Districts : Big Thompson Morgan Boulder Valley Platte Valley Centennial Southeast Weld Fort Collins West Adams Longmont West Greeley WHEREAS , the terms and conditions are as stated in the memo- randum of understanding, a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board deems it advis- able to approve said memorandum of understanding. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the memorandum of under- standing between Weld County, Colorado and the hereinabove men- tioned Soil Conservation Districts be, and hereby is, approved. Brantner County Attorney Norman q Carlson \ :c u: \ne J�j+inso Z ORD #108 830397 DAY FILE : October 10, 1983 MEMORANDUM OF UNDERSTANDING between Big Thompson Soil Conservation District Boulder Valley Soil Conservation District Centennial Soil Conservation District Fort Collins Soil Conservation District Longmont Soil Conservation District Morgan Soil Conservation District Platte Valley Soil Conservation District Southeast Weld Soil Conservation District West Adams Soil Conservation District West Greeley Soil Conservation District and Weld County Board of Commissioners This Memorandum of Understanding was entered into this 5th(fifth) day of October , 1983, by and between the Big Thompson Soil Conservation District, Boulder Valley Soil Conservation District, Centennial Soil Conserva- tion District, Fort Collins Soil Conservation District, Longmont Soil Conser- vation District, Morgan Soil Conservation District, Platte Valley Soil Conser- vation District , Southeast Weld Soil Conservation District, West Adams Soil Conservation District, West Greeley Soil Conservation District (hereinafter referred to as the "Districts") , and the Weld County Board of Commissioners (hereinafter referred to as the "Commissioners") . WHEREAS, the Districts have developed Long-Range Programs to protect and improve the soil, water, vegetation, wildlife and related resources of Weld County as established by state law, WHEREAS, the Commissioners did develop and institute the grassland plowing Ordinance No. 108 to address the conversion of grasslands and fragile grassland to other uses by providing conservation treatment as a prerequisite, WHEREAS, the Districts and Commissioners share many common objectives in the conservation and orderly development of land and water use, NOW, THEREFORE, for and in the consideration of the promises herein contained, the parties hereto do agree with each other as follows: I. THE DISTRICTS AGREE TO: A. Provide information and technical services related to planning and to guiding proper land use consistant with the needs of the soil , the water and the related resources. 1 . The published soil surveys, Soil Survey of Weld Co. - Northern Part and Soil Survey of Weld Co. - Southern Part as developed by the USDA Soil Conservation Service in cooperation with Colorado Agricultural. Experiment Station will be used as the base document for soil resource information. 2. Other natural resource related information, maps, charts, guides, research findings will also be used to help guide decisions for land use recommendations. B. Assist any landowner applying for a permit to engage in the cultivation of grasslands, to develop a conservation plan, pur- suant to landowner and District designated goals and objectives, which will specify the condition under which cultivation is per- mitted and will state the needed conservation practices to pro- tect the resource base. C. Assist with the implementation of the grassland plowing Ordinance No. 108 by providing technical assistance to the landowner to insti- tute the approved conservation plan and provide follow up assistance. 1. Inspection of approved permits for compliance with conservation plan will be made at the request of the County Commissioners. D. Provide technical assistance to the designated county agency by advising remedial measures to be taken in the case of permit viola- tions in order to stablize the soils. II. THE COMMISSIONERS AGREE TO: A. Cooperate with the Districts in the development and implementation of long range land and water programs utilizing such resource data that may be provided by Districts. B. Cooperate with Districts in the enforcement of the grassland plowing Ordinance No. 108 by approving permits for cultivation of grasslands consistanct with the District recommendations and District approved conservation plans. C. Arrange for a meeting with the necessary District, landowner, and county agency to resolve controversial or conservation plan appeals as stated in the grassland plowing Ordinance No. 108. 1. Commissioners decisions on the appeals should then be based on sound resource conservation principles for protection of the soil and related resources. III. IT IS MUTUALLY AGREED: A. The Districts and the Commissioners will meet on an as needed basis to review and, whenever possible, coordinate their individual pro- grams and activities for maximum mutual benefit, and resource con- servation. B. This memorandum may be amended or terminated at any time by mutual consent of the parties hereto or may be terminated by either party by giving sixty (60) days notice in writing to the other.
