I understand that PF-1090 is likely going to be continued. You should probably coordinate with Esther Gesick at
Clerk to the Board on hearing dates. Then send a formal written request for a continuance. Be sure to leave
enough time to address all of Public Works concerns, allow for adequate Public Works review time and allow for
time for Planning Staff to prepare the recommendation to the Board. You do not want to have the Board continue
the case again if at all possible.

discretion of Eagle View Farms so tong as it provides positive drainage from the manhole
in the northeast corner of the PUD parcel which the underdrain enters that serves your

1) Condition 1.B should be amended: the date of the referral response shall be changed from
"July 25, 2006" to "September 25, 2006".
2) Condition 1.S should be amended: This pertains to the underdrain easements: this condition
s'hould be amended to read: "There are two existing pipes that drain farm ground located to the
east of County Road 35 (one on the north end of the development and one in the center). The
applicant intends to replace the existing underdrain pipes and reroute them along the north end
of the PUD. This drain system will not be owned and should not be maintained by the
Homeowner's Association. A signed and recorded easement agreement covering the proposed
underdrain shall be submitted to the Departments Public Works of Planning Services."
3) This condition should be added and renumbered as condition 1.T: "The applicant shall
provide a signed and recorded easement agreement with the Ogilvy Irrigating and Land
Company covering the proposed easement located on the western edge of the PUD."
4) Condition S (should read U) — item 11 should read: "The ditch easement between Ridgeview
Farms, LLC and the Ogilvy Irrigating and Land Company shall be shown and dimensioned on
the plat. The recording information in regards to the easement shall be indicated."

Please acknowledge your review and finding of no conflicts with the Final Construction Plans
and Final Plat dated September 12, 2006, including the revisions to be made thereto as generally
depicted on Exhibits A (North Ditch Segment-- Easement)and Exhibit B (South Ditch Segment
—Reconfigured Detention Pond)attached hereto, and that ditch activities have been adequately
incorporated into the design of the site for the above referenced development that borders the

Revisions to Proposed
Resolution of Approval
October 4,2006
Revisions/Corrections:
Para 2.f. WCR 35 requires a left hand turn lane be constructed as requested by Weld County Department
of Public Works. An improvements agreement has been submitted to and approved by Public Works which
addresses the safe design of the turn lane and the proposed cost necessary for construction of the turn lane
improvement to WCR 35 both of which will be completed by the applicant.
Para I.B. The applicant shall address the concerns and comments of the Department of Public Works,as
stated in referral responses dated September 22 and 25,2006. Written evidence of such shall be submitted
to the Weld County Department of Planning Services. Any and all conditions in the referral responses
relating to the Ogilvy Ditch have been addressed and are deemed to be satisfied by the agreement between
the applicant and the ditch company dated October 2, 2006(a copy of the letter is made a part of this
resolution). Any and all conditions in the referral responses relating to underdrainage of the Fagerberg
property onto and across the applicant's property have been addressed and are deemed to be satisfied by the
letter submitted by the applicant to and approved by Fagerberg dated September 29,2006(a copy of the
letter is made a part of this resolution). Any and all conditions in the referral responses relating to the use
of an exclusive easement granted to Duke Energy have been addressed and are deemed to be satisfied by
the letter provided by Duke Energy dated October 2,2006 (a copy of the letter is made a part of this
resolution). Any required modifications to the Final Plat and Construction Drawings consistent with the
above correspondence shall be approved by the Department of Public Works prior to the recording of the
final plat. Public Works shall notify the Department of Planning Services of such approval prior to
recording of the plat. Easements for the proposed underdrain and the additional agreed upon easement for
the Ogilvy Ditch shall be signed and recorded and submitted to Public Works. Such easements shall be
shown on the Final Plat and Construction Drawings as necessary.
4.A. "Eaton"shall be substituted for"Ault".
Additional Conditions to Resolution:
New Para I.C. The north line of lot 7 and the west line of lots 7, 8, 9, and 12 shall be fenced with five(5)
foot solid fencing in satisfaction of comments in the September 25,2006 Public Works memo concerning
accessibility to the Ogilvy Ditch.
