The undersigned, in accordance with Title 31, Article 12, Chapters 101 et: Seq., Colorado
Revised Statutes, hereby petition the Mayor and Trustees of the Town of Severance, Colorado,
for annexation to the Town of Severance the unincorporated territory described herein and
described and shown on the map designated as "Exhibit A, Property Description, The Reserve
Annexation No. 6 ". Copies of said map are submitted herewith and by this reference are
incorporated herein. The description of the territory hereby petitioned for annexation into the
Town is set forth in Exhibit"A" attached hereto and incorporated herein by reference.
Exhibit A must be an original printed property description on 8-1/2 x 11 inch white paper.
In support of this petition, the petitioner(s) allege(s)that:
1) It is desirable and necessary that the above described territory be annexed to the Town of
Severance, Colorado.
2) The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes
exist or have been met in that:
a) Not less than one-sixth (1/6) of the perimeter of the area proposed to be
annexed is contiguous with the Town of Severance;
b) A community of interest exists between the territory proposed to be annexed
and the Town of Severance;
c) The territory proposed to be annexed is urban or will be urbanized in the near
future;
d) The territory proposed to be annexed is integrated or is capable of being
integrated with the Town of Severance, Colorado.
3) The signatures of the Petition comprise one hundred percent(100%) of the landowners of the
territory to be included in the area proposed to be annexed and said landowners attesting to
the facts and agree that the conditions herein contained will negate the necessity of any
annexation election.
4) No land held in identical ownership, whether consisting of one tract or parcel of real estate or
two or more contiguous tracts or parcels or real estate:
(a) Is divided into separate parts or parcel without the written consent of the
landowner or landowners thereof, except and unless such tracts or parcels
are separated by a dedicated street, road or other public way;
(b) Comprising twenty (20) acres or more and which, together with the buildings
and improvements situated thereon has an assessed value in excess of Two
Hundred Thousand Dollars ($200,000.00) for ad valorem tax purposes for
the year preceding the annexation, is included within the territory proposed
to be annexed without the written consent of the landowner or landowners.
5) Except as otherwise provided, no part of the area proposed to be annexed is more than three
miles from a point on the municipal boundary, as such was established more than one year
before this annexation will become effective.
6) The territory proposed to be annexed does not include any area included in another
annexation proceeding involving a town other than the Town of Severance.

7) The territory to be annexed is not presently a part of any incorporated municipality, town and
county, or town.
8) Petitioner represents that no part of the property to be annexed is included within any site
specific development plan approved by Weld County, Colorado.
9) The territory proposed to be annexed does not include any area that is the same or
substantially the same area in which an election for an annexation to the Town of Severance
was held within the twelve months preceding the filing of this petition.
10) The area proposed to be annexed comprises more than ten acres and an impact report as
provided for in Section 31-12-105.5, CRS will be required.
11) The area to be annexed is located within Weld County and will be serviced by:

Severance Annexation Petition submittal requirements.
14) A Concept Master Plan and supporting documents as required under the Concept Master
Plan Checklist within the Town of Severance Annexation Petition submittal requirements.

IMPACT STATEMENT
THE RESERVE ANNEXATION TO THE TOWN OF SEVERANCE
PUBLIC HEARING DATES: JANUARY 25TH (Planning Commission) AND
FEBRUARY 1st(Town Board)
Location: This is property is located in the NW Ya of Section 10, T6N, R67W. The
property is bounded on the west by WCR 19 and on the north by the ROW for WCR 72
(Tinsman Avenue). There is Y2 of a mile between the proposed Hidden Valley Farm
Annexation and this project. The area contains approximately 156 acres.
Contiguity: A review of the annexation map will show that contiguity is being achieved
through a succession of 6 annexations. Annexations 1-4 are from the SW corner of the
Mikelson Annexation to the NW corner of Hidden Valley Farm at Teller Street and
Tinsman Avenue. The addition of this 1/2 mile of right-of-way clarifies ownership and
maintenance of the right-of-way. Upon annexation, WCR 21, from WCR 76 -'/2 to WCR
70 will be within the Town of Severance and known as Teller Street. Annexation #5 runs
along the right-of-way of the nonexistent WCR 76, or what's to become Tinsman Avenue
from WCR 19 to 1s"Avenue. Annexation #6 is the property itself.
While currently disconnected by'% mile, the Land Use Plan anticipates that the property
between this project and Hidden Valley will someday be within the Town's limits and full
connectivity will be made. Development of Tinsman Avenue and the proposed trail
system aim to this end. The Petitioner's Statement of Community Interest is included for
your review. (Petitioner's Statement includes a provision for a small commercial site that
has since been withdrawn by the petitioner.)
Project Summary: The property is proposed to be zoned Estate-3, which is a low
density residential district intended to encourage the preservation of purposeful open
space, natural features and agriculture land in conjunction with the clustering of single-
family homes. Consistent with the Town's Comprehensive Plan and this zoning, the lots
will be on sewer and with a minimum of 50% of the acreage preserved as undivided,
permanent open space, managed by an owner's association, to provide a degree of
buffer between Severance and Windsor.
Residential Density: Please refer to the Concept Master Plan, dated November 17,
2005, for detail. Gross Residential Density= 1 DU/AC. Estimated price range of homes
on lots : $300,000- $600,000.
Impact on Population: at full build-out, this project is anticipated to add another 390
residents.
Impact on Schools: The Weld County R-E 4 school district estimates that this project
will generate 124 students. The District is requesting fair-contribution in the form of
payment-in-lieu of land dedication, at the effective rate, as agreed to by the IGA between
the Town and the School District, at the time of building permit.

Traffic Impacts: A traffic study will be required with preliminary plat. Applicant will
undertake to extend Tinsman Avenue (WCR 72) from Teller Street to WCR 19. In
accordance with the Town's regulations, Petitioner and assigns will be responsible for
required improvements to adjacent arterials and maintenance of same from annexation
until Town accepts improvements and maintenance responsibilities. With regard to local
streets, applicant is proposing streets, built to Town of Severance standards, privately
maintained by an association of owners.
Utilities: An estimate of impacts to water and wastewater systems is included with the
utility plan. Completion of the Town's interceptor line to Windsor's Regional Plant will be
required prior to development of the property. Acknowledgement of service by NWWCD
will be required prior to annexation. Gas and electric companies have stated the ability
to meet needs to be generated by this project. Electric is within the REA service area;
Gas is within the Xcel service area. Private landfills will handle the solid waste.

Statement of Community Need
The Reserve
Severance, Colorado
The proposed annexation is located on the western boundary of the Town's Growth
Management Area and is bounded by County Road 19 to the west and the proposed
extension of County Road 72 to the north.
This quarter section can be viewed as a strategic annexation as the site when developed
can provide a key portion of road that will in the future provide the Town and its
residents a key east/west arterial that will serve the southern portion of the town. As the
development of County Road 72 occurs, access and traffic circulation will improve and
provide for a more logical development pattern for the town.
The development of this site will also allow for the cost sharing and participation in
infrastructure on a variety of master plan issues such as sanitary sewer, regional water
and storm drainage projects.
We have also provided for a small commercial site which we hope to be feasible in the
not to distant future. We are of the belief that County Road 19 will only become more
and more traveled and we think at some point this access point to Severance could
become beneficial to the town.
We also feel we can have a positive impact on the local tax base for the town. We have
had successful development projects within one-half mile of this site, have built over
1,000 units in the Windsor area and have been able to absorb and target markets that are
beneficial to both myself and to the town's I have worked with.. I would foresee these
lots as selling within a three to four year time frame with homes in the $300,000 to
$600,000 price range. A low density project as proposed; with private interior streets
can have a financially positive impact for the Town. I see the improvement of County
Road 72 as being key to the immediate area and with the absorption of the residential
area I see the commercial area being potentially feasible for retail or professional office
space. It is possible that the retail sales generated for this site would largely come from
commuters traveling from Fort Collins to Greeley. The completion of County Road 72
into southern Severance will also help the orderly development and absorption of
developments in the southern portion of the Town's growth management area. In
summary, I think the addition of The Reserve to Severance has a variety of projected
benefits for the town and I think the benefits will only be enhanced into the future.
RESOLUTION NO.2005-14
A RESOLUTION FINDING THAT THE PETITION FOR ANNEXATION
OF PROPERTY KNOWN AS THE RESERVE ANNEXATION IS IN
SUBSTANTIAL COMPLIANCE WITH C.R.S. 31-12-107(1) AND
SETTING A DATE FOR A HEARING BEFORE THE BOARD OF
TRUSTEES OF THE TOWN OF SEVERANCE TO CONSIDER
ANNEXATION OF THE AREA PROPOSED TO BE ANNEXED.
WHEREAS, the owners of 100% of the property known as The Reserve Annexation
have filed a Petition for Annexation of the hereinafter described property to the Town of
Severance,and;
WHEREAS, the Board of Trustees has determined that the Petition is in substantial
compliance with C.R.S. 31-12-107(1) and that a hearing on such annexation should be scheduled
as provided by Colorado law.
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF SEVERANCE,COLORADO AS FOLLOWS:
Section 1. The Board of Trustees hereby accepts the above described petition for
annexation and finds and determines that the petition for annexation of the property described as
The Reserve Annexations#1 -#6 and as described in Exhibit"A"attached hereto is in substantial
compliance with the requirements of C.R.S. 31-12-107(1) and Section 30 of Article II of the
Colorado Constitution and desires to initiate annexation proceedings in accordance with law.
Section 2. The Board of Trustees will conduct a public hearing on the ft day of
February, at the hour of 6:00 p.m. or as soon after as possible at the Town Hall, Town of
Severance, 231 West Fourth Avenue, Severance, Weld County, Colorado for the purpose of
determining whether the area proposed to be annexed meets the applicable requirements of C.R.S.
31-12-104 and 105, and to determine whether the area should be annexed to the Town of
Severance.
Section 3. The Town Clerk is hereby directed to publish notice of this hearing once
each week for four weeks in the Greeley Tribune, the designated newspaper for the Town of
Severance.
