RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMITS #461 AND #462 -

WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution#810177, dated May 6, 1981, and Resolution#810175, dated
May 20, 1981,the Board of County Commissioners approved Use by Special Review Permits#461
and#462 for an egg laying facility and manure composting facility for Kenneth Hohner,3398 Weld
County Road 4, Erie, Colorado 80516, on the following described real estate, to-wit:
Lot 3, Block 2 of the Second Filing of Ranch Eggs
Subdivision, being part of the NW1/4 of Section 34,
Township 1 North, Range 68 West of the 6th P.M.,
Weld County, Colorado, and
WHEREAS,the Board has received a request from Herbert and Cathryn Riehl,3398 Weld
County Road 4, Erie, Colorado 80516, current property owners, to vacate said Use by Special
Review Permits#461 and#462,since the uses are no longer being performed on the property,and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicants and the recommendation of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacations.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that Use by Special Review Permits#461 and#462 be,and hereby are,vacated.

The Department of Planning Services has received the attached letter dated September 29,
2006 from Herbert and Cathryn Riehl. The property owners are requesting that USR-461 and
USR-462 be vacated from the following parcel, 1467 34 201011 since the use is no longer
being performed on the property.
Background information:
Legal Description: Lot 3, Block 2 of the Second Filing of Ranch Eggs Subdivision being part
of the NW4 of Section 34, T1 N, R68W of the 6th P.M., Weld County,
Colorado.
Location: South of County Road 4 and east of County Road 7
USR-461 and USR-462: USR-461 and USR-462 was approved by the BOCC on
May 6 and May 20, 1981, for a Site Specific Development
Plan and Special Review Permit for an egg laying facility
and a manure composing facility in the A (Agricultural)
Zone District.

Dear Mr. & Mrs. Herbert Riehl:
This letter is regarding your property located on Lot 3, Block 2 of the Second Filing of Ranch
Eggs Subdivision being part of the NW4 of Section 34, T1 N, R68W of the 6th P.M., Weld
County, Colorado, parcel number 1467 34 201011.
The Department of Planning Services conducted a site visit of your property and noticed the
Use by Special Review USR-461 and USR-462 for an egg laying facility and a manure
composing facility originally approved on May 6 and May 20, 1981 by the Board of County
Commissioners are no longer being conducted on the property.
The Department of Planning Services request that you submit in writing to our office a request
to either vacate the Use by Special Review or submit written evidence that the approved uses
are still in operation. I have enclosed a form for you to indicate your wishes and sign along with
an envelope for you to mail the form back to the Department of Planning Services.
If no response is received the Department of Planning Services will be setting up USR-461 and
USR-462 for a probable cause hearing before the Board of County Commissioners to review
compliance with the permit. All conditions of the original permit must be in compliance by
October 30, 2006 or a Probable Cause public hearing, pursuant Chapter 23, Article II (2),
Division 4, Section 23-2-270 of the Weld County Code, will be scheduled.
If the Probable Cause Hearing is scheduled, the purpose of this public hearing will be to review
case numbers USR-461 and USR-462, for compliance with the Development Standards and
Conditions of Approval, as approved by the Board of County Commissioners on May 6 and May
20, 1981 to determine if probable cause exists to hold a hearing on revocation of the permits.
The Department of Planning Services has determined that per section 23-2-200 of the Weld
County Code the Use by Special Reviews (USR-461 and USR-462) for a an egg laying facility
and a manure composing facility are not being conducted on site.
