HomeMy WebLinkAbout20062328.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN, PF #521, FOR 19 LOTS WITH E (ESTATE)ZONE USES,ALONG WITH 15 ACRES OF OPEN SPACE, IN ADDITION TO 36 ACRES OF OPEN SPACE AND EQUESTRIAN USES LOCATED ON TRACT A-DON AND LINDA OWENS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,a public hearing was held on the 30th day of August,2006,at 10:00 a.m.for the purpose of hearing the application of Don and Linda Owens, 8585 Weld County Road 22, Fort Lupton, Colorado 80621, requesting a Site Specific Development Plan and Planned Unit Development Final Plan,PF#521,for 19 lots with E(Estate)Zone uses,along with 15 acres of open space, in addition to 36 acres of open space and equestrian uses located on Tract A, for a parcel of land located on the following described real estate, to-wit: Lot B of Recorded Exemption#1921;being part of the SE1/4 of Section 9, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS,at said hearing on August 30,2006,the Board deemed it advisable to continue the matter to September 27,2006,at 10:00 a.m.,to allow the applicants adequate time to address issues of concern regarding: 1)drainage, 2)road maintenance, 3)submittal of a letter regarding removal of the provision for maintenance of the septic systems by the Homeowners'Association, and 4) status of the Annexation Agreement with the Town of Firestone, and WHEREAS, at said hearing on September 27, 2006, the Board deemed it advisable to continue the matter to November 1, 2006, at 10:00 a.m., to allow the applicant additional time to work with staff to resolve remaining outstanding matters, and WHEREAS, at said hearing on November 1, 2006, the applicants were represented by Steven Janssen, 3990 Pleasant Ridge Road, Boulder, Colorado 80301-1718,who requested an indefinite continuance, and the Board deemed it advisable to refer the matter back to the Department of Planning Services to allow the applicant additional time to work with staff to resolve outstanding matters. 2006-2328 PL1734 ((I ' /OL, /4r% ��L7) 4'A- M7-) //-i3 -o6 REFER PUD FINAL PLAN, PF#521, TO PLANNING SERVICES - DON AND LINDA OWENS PAGE 2 NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Don and Linda Owens for a Site Specific Development Plan and Planned Unit Development Final Plan, PF#521, for 19 lots with E (Estate)Zone uses, along with 15 acres of open space, in addition to 36 acres of open space and equestrian uses located on Tract A,on the above referenced parcel of land be, and hereby is, referred back to the Department of Planning Services for additional review.
