This referral does not appear to qualify as a "subdivision"as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit, or physical availability of water.
According to the submitted information, the Gravel Mining operation will cause depletions to
the South Platte River due to evaporative losses from exposed ground water and operational losses.
A Substitute Water Supply Plan (SWSP) or court approved augmentation plan must be
obtained to replace the depletions caused by the operation.
Gravel pit operators typically must first obtain approval from the Colorado Division of Minerals
and Geology(DMG) prior to mining. As part of that process the applicant will need to address the
potential concerns of State Engineer's Office as they relate to water rights.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our
comments and requirements are as follows:
COMMENTS:
WCR 6 is designated as a collector road, which requires a,70-foot right-of-way at full build out. This road is
maintained by Weld County.
Weld County Road Classification Plan (FHU): (June 2002) WCR 6 is a collector road and requires an 80-
foot right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents
creating the right-of-way. If the right-of-way cannot be verified, it shall be dedicated.
raffic Counts: The average daily traffic (ADT) counts for WCR 6 at this location ranges from 1,500 to 2,100
vehicles. These counts were taken in 2004 and 2005.
Traffic Impact Study: A joint traffic study including Aggregate Industries and Mobile Pre-Mix along with
Asphalt paving was submitted to the county as a part of the improvements agreement for the operation of the
pits on WCR 6. This traffic study generated additional traffic and a light was installed at U.S. Highway and
WCR 6 through this study. The applicant is indicating that there will be no increase in the truck count or
average production rate just transporting the material Perry pit to the proposed Wattenberg West site;
therefore, a new traffic study will not be required if annual production would not increase.
REQUIREMENTS:
Improvements Agreement: The applicant shall enter into a new Long-Term Road Maintenance and
Improvements Agreement for the Wattenberg West facility with the Weld County Public Works Department for
the Upgrade of paving and maintenance of the Weld County road which are associated with the pit and any
additional intersections impacted associated with heavy hauling that may be identified.
Storm Water Drainage: The site will be graded to insure that all storm water run-off that comes in contact
with disturbed areas will be directed into the mining areas or settling ponds.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.

operation.

Site Specific Development Plan and a Special Review Permit for a Mineral Resource Development Facility including a

1. A building permit shall be obtained prior to the construction or placement of any structure such as a scale house and the
truck scale. An electrical permit will be required for any electrical service to the plant and processing equipment. A plot
plan shall be submitted when applying for building permits showing all structures with accurate distances between
structures, and from structures to all property lines.

2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of a
Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the
following has been adopted by Weld County:2003 International Building Code;2003 International Mechanical Code;2003
International Plumbing Code;2002 National Electrical Code;2003 International Fuel Gas Code and Chapter 29 of the Weld
County Code.
4. Each structure set on a foundation will require an engineered foundation based on a site-specific geotechnical report or
an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a
Colorado registered engineer.
5. Building wall and opening protection in accordance with the Building Code. Setback and offset distances shall be
determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the Building Code for the purpose of determining the maximum
building size and height for various uses and types of construction and to determine compliance with the Bulk
Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter
23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback
requirements are measured to the farthest projection from the building.
7.A Flood Hazard Development Permit shall be submitted for buildings constructed in the 100-year flood plain.

Environmental Health Services has reviewed this proposal for a concrete and asphalt batch
plant, recycling plant, materials blending, import of materials and gravel mining. We have no
objections to the proposal, however, we do recommend that the following conditions be part of
any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and
Emissions Permit application from the Air Pollution Control Division, Colorado
Department of Health and Environment.
2. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
3. The applicant shall submit evidence from the Colorado Division of Water Resources
demonstrating that the proposed well water is appropriately permitted for drinking and
sanitary uses. Bottled water shall be provided to employees at the temporary locations
of the working face.
4. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS)
from the Water Quality Control Division of the Colorado Department of Health and
Environment for any proposed discharge into State Waterways.
5. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as conditions
that must be met one month prior to operation:
1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-contiguous
land disturbance is greater than or equal to one acre in area. The applicant shall inquire
with the Water Quality Control Division (WQCD) of the Colorado Department of Public
Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to
obtain a stormwater discharge permit. Alternately, the applicant can provide evidence
that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as conditions
that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed scale house and shall
be installed according to the Weld County Individual Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the
Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions.
4. The applicant shall operate in accordance with the approved "waste handling plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The
facility shall be operated in accordance with the approved dust abatement plan at all
times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.

7. Adequate handwashing and toilet facilities shall be provided for employees and visitors
of the site.
8. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems.
9. Portable toilets may be utilized on sites that are temporary locations of the working face
and portable processing equipment, etc. for up to six months at each location.
10. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
11. Bottled water shall be provided to employees at the temporary locations of the working
face at all times.
12. The applicant shall obtain a stormwater discharge permit from the Colorado Department
of Public Health & Environment, Water Quality Control Division.
13. In the event washing of vehicles will occur on site the applicant shall ensure that any
vehicle washing area(s) shall capture all effluent and prevent discharges in accordance
with the Rules and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
14. The operation shall comply with all applicable rules and regulations of the State and
Federal agencies and the Weld County Code.

The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
Per the application materials, the applicant is proposing Site Specific Development Plan and
Special Use Permit for Mineral Resource Development Facility for a dry mine imploring the use
of a dewatering ditch for an open pit mining operation in the A (Agricultural) Zone District.
Staff reviewed the Special Review Plan for this application, and staff did not review any
associated maps usually present for this application. Further, there was not evidence provided
stating that the applicant had obtained the Division of Minerals and Geology (DMG) Permit.
Descriptive text associated with this application discusses the proposed treatment of the site at
present, and the proposed treatment of the site when mining is finished. The post-mining land
use is for lined water storage.
On-site landscape treatment consists of existing and proposed deciduous and evergreen trees
with a dryland seed mix covering the ground plane. Per the application materials, the ground
plane will be planted in native and/or drought tolerant grasses. Future correspondence shall
identify the species of grass seed mix and whether the mix is to be drilled or broadcast for
installation. Future correspondence shall identify the erosion control devices including but not
limited to rip-rap and seeding that will be placed within and adjacent to this area. If plant
material is proposed, please identify the species and how this plant material will be installed.
Further, the proposed plant palette suggests that the installation of the plants would minimize
the erosion potential, however, the information is incomplete, and staff requests additional
information.
Further, the application materials do not indicate if a berm or mounding of overburden will occur
to effectively buffer the proposed Industrial type use from residential properties during the
extraction phases of this proposed permit.
In the questionnaire, item number 8j. directs readers to a line drawing delineating little
information for clarification, i.e., no topography, changes in elevation, et cetera. Further the
landscape treatment is to the east of the property, yet there are other rural residential structures
to the west that will be equally impacted by such a proposed facility. There is also some
landscape treatment to the north of the site near the batching facility, however, the level of
detail delineated requires greater depth and detail that what is submitted. Staff requests

additional information regarding the landscape treatment. Further, requirements for screening
the operation from adjoining properties, including the public rights-of-way should be addressed.
No discussion on this topic is presented. It is strongly suggested that the applicant consider
lowering the grade of the plant processing area to effectively screen and limit the amount of
noise, dust, odor and potential visual blight associated with the on-going operations of this
facility.
Issues concerning potable water and septic, dust suppression and appropriate permits to be
obtained prior to recording the plat(s) shall be coordinated with the Weld County Department of
Public Health and Environment.
Issues associated with on-site lighting shall be addressed to the Department of Planning
Services and delineated on the recorded USR Plat(s).
The applicant shall address Section 22-5-100.A of the Weld County Code which states "oil and
gas exploration and production should occur in a manner which minimizes the impact to
agricultural uses and the environment and reduces the conflicts between mineral development
and current and future surface uses." Section 22-5-100.B of the Weld County Code states
"...encourage cooperation, coordination and communication between the surface owner and the
mineral owner/operators of either the surface or the mineral estate." Finally, Section 22-5-
100.6.1 of the Weld County Code states "new development should be planned to take into
account current and future oil and gas drilling activity to the extent oil and gas development can
reasonably be anticipated." The applicant shall either submit a copy of an agreement with the
property's mineral owner/operators stipulating that the oil and gas activities have been
adequately incorporated into the design of the site or show evidence that an adequate attempt
has been made to mitigate the concerns of the mineral owner/operators. The plat shall be
amended to include any possible future drilling sites.
The applicant shall apply for and be approved for a Flood Hazard Development Permit for any
development that will increase or decrease the base flood elevation in the flood plain as
delineated on FIRM Community Panel Map, including the construction of any structures roads
and parking areas.
The applicant shall submit an Improvements Agreement for Public and Private Road
Maintenance, as required by the Departments of Public Works and Planning Services for review
and approval by these offices if so determined that one is needed.
The Landscape Plan associated with this application is determined to be of insufficient to render
an opinion on the effectiveness of the proposed plan. Staff requests greater detail and
description of this specific treatment.

Dear Ms. Martin;
In response to your request, I visited the site and reviewed the site plan on November 8,
2005. The site consists of approximately 135 acres which is proposed to have a
concrete and asphalt batch plant, a recycling plant, materials blending, import of
materials and gravel mining. Included in the submittal were an Application for Weld
County Use by Special Review Permit for Mineral Extraction and Processing by Banks
and Gesso, LLC (10-11-05), a vicinity map, an index map and operation policies, an
extraction plan map, and a landscape, screening and buffering plan by Banks and
Gesso, LLC (8-26-05; 9-12-05).
1. Subsurface.
According to the Geologic map of the Boulder-Fort Collins-Greeley Area, Colorado
(Colton, 1978), the site is underlain on the northwest part by Broadway Alluvium, which
consists of sand and gravel deposited by the South Platte River. The southeast part is
underlain by Piney Creek Alluvium, which consists of sandy to gravelly alluvium
containing organic matter. According to the Potentially Swelling Soil and Rock in the
Front Range Urban Corridor, Colorado (Hart, 1974) there is low swelling soil potential
on the property. These subsurface conditions pose no geologic hazards that would
preclude the proposed development.
2. Groundwater.
According to the State Engineers office, the water wells of adjacent landowners are
relatively shallow, ranging from 22 to 48 feet deep. The wells are located in a near
surface, unconfined alluvial aquifer. The wells of adjacent landowners may be
susceptible to dewatering if gravel extraction operations are deep enough to affect the
local ground water table. The applicant should be referred to the Division of Water
Resources to insure that all permits are secured which will prevent disruption of
adjacent landowner's water wells.

3. Oil and gas operations.
The oil and gas agreements in Appendix H were not included in the submittal to the
Colorado Geological Survey, but should be reviewed by the county to insure that the
gravel extraction operationtdon't interfere with the long-term oil and gas operations on

In conclusion, if the recommendations listed in this letter are followed then this office
has no further concerns regarding the geologic hazards at this site.

Subject: Proposed Wattenberg West Sand and Gravel Mine, Asphalt Paving Company
The West Adams Conservation District has requested assistance from the Natural Resources
Conservation Service(NRCS) in answering your request for reclamation information for permit
applications for the proposed subject sand and gravel mine in Weld County. If approved, future
reclamation of the mine site will be completed to reclaim the affected land to a lined water
storage reservoir. We offer the following general information that pertains to many sand and
gravel mines in the Platte River drainage. It addresses recommended handling of topsoil and
overburden, reservoir final reclaimed slopes, reclamation re-vegetation and recommended seed
mix.
Topsoil and Overburden Stockpiles
The NRCS recommends that topsoil stockpiled for reclamation be segregated from other spoil.
The topsoil and overburden stockpiles should be graded with final slopes preferably no steeper
than 4H:1 V. Slopes that are less steep allow easier maintenance, are less susceptible to water
erosion and more readily establish grass protective cover.
It is highly recommended that topsoil and overburden stockpiled over 30 days be seeded
immediately as weather pu nuts to protect the soil. The immediate seeding of these stockpiles
should be done to avoid soil erosion from wind and water, as well as from a weed standpoint.
Weeds are very invasive and move onto disturbed areas very quickly. Some of these can be
noxious weeds and require control based on the state noxious weed list. Through immediate
seeding to promote temporary cover, the opportunity for weed invasion will be less, as will the
potential for erosion. For seeding the stockpiles, Luna pubescent wheatgrass and/or Amur
intermediate wheatgrass are recommended, both of which will establish readily and quickly.
This temporary seeding should be done at a rate of 15 total pounds PLS per acre.

You may want to contact Ron Broda, Vegetation Weed Management Specialist with the Weld
County Public Works Department at (970) 356-4000 X 3770 to coordinate weed treatment plan
development and implementation, and to ensure compliance with the Weld County code and the
Colorado Noxious Weed Act.
Water Storage Reservoir
It is recommended that the final reservoir slopes be no steeper than 3:1, and preferably less steep
such as 4:1 or 5:1,to permit eventual use of the reclaimed water storage reservoir by wildlife.
Steep slopes can discourage wildlife from approaching and using the water reservoir.
Reclamation Re-Vegetation
For those areas to be reclaimed, it is recommended that 12 inches of topsoil be spread in lifts not
to exceed 4 inches and worked into the slopes to ensure good adhesion and to minimize soil
creep. In order to re-establish normal levels of microbial activity in the soil, compost at the rate
of two cubic yard per 1000 ft2 should be mixed with the soil. If compost is not applied, following
topsoil replacement and before grass is seeded, the soil should be tested to determine the need for
additional fertilizer. Recommended grass seeding dates are from November 1 s`through April
30th; seeding should be done in unfrozen soil. A good quality grass seed drill with an agitator,
depth bands and press wheels is recommended.
The following native grass seed mix and application rate is recommended for re-vegetation in the
soil types found in the mine area. It is based on NRCS "critical area" seeding rates that are
double our normal rates.

Note: If seed is broadcast, recommended rate should be

We recommend mulching re-vegetated areas with clean weed-free straw or native hay. It should
be applied at a rate of 4,000 pounds per acre and crimped into the soil to anchor it. Crimping
should be cross slope or on the contour, if possible. The State of Colorado has a list of certified

weed-free straw available on the intemet or it can be obtained through local county extension
service offices. All surface water should be diverted away from the re-vegetated slopes to a
point where it can safely flow down slopes without the potential of serious soil erosion. Weeds
in the re-vegetated areas will need to be controlled by mowing until grasses are established,
usually the first four years after planting for native species.
