In response to the NOTICE TO SURROUNDING PROPERTY/MINERAL INTEREST
OWNERS from the Weld County Planning Department, Case Number: USR-1574 dated
August 10, 2006.
AGPROfessionals, LLC represents TV Dairy and its owner, Mr. Marvin TeVelde
regarding the notices for and issues surrounding USR-1574. TV Dairy is located at:
7678 WCR 17, Fort Lupton, CO 80621
TV Dairy neither supports nor objects to the activities of the New Hope Family Christian
Church, children's center and private school, and supports the full use of private property
according to applicable and allowable regulations and requirements. However as the
owners of a nearby Dairy Confined Animal Feeding Operation, there are some concerns
that can be alleviated with this notice. TV Dairy wants to publicly notify New Hope
Family Christian Church on record of the Weld County"Right to Farm" policy and the
necessity for protection of agricultural practices in the Agriculture Zone. While many
non-agricultural uses are allowed in the agricultural zone, New Hope Family Christian
Church is choosing to locate in the only zone designated for confined animal feeding
operations. New Hope Family Christian Church must be aware and accept that there are
certain conditions and long-standing best management practices that exist in the
Agricultural zone which may not be aesthetically pleasing to all persons voluntarily
engaging in non-agriculture uses in the Agricultural Zone.
TV Dairy supports private property rights and the ability for landowners to use their
property for the maximum allowable financial use or activity.
Obviously, New Hope Family Christian Church is growing and planning for the future
and we commend them. To that affect, TV Dairy would also like to enjoy the full use of
their property including any potential future planning and growth of the dairy with the
same consideration given to the Church.

We would respectfully request the Weld County Planning Commission and the Weld
County Commissioners craft a condition of approval to that effect. To assist, some
suggested language may be:
"New Hope Family Christian Church is aware and acknowledges that 1) an
existing confined animal feeding operation currently exists in close proximity, 2)
there may be longstanding, acceptable and legal activities of the operation that
may not be aesthetically pleasing to all persons voluntarily engaging in non-
agriculture uses in the Agricultural Zone, 3) Weld County has a "Right-to-Farm"
policy, and 4) the Church will not object to any traditional, legal and/or
allowable activities, evolution or extension of the confined animal feeding
operation. "
TV Dairy is considerate and cooperative with all its neighbors and we wish them success
