RE: EMPLOYEE UTILIZATION OF COUNTY SHOPS ON OFF-DUTY HOURS.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners are in receipt of the attached
request from the employees of the Weld County IGA Shops, concerning the utili-
zation of the Shop facilities on off-duty hours for the purpose of repairing
their own vehicles, and
WHEREAS, it has been past practice to allow employees of the IGA County
Shops to work on their own vehicles in the County Shop after normal working
hours, and on weekends, because the employees are required to have their tools
at the County Shops for the County's benefit during the performance of their
duties as mechanics , and
WHEREAS, a research of the records indicate that there is no specific
County policy addressing the issue of authorization to work on their own
vehicles in the County Shops after normal working hours and weekends , and
WHEREAS, employees of the IGA Shop have requested such authority via
the attached letter, hereby referenced as "Exhibit A" and made a part of this
resolution by reference.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners
hereby authorizes IGA County Shop employees formally to work on their own vehicles
in the County Shops after their normal working hours or on weekends with the
following rules and restrictions :
1 . Permission to work on vehicles has to be obtained from supervisors.
2. No vehicle would be left in the Shop during normal working hours .
3. Only immediate family, private vehicles can be worked on. Proof of
registration may be required.
4. All parts or supplies will be furnished by the individual car owners .
Proof of purchase of parts and supplies could be required at any time.
5. Abuse or misuse of this privilege would result in immediate revocation
of the resolution authorizing use of the Shops by specific individuals or all
individuals .

6. A sign-in and sign-out log must be maintained by the Equipment Service
Manager to account for the individuals using the Shop after hours.
7. All Shop employees must sign a hold-harmless agreement, prepared by
the County Attorney, and a receipt of this resolution specifying the rules and
regulations prior to being allowed to use the County Shop after hours .
8. Only County Shop employees will be permitted in the Shop during off-
duty hours. Persons other than County Shop employees are prohibited from
entering the Shop during off-duty hours and will be considered tresspassers.
Signs indicating this will be posted at all entrances.
BE IT FURTHER RESOLVED that Personnel include in the job description for
all positions of mechanics, the requirement of providing their own tools and
equipment for the performance of their duties as Weld County mechanics, and
BE IT FURTHER RESOLVED that all employees be informed by the posting of
this resolution in a conspicuous place at the IGA County Shops, that Weld County
assumes no responsibility for loss or stolen tools of employees.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote on the 6th day of February, A.D. , 1980.

s"n;ect: Use of County Shop to Work on Private Vehicles
The attached letter on the above subject is forwarded for consideration .
There are some advantages and disadvantages to both sides in this matter .
As pointed out in the mechanics letter, the increased security, furnishing
of even the basic hand tools not required by the job description and
occasional repairs they do during off hours are a definite benefit to
the county.
The mechanics are concerned about theft of their personal tools . Some
of them have as much as $4,000 .00 - $6,000 .00 invested in tools and
some even more . This shop and other county shop buildings have been
broken into in the past . Only a "gentlemans agreement" seems to be in
effect as to replacement of tools if they are stolen.
From time to time , they need to work on their own cars . Past practice
was to permit them to use the county shop to do this since their tools
were kept here .
From another point of view, there are very serious questions of liability
in case of injury to a person while working alone on his own vehicle .
There is also concern about safety should a person become trapped or
injured while here alone .
Permitting private use of a publically owned facility like this could
be reason enough for non-shop employees requesting the same privileges .
Mechanics throughout the country furnish their own hand tools on the job
as a common practice . This has been an accepted part of the profession
for many years . The employer in most cases furnishes special and larger
tools as needed . The amount of tools owned by individual mechanics
generally go hand in hand with their job requirements , experience and
pride in their ability.
As pointed out , current regulations prohibit the use of county property
or equipment on private projects or vehicles unless a resolution is
passed by the Board of County Commissioners permitting it . If such
a resolution is favorably considered, some very definite rules and
restrictions should be established .

Subject: Section V , Paragraph 6 of the Weld County Administrative
Code
We , the shop employees of Weld County IGA Shop request that the
Weld County Board of County Commissioners consider a resolution
authorizing the shop employees to work on their own vehicles in
the County shop after their normal working hours or on weekends .
This is currently prohibited by the above section of the administrative
code . Reasons for this request are as follows:
1 . Increased security of shop and yard area.
By shop personnel being in the area at irregular times on
weekends or evenings , it provides additional protection
against breakins and theft . There is no county policy on
insurance against theft of personal tools that are in the
county shop.
2 . Mutual benefit in use of tools .
The mechanics have only one set of tools . Many of them have
several thousand dollars worth of tools that are not required
tc be furnished by them. By having these specialized tools
they are able to perform work on county equipment more
efficiently. If they must take these tools home to work on
their own cars for several days , it could affect repairs on
county equipment . Mechanics are the only group of county
employees who must have such a large personal investment in
tools and equipment in order to perform their duties as county
employees . Current job descriptions do not require this
investment by any mechanic .
3. Call in of personnel for minor emergency situations .
In the past there have been instances where a county vehicle
needed repairs during off times while someone was here at
the shop. This was accomplished without having to call
additional personnel in to do the repair. Another time a
gasoline pump was damaged by a Sheriff' s deputy not removing
the nozzle from the gas tank on his car. This was repaired
without calling anyone in.
If this request is favorably considered, it is recommended that
the following rules would apply:

2 . No vehicle would be left in the shop during normal working hours .
3 . Only immediate family private vehicles can be worked on . Proof

Subject: Use of IGA Shops by mechanics
Wayne Smyth has requested of me the development of a resolution concerning the
utilization of County Shops by mechanics on off-duty hours. In this discussion
he indicated that he had discussed the matter with your Board, and it was agreed
that, with the exception of the attached resolution, all of the matters could
be handled administratively. Based upon my understanding of the situation and
Wayne's request, I have developed the attached resolution which, in my opinion,
would clarify and formulate a Board policy regarding the matter, and protect the
County's interest and property.
If I hear no objections from any Board Member concerning the proposed policy, I
will place it on the agenda for Wednesday, February 6, 1980.
