RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1590
FOR AN AGRICULTURAL SERVICES ESTABLISHMENT, INCLUDING A LIVESTOCK
CONFINEMENT OPERATION (A CALF RAISING OPERATION FOR UP TO 5,000 HEAD)
IN THE A(AGRICULTURAL) ZONE DISTRICT - CONTRERAS FARMS, INC.
A public hearing was conducted on July 25, 2007, at 10:00 a.m., with the following present:
Commissioner David E. Long, Chair
Commissioner William H. Jerke, Pro-Tern
Commissioner William F. Garcia
Commissioner Robert D. Masden - EXCUSED
Commissioner Douglas Rademacher
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 1, 2007, and duly published June 6, 2007, in
the Fort Lupton Press, a public hearing was conducted on June 20, 2007, to consider the request
of Contreras Farms, Inc., for a Site Specific Development Plan and Use by Special Review
Permit #1590 for an Agricultural Services Establishment, including a Livestock Confinement
Operation (a calf raising operation for up to 5,000 head) in the A (Agricultural) Zone District. At
said hearing the Board deemed it advisable to continue the matter to July 25, 2007, when the
applicant's representative could attend. On July 25, 2007, Bruce Barker, County Attorney, made
this a matter of record.
Chris Gathman, Department of Planning Services, stated the applicant's representative has
submitted a request for a continuance, marked Exhibit H. He stated a portion of property to be
included within the Use by Special Review Permit boundary is under separate ownership, and the
closing for the property has not yet happened. He further stated an Attorney handling the water
issues on the site could not be available today. In response to Commissioner Jerke, Mr. Gathman
stated the property owner is currently in violation of the Weld County Code, and the case has been
continued once previously. Upon conferring with the Acting Clerk to the Board, Mr. Gathman
suggested continuing the case to August 22, 2007, at 10:00 a.m.
Patrick McNear, Scott Realty Company, represented the applicant and stated he requested a
continuance due to the difficulty of obtaining financing for the property to be purchased. He stated
the applicant's lender should have completed the required financing paperwork in June, 2007;
however, it was not completed,therefore,the closing on the property has been delayed. He further
stated he feels it is important to have a completed Augmentation Plan in place before the hearing,
which is not yet finalized. In response to Chair Long, Mr. McNear concurred with continuing the
matter to August 22,2007,and stated the Attorney handling the water issues will be present on that
date. Responding to Commissioner Jerke, Mr. McNear clarified the applicant is purchasing an

additional 80 acres to combine with the 70 acres he currently owns. He stated the applicant is also
purchasing water rights.
No public testimony was offered concerning this matter.
Commissioner Jerke moved to continue the request of Contreras Farms, Inc., for a Site Specific
Development Plan and Use by Special Review Permit #1590 for an Agricultural Services
Establishment, including a Livestock Confinement Operation(a calf raising operation for up to 5,000
head) in the A (Agricultural) Zone District, to August 22, 2007, at 10:00 a.m. The motion was
seconded by Commissioner Rademacher, and it carried unanimously. Commissioner Jerke
cautioned the applicant's representative that the Board will not consider another continuance
request. There being no further discussion, the hearing was completed at 10:15 a.m.
This Certification was approved on the 30th day of July, 2007.
